External - from customers or people outside the company (or surrounded by your case, ethnic group you don't know).
Can i use SMS to advertise alcohol and cigarettes?
Answers: No.
Legally, I know of no specific prohibition on the use of SMS to send advertisements for alcohol or cigarettes, although there might be such a law (note that there may be laws in any state in the US, or federal laws or regulations that apply). This is not something I have specifically researched, though I know that in the early 1990's, California passed a law prohibiting payment for alcohol or tobacco content in video games.
There are probably laws against sending unsolicited text messages, since recipients often must pay. There are probably "terms of service" for your service providers that prohibit such practices, and those terms may also specifically include promotion of alcohol and tobacco.
However, I am quite confident that it is illegal to intentionally direct advertising of alcochol or tobacco products toward minors, and I believe that SMS text-messaging is used more by those under 18 than by those over 18 -- almost certainly, those under 21 account for more than 50% of all SMS traffic. Thus, even if you sent advertisements only to people who "agreed to accept them," such as people who opted into an SMS messaging service, you would almost certainly be targetting minors.
Such advertising might also violate the terms of the various "tobacco settlements" over the past 10 years or so, under which the manufacturers of cigarettes agreed to additional conditions; such terms might not extend directly to you, but would probably result in your suppliers or wholesalers terminating your supply.
It's also morally wrong.
Just don't do it.
