If my company manufactures items and I want to confer them model #s, do I have to exclusive rights (copyr/tradem?) those numbers. I hold seen honourable off-brand designs. I think one of the basic points is who is making them. The manufacturer might not hold the budget for a marketing/design staff so they get by cheaply next to one designer that is so-so. I won a local design competition award and my budget be $25 on the project. My competitors were local design agencies beside big "brand" clients and huge budgets and a design team. I won because the design be good. Like someone else said though. People buy the off-brand because they are cheaper, not because they look devout. But...can you imagine how better sale would be if they DID?
