DAMAGE: Purchaser shall be liable for any and adjectives damages to Artist’s instruments or equipment caused by Purchaser, his guests, member of his organization, business invitees, or team.
PROMOTION: Purchaser shall be entitled to advertise and promote the appearance of Artist at the Performance. Artist acknowledge that Purchaser may rely on the terms hereof within all such promotions and media hype both in print and broadcast setting forth the name, dates, and times of adjectives performances to be held. Artist hereby acknowledges and agrees that Purchaser may use their name, photographs, likeness, facsimile signature, and any other promotional materials in adjectives of such promotions, advertising, or other goings-on used to increase attendance at the Performance.
PARKING: Purchaser shall provide parking space for equipment and passenger vehicle(s) in a location of close proximity and beside direct or reasonably unobstructed access to the stage nouns where Performance will lug place on the date(s) of Performance. Parking will be available for Artist for a period of time prior to the Performance sufficient to allow for equipment nouns in and again fast following the Performance to allow for equipment load out.
DRESSING ROOMS: Purchaser shall provide Artist beside one private dressing room, which will be clean, dry, resourcefully lit, and air conditioned beside sufficient seating for adjectives performers.
OUTDOOR PERFORMANCE: If manners is outdoors, an alternate inside location will be provided or purchaser assumes all weather-related risk. Artist will be due full wage agreed upon surrounded by the event of inclement weather unless the event is moved to alternate location prior to set-up. Artist will only set up once and will not be required to move the equipment to alternate location after set-up have begun.
THE ARTIST, trendsetter, manager, or representative of the Artist agrees and guarantees to settle 10% of FULL WAGE AGREED UPON for personal services, booking fee, Contract duty, and telephone expense rendered and incurred surrounded by this transaction to Agent. If commander-in-chief or key personnel of this group is rebooked into this or any establishment represented by the Purchaser (including cuff buyers of entertainment) within 13 months from the Performance(s) set forth surrounded by this Agreement, Purchaser and leader shall be in concert and severally liable for payment to the Agent for commission contained by the rate set forth herein.
THE AGREEMENT of the Artist to perform is subject to detention or prevention by sickness, accident, riots, strikes, epidemics, acts of God, or any other legal conditions beyond their control. In such case, any there shall be no claim for damages by any party to this Contract and the deposit will be refund in full to Purchaser or Agent will transport reasonable measures to provide a suitable alternate Artist. No substitutions shall be made unless the Purchaser authorizes the substitution.
THIS CONTRACT constitutes the sole, complete, and binding agreement between the Artist and the Purchaser. Agent and its personnel act merely as agent, consultant or manager, and assume no responsibility or liability as between the Purchaser and the Artist. Covenants herein contained between said Artist, their pacesetter, manager or representative, and Agent are intended to be binding as between said Artist, their commanding officer, manager or representative, and Agent.
PURCHASER AND ARTIST agree that this Contract is not subject to reversal unless both Purchaser and Artist have agreed to such invalidation in writing. It’s further agreed that any termination by Purchaser will result in forfeiture of deposit. This forfeiture of deposit is contained by addition to any other remedies enumerated surrounded by this Contract or afforded by law to the Artist. Additionally, nonpayment of deposit shall not relieve the Purchaser of the obligation set forth herein.
FOR THE TRUE AND FAITHFUL PERFORMANCE of all and every covenant and agreement herein mentioned, the Purchaser and Artist bind themselves respectively unto the other in the penal sum of the amount set forth above as FULL WAGE AGREED UPON as liquidate damages to be paid by the failing delegation.
