Can my employer treat me smaller quantity usefully because I suffer from work related stress?
I have only just been on 'long occupancy sick' due to work-related stress, as diagnosed by my GP. On my return to work, my employer advised me that I be not entitled to indisputable 'reasonable adjustments' and condsiderations going on for my working environment. When I challenged this ruling I was told that I could not hold these benefits because I had suffered from work-related stress, but if it have just be stress (non work related) I would have be entitled to the benefits. The 'reasonable adjustment' that I have requested was a phased return to work.
I get the impression that my employers decree was unreasonable as work related stress is no less of an condition than 'regular' stress. Is this right?
Answers: Although the answer they gave you is lame it doesn't situation. You are physically unable to get something done the job duties that you be hired to do. They can and probably will fire you. You will not be able to collect job loss because one of the questions asked on weekly telephone in is "are you competent to physically perform the position duties for the type of work that you do". If you answer yes then the employer will quarrel it and you will lose the appeal.
Your employer is right. Work tends to be stressful, to be precise why it is 'work' not playtime.
What type of stress-reducing accomodations were you looking for?
- extended deadline?
- lighter work assigments?
- lowered expecations?
if you were given any of those, how do you reflect on your co-workers would react?
You own 2 choices. 1) Man-up and cope w/ it. 2) Find a different job.
Employment tenet can be tricky and is very complicated. If your employer have half a brain he will enjoy checked with his court department or solicitor on this issue before giving you this counsel. If he hasnt then he is treading on remarkably thin rime! A good site that will provide you free info about employment regulation and working rights (and you can probably email them the question) is ACAS. The sites source is in the box below. Good Luck.
