My Employer wishes a copy of my passport? Why?

Hello. I have be a barman at a bar surrounded by Hove (Brighton) now for seven years. I am a British Citizen born and bred. I own a National Insurance number and pay levy via PAYE. My questions is this; My Employer have asked me and everyone else who works for this bar and others surrounded by the small chain of bar, for a copy of our passports. 1) is this a legal requirement? 2) Why do you presume they have asked me for this? 3) Can I stay away from? Any help would be appreciated. Thank you.

Answers: It is standard procedure within the current employment climate following changes to employment directive made 2-3 years back, whereby an employer risks have action taken against them if they do not ensure that their organization are permitted to work in the UK and also hold a record of how they own checked employees eligibility to work contained by the UK.

The company I worked for at the time the rules changed took a copy of everyone's passport and, where applicable, copies of work permit so as not to discriminate against anyone. If an employee or potential member of staff doesn't have a passport which proves right to work contained by UK, there are other documents which should be provided (long birth licence and something else).

Of course you can refuse, but if you enjoy nothing to put away why would you?

EDIT: TEXT TAKEN FROM http://www.businesslink.gov.uk/bdotg/act...

It is a criminal offence to make use of anyone subject to immigration control who is aged 16 or over and who doesn't have consent to work in the UK or to do the type of work that you're offering. The maximum cost is currently lb5,000 per illegal hand on summary conviction in a magistrate's court. However, near is no upper limit to the fine imposed by a Crown Court following indictment.

Under the Asylum and Immigration Act 1996, an employer is defined as a human being who employs an individual beneath a contract of employment. This can be a contract of service or an apprenticeship. The contract can be expressed either vocally or in writing. Before you enter into a contract of service next to a new hand, you will need to check their entitlement to work surrounded by the UK in charge to establish a defence against conviction.

Check and keep hold of a record of artistic documents confirming an individual's entitlement to work in the UK previously employing them. Specified documents, if see and photocopied or scanned using Write Once Read Many technology, such as a CD-R, may provide employer with a statutory safety.

There are two lists of documents that provide a statutory guard against conviction for employing an private migrant worker. The first list is of documents, which includes secure types of United Kingdom passport, that provide a defence as standalone documents. The second is a catalogue of documents that provide a statutory defence against conviction surrounded by combination with another document, such as a P45 together near a certificate of registration or naturalisation as a British citizen. Find these list and further guidance outlining reasonable steps you should cart when checking documents on the Border & Immigration Agency (BIA) website.

And if you go http://www.bia.homeoffice.gov.uk/sitecon... and click on comprehensive guidance you will find a account of all documents which can be permitted if the individual does not have a passport, such as a full birth permit.
Fairly standard these days I reckon - it's to show your nationality/ that you have consent to work in this country.
Edit - I'm going to repress to add this because some of the other answers you're getting are totally misleading.I've been interviewing for a tentative job this olden month and every single employer has asked me for my passport or similar document. It is not dodgy it is STANDARD PROCEDURE.
I Would Defeinetly send regrets if he gets hold of your passport next he can get loads of info on you
A passport is a official document used to prove citizenship and for other reasons as capably. Passports are generally firm to duplicate (falsify) unlike other forms of ID. It is legal to require you to provide it if you own one, because in direct to get it you have to provide official christening.
They are gonna steal your identity and most likely put to death you and discars your body
This has to do near the employer completing a required Government document.

Employers are required to have current employees complete
the I-9 application which confirms an employees' wherewithal to work in the US. This form must be completed inwardly 3 days of the employer bringing you on board.

Part of the requirement is for two forms of credentials from the potential employee. This is something that the employer MUST do our be held liable. There are sets of documents that are required and one set requires a valid Passport.

If you do not own a Passport or don't feel comfortable using it, ask the employer what other baptism you can provide in proclaim to proove your eligibiliy to work in the U.S. Again, the I-9 have a large scope of documents that can be used to fullfill this purpose.

I'm sure this is what the employer needs this for.
Hi,

I work for a HR company and it is required officially, i think the directive has a short time ago been applied.
if you are an immigrant, you are suppose to hand over a copy of your pass port, valid visa, work visa, employment licence, etc.,

if you have the residency in a country where on earth you work, you need not to pass pass port.

next to a copy no one can do anything - if you hold any suspicion, mark the article as copy - not transact-able.

one should understand that an employer have certain statutory must to know about the member of staff, customers, etc., and it is quite but unconscious that the employer ask certain adjectives details about human resources. If they don't get equipped near all the information about their force, at times they have to obverse penal actions from Home Department.

Let us read between the lines others responsibilities.

In this case I don't see any wrong intention on your employer.
Yes it is a decriminalized requirement, your employer is liable up to lb5000 if he doesn't have proof of your identity at time of employment.

I wouldn't be concerned, adjectives employers are required to verifiy identity of ALL workforce whether black, white or brown, British or otherwise.

Providing a copy of your bio page yourself and let him check against your passport should do, this way you don't part of a set with your passport.
All employer in the UK are required by ruling to ask for your passport as proof of eligibility to work in the UK. Perhaps that imperative has come into force inside the last seven years and that's why you've never be asked before, but they are noticeably supposed to ask. If you don't comply and give it to them, they can cancel you, as they can argue that they can't be sure that you are legally allowed to work within the UK. If they were found to be employ illegal immigrant, the penalties would be severe.

No, have an NI number and paying PAYE does not prove that you have a legally recognized right to work here. If you've ever had the right to work within the UK, then you'll hold an NI number, but just because you once have the right doesn't mean that you still do very soon. As an example, an Australian that came to UK on a Working Holiday Visa would hold an NI number, but eventually that visa is going to expire and they won't have a right to be here. Of course you payment PAYE, it's deducted from your paycheck by your employer, so once again this does not signify a right to work here.
What near illegals working in such work as yours it is clear they want proof, maybe they enjoy had a directive from the Workers & Penstions to do this and they want proof of personnel. You can ask when giving your
copy of the passport.Nothing sinister in the request.
Forget some of the answers here, as they may be wrong.

They are fantastic and hold helped me and my hubby so much contained by the past surrounded by regards to employer "rules"
Good Luck!
Hey, let's get this straight right very soon. You have no legalized requirement to hold a passport if you have a UK birth tag. If you don't have a passport you can't offer them a copy of it.

All the answerers who say differently are misguided, delude and downright wrong.

P.S. Please read what 'sussexdan' is saying contained by his question previously answering.
Under the Asylum and Immigration Act 1995, employers are required to make a purchase of proof that everyone they employ have the right to work in the UK. In demand to treat everyone the same, they hold to ask everyone for this info, even if they are clearly British. There are other documents which you can produce to prove your right and these are probably listed on some website somewhere.
One piece is clear however - it is unlawful to photocopy a Uk passport. Your employer can look at the passport if you bring it to him and then register down that he has see it, but he may not photocopy it.
He is probably making sure you are not an illegal (i hope) I would set aside to show him your passport in your presence but no copy. Better still only just say you don't hold one. Identity theft is a genuine danger to you or worse if used out of the country to get a replacement passport etc, yes i would be worried
It's not a legalized requirement, but quite run of the mill in my experience, as it provides evidence of citizenship and work rights (i.e. whether you're European or not & whether or not you own a visa). It also provides them with lawful photographic ID to prove that you are who you say you are. I focus they're probably just covering their back, maybe worried something like someone there working dishonestly (as some people own been given NI numbers who shouldn't hold them) or someone committing some kind of fraud. You can shun, but if sacked, a tribunal probably wouldn't adopt this as an unlawful dismissal. My employer has a copy of my passport as proof of ID and as piece of obtaining a CRB check, which wouldn't be basic for your job.
Ask him if you can submit a photocopy and win out your passport number.

Its a bit strange why he asked you for it, Your passport is your identity. So why should he want to get a hold of it?

Id find a topical job.

We are a non profit in CA that would like to have volunteers, what laws are there on this issue?

Answers: Tim is correct! There are really no "laws" on having volunteers. Do make sure you have the insurance to cover them.
I would also like to add if your non-profit deals with children, I advise you to make sure that all volunteers are fingerprinted and background check if they're working directly with the children. This is for the safety of the children as well as it not hindering the reputation of your organization.
There are no laws. Since they are volunteers they are not affected by labor laws.

Make sure you have liability insorance for the non profit as the non profit can be held liable for the actions of its volunteers.
There ARE laws that affect volunteers -- shame on the other two posters for saying otherwise! Volunteers are covered by all the same health and safety rules as those that protect your paid staff and customers. Organizations MUST follow state and federal laws regarding volunteers who will work unsupervised with children, for instance. There are volunteers who have sued and WON in court for wages, for instance, when an organization has been shown to involve the volunteers in an effort to replace paid employees. Here's an article that provides more examples of this:
http://www.laborlawyers.com/showarticle.

Visit http://www.energizeinc.com for all of the best books *anywhere* regarding volunteer involvement. Books by Linda Graff would probably be best for you, as they are focused specifically on risk management in volunteer involvement. I'm a big fan of her book "Beyond Police Checks."

As you are new to volunteer involvement, I also recommend the electronic book on the Energize site, "The (Help!) I-Don't-Have-Enough-Time Guide to Volunteer Management" -- it's a fantastic, basic step-by-step guide.

The Internet is also filled with sample volunteer policies and procedures you can use to create your own. Just use G00GLE to find them.

Your area may have a DOVIA chapter -- Directors of Volunteers in Agencies. Call your local volunteer center (you can find such on the Points of Light Foundation web site) and ask them if there is an association of volunteer managers in your area.

There are also many certificate programs in volunteer management -- you can find these using the Internet as well. Your organization should consider having at least one person from your organization go through such a program, to learn about the basic fundamentals of volunteer management.

Don't let fear of being sued or being fined stop you from involving volunteers. Any activity incurs risk, such as walking out your front door. There are plenty of resources out there to help you do volunteer involvement right. It's just a matter of you connecting with them and using them. Get your systems and knowledge in place FIRST before you start recruiting volunteers!
