My friend hasn't recieved her W-2 form from her Temp agency and they say they take it, is that legal?

She is entitled to her w-2 form from what ever company she worked for.
I would have her call there human resources department or the person that does there payroll.
She would get a W-2 from the temp agency, NOT the employers that she worked for...b/c the employers pay the temp agency, not her.
The employers don't send a temp agency a W-2.
The temp agency has until 1/31/2008 to postmark it to her home.
They are required by law to mail the W-2 today at the latest. She should ask to speak to a supervisor at the temp agency.
