Do I own rights contained by this concern?

I was fired today because I have called contained by sick 3 times while still on my probationary period. One episode was excused by my doctor. I am 6 months pregnant and have worked on the same floor as where on earth I will be delivering, alongside my OB. I know that you arent supposed to appointment in while on "probation", but everyone, including my superiors know I was pregnant when I be hired. It's not like I call in sick cos I be out partying the night beforehand. I guess there is nought the union can do nearly it because I wasn't covered by them yet, but someone is going to look into it for me. Just wondering if I enjoy ANY rights in this thing and what I can do to get my position back. All your assist is appreciated.

Answers: There is nothing that you can do within this situation. By your own admission you stated that you call in a few times while still on probation. Probation in essence is a trial run or as some enunciate an extended interview to determine you work ethic and overall fit for the position. Missing time during that period is a red flag.

Pregnancy does not excuse you from work nor does a doctor's memo. Only way that calling surrounded by for pregnancy related reason would not impact you is if you be covered by FMLA and had intermittent confer on. To qualify for that your employer must have at lowest 50 or more employees, you must hold been employed near the company for one year, and have worked 1250 hours, which does not enjoy to be consecutive. Since you were still on probation, you did not qualify for this.

You will probably not capture unemployment from that company any because of your short job tenure. It would also be a stretch to achieve your job put a bet on. My advice would be to verbs from this situation as to keep stress down to a minimum and focus on have a healthy infant.
I'm pretty sure you had to enjoy been missing for three unexcused days. One of those days was excused by a doc...so that doesn't count.

also, when your pregnant, it considered a interim disability...

so you have some core issues you can fight.

Contact your HR or EEO.
I definetly grain for you in this situation. I be fired my last place of employment after one diagnosed with a staph infection, despite have a doctors note stating I be still contagious (sp?) and could not return to work for several days.

Try calling your local labor board and/or a free consultation with an attorney. That is your best bet as they will better know the law in your nouns.

Even with "employment at will" you may hold a chance given your situation.

Again, as someone who go through this situation I wish you the best of luck.
Your answer depends on what state you live within, since the laws alter. I'm in CA. If you are too, than your answer is as follows:

Yes, you can be fired, as long as you are terminated beneath the "'At-Will" agreement, which you signed at time of hire.

And yes again, you can be fired for having excessive absence. The only one that can NOT be held against you, is the one that be excused by a physician. The other two, since they are not excused, can and will be used against you to terminate your employment officially.

If you have further question in this event, contact your local Labor Board. They are very thoughtful.

Three times during probation is pretty excessive -- no matter what the function. A doctor's note have no legal attitude unless you were covered lower than FMLA. However, since you said you were contained by the probationary period, I'm truthfully certain you haven't be there for a year, as a consequence you wouldn't be covered under FMLA.

Unless you enjoy a contract in place you're simply out of a career.
Contact a local employment attorney. You may have a pregnancy nouns case which could be file with the EEOC (www.eeoc.gov). But your local attorney requirements to look at your state's laws and the federal law to see if you do have a casing.

You are right, calling in sick while on probation will usually attain a person fired and in that is nothing that can be done. However, your pregnancy complicates things. The employment attorney stick assoc is at www.nela.org
soory that why it is called a probationary term to see if you like them and they similar to you, you can be terminated without inflict and have no recourse.
