In my experience, management be just as (or sometimes even more) incompetent than the general public they put in the positions contained by the first place. So, there go it: the trickle down effect of stupidity.

But I hear ya.... 1) Management doesn't want to open themselves up to a lawsuit, whether or not it's even defensible. For example, if the co-worker were spoken to, s/he could bring seriously pissed off, and bring some charges against the company.
2) Less dramatically, tons manager-types are AWFUL communicators when it comes to critiquing or reprimanding. It's not usually from a lack of concern, but from suspicion of having to confront a potentially hostile member of staff. Managers would often consent to the nature of department relations run their course - despite the fact that they may irritate and even lose more advisable employees, such as yourself. That is on the whole due to incompetent upper management.
