There is no regulation prohibiting this information from being disclosed. However, standard business practice is not to disclose litigation. I wouldn't verbs about it--your verbs will make your prospective employer wonder what's going on and they will doubt the inocuous hint you will receive.
Why would you put this company down as a reference?? First of adjectives, you put individuals down as references. Second, you solely put people down who you know will pass you a good insinuation. And you know they will give you a moral reference because you own double checked by ASKING them if they will give you a devout reference.
