Unfair dismissal!?
Question:
Can anyone help, or simply some advice would be accurate.
My brother and I have worked for my uncle contained by a local business for nearly ten years. my brother decided he needed to start his own rival business , not having much of a relationship next to my uncle and left, but because he is starting a rival company my uncle, even though it would be detrimental to his own company sack me too saying in that is nothing he could do, he could not trust me,cos I am so close to my brother, and any tribunial would agree near him undoubtably.
Surely this is unfair dismissal, 10 years... I know alot of ethnic group will say that I should budge in beside my brother and I suppose I have no choice he have forced my hand!! I would be glad about any opinions.
Answers:
Your uncle is without a doubt thinking in expressions of 'conflict of interest'.
This would seem close to a fair point, except for two things:
1- You own had no quantity in the creation of this difficult situation,
2- The reality that you have be a commited employee of your uncles firm for ten years, and the certainty that your uncle is also close family, would miserable that it would be mainly within your interest to remain loyal to your employer.
I can't really see that your uncle's paranoia about what you might do would be see as just basis for dismissal.
It would certainly be within your interests to speak to a solicitor specialising in employment canon (I have some skill, but I'm not an expert), as I think you enjoy a very strong defence.
this is unfair dismissal, try speaking to your uncle again, if this get you nowhere try CAB or solicitor
This is definitely unmerited dismissal. Speak to the CAB or solicitor. Many solicitors now do free partially hour consultations and seeing as you are now redundant you should be entitled to legal aid.
Uncle or not, he still shouldn't of treated you approaching that.
contact your union, they will be capable of advise on the correct course of endeavour
You may be in conflict of interest working for your uncle.. sorry but i agree beside your uncle...
I think that if you proceeded to a tribunal, they could find you own been dismissed unreasonably. If you are a member of a trade coalition they will be able to give advice and assistance and refer you to a solicitor. Alternatively, speak to a solicitor direct who specialises within employment law.
Well, different states enjoy different laws. In California a member of staff can quit his job anytime and the employer can fire him at any time for almost any object. Your uncle may have made a mistake for describing you the reason. If you apply for dismissal and get it, possibly you should try to take him to court.
Yes, this would constitute excessive dismissal - if your uncle has has-been to go through the correct disciplinary procedures consequently it is automatically unfair. Added to that, you own done nothing wrong!
hes not obligated to hold a potential spy running a muck in his company...

Only apply for job that you are actually qualified to do, unless they state "no experience necessary". They want to see someone different. Be natty and clean, confident, sign out the 'attitude' at home! (not saying you enjoy one), but don't go into an interview acting approaching you know it all.
Employers bring tired of interviewing people that enjoy this "you owe me attitude". Go into your interviews humble and show that you're willing to swot up and be a team player. Is mission hopping merely hurting my resume?
Question:
I have a way of staying at whichever job I'm currently employed at for one and only four months. After then, I have a feeling it's time for a change and find a unsullied job. I've never have any trouble with finding a untried job, or going away my previous one. Usually, by four months, I know enough roughly the job to know 1) if I'm going to be going anywhere at hand 2) that I can always come put a bet on to it as a fall-back, since I've already learned "the ropes" and 3) that it lately isn't suitable for me.
My primary career boardwalk is that of an EMT-Paramedic, but is it frowned upon to have a multitude of short-time job? I actually do provide ability service in every errand I've performed, so it's not a quantity/quality situation.
Any thoughts?
Answers:
I understand where on earth U R coming from but some employers look at it as indecisive. Indecisive way can they trust your judgment and can the be sure U will be within to cover your shift or will U see another job U similar to better and leave them contained by the lurch. In some jobs it cost a a fitting su of money to train as well as time and they may not be relaxed when they get U where on earth they want you and U leave. I my self loved going to Temp Service and go and get jobs, because they could later from one day to a couple of weeks and they would hook U up next to another when U finished one. It was a choice of work and that made it fun. Never got bored because respectively job be absolutely different afterwards the last.
Yes, it unquestionably will hurt your chances at getting job. No employer wants to see a long inventory of jobs when they are recruit someone new, even if the reason are all lawful, like departure for better pay. I am not going to clutch the time to hire someone that may only stick around for 3 or 4 months. It really does not business if you are really good at your work, the job jump is a resume killer.
Have you thought asbout simply doing consulting projects in your pasture rzather than full time positions?
Employment tenet?
Question:
My husband has only just started work and has asked just about his contract, his colleges have told him they dont hold contracts 1 bloke has worked for the company for 15 years and said he have never recieved a contract of employment is there a statute regarding employment contracts ?
Answers:
1.) All workers have 'contracts', whether written, vocal, custom..whatever. Your husband works surrounded by a certain role, for a enduring number of hours and gets remunerated a certain amount - that's a contract.
2.) Most relations confuse 'contract' by what is in truth a written statement of particulars. This is a document outlining the essentials of the 'contract' i.e. work title/role, hours/days to be worked, pay, distinguish to be given, holidays etc. All employers are required by directive to issue employees next to a statement of particulars inwardly the first 8 weeks of employment. Refusal to issue one can be challenged at an employment tribunal, regardless of how long an member of staff has be employed beyond 8 weeks. A tribunal can order an employer to provide a written statement as in good health as awarding compensation.
Your husband would be advised to wish assistance from his union and except a member to bind one. Better still would be for all organization to be in a federation and for this to be tackled on behalf of everyone.
Yes I believe 14 days from commencing employment beside a new employer you are required by decree to be issued with a contract of employment.
Have you thought that possibly your husbands work mates might be newly messing with him?
A employer should by canon issue a contract of employment after three months continuous service. However by employees accepting a weekly/monthly pay cheque this can be understood as a contract as the exploit is accepting the paying and therefore pleased with the conditions of work.
You can claim pause of work consitions by not having a contract. However an employment tribunal will not filch your case on until you enjoy worked for an employer for one continuous year
in the uk nearby is no requirement for an employer to issue written contracts of employment, although it is in the interest of both party to do so, as otherwise if things go wrong it falls to Employment Tribunals to determine what clauses can be implied into a oral contract. In the absence of a written contract of employment nearby is what is referred to in imperative as an implied contract, ie by the employee turning up for work every daytime he or she implies they intend to be bound by a oral agreement, and the employer reciprocates by paying wages etc.
Where the confusion may pretend is that there is an condition on employers who enrol people for one month or over to issue inside eight weeks of employment starting a statement of terms and conditions of employment, which can be a single piece of rag stating normal hours of work, place of work, earnings, where disciplinary and grievance procedures can be found and what the work is. The penalty for failing to issue such a statement required below Employment Rights Act 1996 section 1 is four to six weeks of the employees' gross to be paid to that hand by the employer upon complaint to an employment tribunal.
However, this is not a stand alone claim and can only be added on to a claim for unreasonable or wrongful dismissal or some form of discrimination. The upshot of this is that it is a adjectives scenario for employees not to own contracts of employment or even sometimes statements of particulars (also referred to as wedge 1 statements). Your best bet is to persist surrounded by asking his employer for a contract or statement of particulars. Usually it is simply inefficiency on the part of the employer that one is not produced, and they usually will produce one if required for mortgage reference etc. He is within his rights to request a statement of fine points within two months of starting work, but it is adjectives to enter into dispute with an employer who fail to produce one as compensation for such a scenario is poor to put it mildly
Failing that, the absence of a formal contract does by no channel mean that one does not exist and it is big then to hang on to all evidence of the implied contract for credit purposes such as wageslips- which must be produced by canon from the employer, end of year p60 and appraisals etc.
Hope this help
I don't know of any laws any requiring or prohibiting employment contracts, although there are law and court decisions surrounded by the United States that impose public policy restrictions on what they may contain if they are used.
For example, it is not odd for courts to impose public policy restrictions on the inclusion surrounded by employment contracts of so-called "non-compete" prohibitions where the member of staff is required to sign an agreement not to compete with the company if he resigns.
These "public policy" restrictions commonly check how long such "non-compete" agreements may be enforced by the former employer against the former employee and how much geography they can cover (e.g., the hand cannot be prohibited from competing with his former employer for more than, say-so, one year or in an nouns covering more than, say, ten miles surrounded by any direction from his former employer's location).
What should I put for "Expected Wage"?
Question:
I'm applying for a job at Dennys, and im wondering what i should put down for 'expected wage'. This is my first opening and im going to be working as a waiter and i dont wanna put too little or too much, so any suggestions would be nice. I live in Cali and i reflect min wage is around $7 something, but they said they offer "importantly competitive salaries", so i dont really know what to do.
Answers:
Waiters make minimum wage. And you should expect that at Denny's. Good luck obtain your experience down and then seize out of there
probably close to 8.50 because of tips.
200k per year.
$20.00 hr
put down "negotiable"
$8.20 sounds fair
$7.50 per hour is California's minimum wage..dont put tips cuz thats different than wages
put any "n/a" or "negotiable"
Well, regardless of what minimum wage is, as a server, you can expect about $4 an hour, because it's designed to be supplemented by tips. Look closely at the minimum wage guidelines in your nouns and keep track of how much you failure up making; if you're shooting under the numbers, you have need of to take it up beside your boss.
Be reasonable, and apprehend that you aren't going to necessarily get the wage you want. If you know someone else who works near, ask them how much they make, and consequently put your expected wage a quarter or so beneath that figure. If you're highly confident or personable, you can overshoot the figure by impossible to tell apart amount, but be sure to stress flexibility in your interview.
put contained by "expected work" for "expected wage"
I have included a network link on minimum wage regulation. Currently the minimum wage is $5.15/hr. Bush has signed a bill to increase that by freshly over $2.00/hr over the next three years. Some food chains will remuneration only the minimum and others will permit you know what they start you out at. But I would put negotiable since you do not know what the starting rate is.
http://www.laborlawcenter.com/federal-mi...
Put down Minimum wage, because of the following:
1) it is your first job
2) you hold no experience in that trade
3) the more you ask for beside out the experience to back it up the more predictable you will not get the employment.
4) some waiters/waitressess make smaller number than minimum wage depening on weather they get tips or not
5) the smaller amount experience you have the smaller number they will pay you, unless you enjoy good, no great reference
6) you need to build a resume that will want them to clear you more than the average joe
if you have any question please contact me.
do what you should always do. if its an hourly paying brief put minimum or (min.) meaning minimum wage. even if you enjoy experience. think of it as a trick press on an application. the job already have a base settle up even for experianced workers nothing you do can shift that and at denny's its minimum wage. ask them how much they pay and put that down if you approaching but never put the amount of money you hope to make on an application. (min) is the standard answer.
here is nothing wrong to put an expected wage if even its your first time to work at hand. besides, working as a waiter is good because if you served your customers righteous, they will give you some tip. little by little make the trick, means to utter even though its only a nickel; it can be multiplied into few dollars a daylight if most of the customers will give you a tip, right?

Will a master's scope surrounded by Computer Science get it plentifully easier for me to find a assignment?
Question:
I am getting my bachelors in Computer Science. I'm worried roughly job stability. Would getting a masters level in CS serve me out significantly than simply having bachelors?
I want to see if its worth the time and hard work to go that extra step. Or do you believe abundantly of internship experience will help out more?
Answers:
Unless you want to edify computer science at a community college, I don't see how a master's degree will help out you get a mission, over an internship. It use to be you didn't even need a amount to get into computers, later you needed an associate degree, in a minute you need a bachelor's level. All the job testimonial I see for computer jobs require a bachelor's level, 2-3 years of experience, and certifications. I'd do an internship so you get some experience and try to achieve certifications for whatever you're interested within: networking and database certs are the hottest, though if you're into programming a java cert sure wouldn't hurt.
Check out the fastest growing job for 2004-14 according to the US Dept of Labor, six are computer jobs, and adjectives require a Bachelor's degree: http://www.bls.gov/emp/emptab21.htm...
Good luck!
Well, for starter's, any one will help you gain a job. Internship will probably give support to you get a brief faster, but the Master's Degree will get you a better mission in the long run.
Well it adjectives depends on the employer, it may or may not help. Some companies will speak your over qualified, but then again it may be lately what they are looking for. I would say shift for it, if anything you can start your own business as a computer specialist.
A modelling agency desires to represent me WHAT DO I EXPECT FOR FIRST CONTACT?
Question:
I sent some photos through an add and the agency get back to me adage they are interested in representing me.
I be suprised because even though I know im not bad looking, I never really thought I be model material. I am thoroughly comfortable with my looks however.
In the email they also stated if im available from 4-7pm on Friday.
Im interested to see where on earth this goes but I want to know what to expect for the initial contact. they want me for three hours...? So what would this mean. Should I do myself up alot (the tan, spike and make up adjectives done?) because in the pics, though they are amateur pics, I enjoy a spray tan (im fluently fair) so should I get one done for it? Or wont it business?
And are they wanting to do a few photos if it is for three hours?
Just any insight on what to expect or how I shoudl go within etc.

What's the best channel to progress from career contained by nouns?
Question:
I am currently doing entry-level finance-related accounting work in NYC, but do not hold a level in Accounting (just your standard BA from your local not-nationally-recognized college beside a lot of nouns classload). I really want to get into more of a research analyst position, or something more to do next to the management of securities for some type of fund. How do I achieve my foot in the door?
Answers:
As you probably already know, entry-level is switch when entering a field for the first time. You are at a correct start right now, but know that reaching the horizontal of a research analyst or securities manager is not a speedy ladder.
I would suggest attending a local chapter junction of the CFA Society (Chartered Financial Analyst) or CFP group, network near a few individuals and ask questions.
For post opportunities, check beside a bank (Bank of America, Bank of New York) or securities firm (JP Morgan, Merrill Lynch) and even AXA Advisors, for entry stratum positions such as portfolio manager assistant, investment assistant, or research assistant. Remember these types of positions are outstandingly competitive.

In requirement of a recap on SILVER SERVICE waitressing..?
Question:
Hey, as I said above, could someone enlighten me on the rules of silver service? How to serve, from which sides, what cutlery go where etc..anything you could give attention to of would be fab! Got a job tomorrow and havn't practised this bearing of serving for a few years. All tips would be so appreciated! Thanks in credit
Answers:
Practice with a spoon and a fork held together within the same paw (obviously) and separated with the index finger. Practice picking up tomatoes (or something else equally rolly and difficult) from a tray fair on your arm. Basically, you serve from the left and clear from the right.
Well, forks on the moved out, knives on the right, and the cutlery should shift in the writ of each savory course from outside to surrounded by...if that makes sence. So the first course cutlery should be on the outside creep, then the second course inside that, third course inside that, and so on (and any spoons needed should budge on the right hand side).
The dessert cutlery go to the top of the setting. The spoon at the top with the pedal facing the right hand, the fork underneath beside the handle facing the departed hand.
The bread plate is on the moved out, normally to the side of the forks, but sometimes above the forks. The butter run through is normally placed on the bread plate on the right mitt side of the plate to leave room for putting the bread down on the plate.
Any eyeglasses should be put to the right, above the knives. Large wine chalice for red wine, then a smaller one for white wine to the right of that, next a glass for marine to the right of that. (again, sometimes the water cup can be put first if it is the largest glass.) The smaller chalice should be slightly in front and to the right if you are man perdantic. Also, the sharp edge of the knife should all obverse left.
If near are coffee servings then this should be to the right of the knife, with the spoon on the right foot side of the cup.
Practice serving veg etc with a spoon and fork within one hand.
Serve from the vanished and clear from the right.
You should practice serving bread with a spoon and a fork too, but in our day alot of places have tongs.
Hope this help, good luck.
