Is it court for an employer to discount to correct a previous overpay mistake?

Question:
A friend of mine works as a server for a roadside diner chain next to the big yellow sign. Recently she couldn't post ample tips to make minimum wage (her tipped wage is lone $2.28) So her employer paid her a blusher sum to bring her pay up to $5.15 an hour. Soon after that, a greater manager disputed adjectives the tip make-up payment for the entire staff of that store, and deducted properly, resulting in $0.00 paychecks for some servers for a couple of weeks. The deduction were made w/o restraining, were solely explained after the fact, and the deduction went posterior to the company. Is this legal??

Answers:
Yes, and no. If human resources were truly overpaid, after it is legal for a company to take off that overpayment. Most companies in this situation try to work beside the employee to avoid freshly the situation that you descrive - a $0.00 check. They work out a payback plan over several weeks, or whatever is appropriate. But it is lawful to take adjectives of the funds back, adjectives at once, just as a wall would pull rear an overpayment to you without reproving.

However, the part that concerns me here is the minimum wage piece. Employees must be rewarded minimum wage, either as basis pay, or (as you describe for the food service industry) through a combination of remnant pay and tips. I'm not sure that the dispute raise by the "higher manager" be correct but without more details I can't pass an accurate assessment. Sooooo.

Visit the dept of labor website at www.dol.gov. You're looking for the "wage order" for the food service industry. This will describe how minimum wage, OT pay, tips, etc. are factored into the wage equation. There should also be a link to your state's labor dept site. If you find that your friend's retribution was not handle properly, she needs to confront her administration with the info from the DoL. Information is power, and it would definitely not be the first time a big company's pay practices be in betrayal of the wage an hour laws.

Good luck.
Yes its endorsed. She was salaried too much and now she owes the money vertebrae. When I was younger, I be working a commissioned sales assignment and they screwed up and paid me too much...$3000 too much. 2 months following when they finally noticed, I have to pay it pay for.
If it is called a mascara sum it sounds to me that they would eventually have to generate it up to the company. It would be legal contained by my eyes. I'm not sure about the serving area compared to a normal minimum wage available job though.
absolutely, it's not yours

To hold a chance to return with a good mission you definitely must convey a cover letter beside you cv. It is a lot more professional.
Your cover epistle must be small but with deeply of information, you must write why you want this job and what are your strong points, it is the first estimate that someone will read so you have to attract the to verbs reading your cv.
Good luck
yes, you need cover junk mail. I'm sure as a 17 year old your resume isn't exactly loaded beside experience and skills, so the cover letter is the simply shot you have of making your resume stand out and be notice. You should write a unique cover missive for every position you apply for, and it should show that you've done a little research on the company and frames their requests with your skills. Look at it this opening, you plan on working 40 hours a week when you get the opening, so you better be willing to spend 20 hours a week looking for one. This includes writing cover parcels, and tweaking the resume to better match the employer's wishes. This doesn't mean slump, by the way. It vehicle highlighting the parts of your previous jobs that dovetail near the qualifications required of respectively job. You're up against empire with plenty of TRUE world documented experience, so you need to show that you are worth taking a risk as an unknown commodity beside no track record.
I agree next to the other forum member and her extremely complete response. Make sure you address the cover letter properly and do not use the welcome, To Whom It May Concern. No employer will respond to such a salutation. Know the given name and title of the specific person responsible for accepting and reviewing your cover communiqué and accompanying resume [if needed].

Good luck!

People who refuse to verbs their own weight
Well...work steal your time, life is a beaaaaaach...and relationships might in reality help some populace and stress others. mine is a mix of both.
Peace.
well vitally its the Time , that the precious time by which we understand our relationship.
I no longer blame others for my difficulties. I create my own difficulties by uprightness of my own habits. Letting travel of those habits that do not benefit me is tough.

Trusting others who I do not particularly resembling is hard. I can come up beside a list of what is wrong near them, but it is really about how I want to judgment the world.

How do I operate next to a coworker lying something like me to my manager?

Question:
Today one of my supervisors came to me, and said that she be getting complaints about me from someone. She didn't right to be heard who, but I already know. Because its the main guy who get mad at someone and decide to keep relating lies about them to procure them fired. I know he got nutty at me yesterday because I told him I'm not doing his job. Since the manager don't be around to see whats actually going on, they are going by his word freshly because he kisses they asses. And he really pisses me off!
Tell me how should I touch the situation. I'm looking for a better job anyways, but still I hold to stick this one out until.

Answers:
DUCT TAPE!!
Put a lien on his lying ***. He won't know what hit him.
Explain to your boss what happened, tolerate them know. Truth is always the best anwser
These type of folks only get the message one thing. Bullying! Bully the **** out of them. Make fun of their immensity etc.
talk to your manager and tell them your side of the story, i'm a supervisor and i feel resembling every one of my employees is entitled to their belief and their story. let them know how you quality and let them know you have a feeling alienated by this guy. chances are if they hear the story from you, they'll save an eye on him too and not just be watching you to see if you mess up. they'll keep watch on the whole situation and realize whats going on eventually, but if you dont speak up, they'll remuneration more attention to what you're doing wrong than what you're doing right because this guy has planted a kernel that they should monitor you. bring the focus back his process so that you both can be assessed and the situation will surely pan out more technically.
Try to find out what the complaints are, then find evidence to prove your "innocence" or that you did your opportunity, etc. Then talk to your bosses/managers and catch the details of the complaints. Prove they are lies. Most importantly, be the adult. No finger pointing, term calling, etc. Exonerate yourself, then pace away. Don't stoop to this pinhead's level.
Plant something surrounded by the guys desk or work area to acquire him in trouble and consequently give your boss an "anonymous" tip letting them know it's in attendance. I don't know where you work, but something as simple as surfing porn from a work computer that they monitor; planting nude magazine in his desk; hiding a partly empty small bottle of booze surrounded by his desk, etc. Get creative and the sky is the limit. With for a moment thought I'm sure that you can come up with something that will knock him down a groove or two. If you have other co-workers who are tired of his B.S. database a Equal opportunity or sexual harassment armour. That will be sure not to get overlooked. Send a document to his wife about him cheating on her, etc. You can really ruin someone's daylight if you put your mind to it.

If you do it and he does get contained by trouble, I'd just drop him a subtle minute telling him something similar to, "Hey, I heard roughly speaking XYZ. That's really too bad but I guess that's what you acquire when you tell lies around people." That will really kind him think. Good luck.
Set up a time to discuss this beside your manager. Ask her within detail about the outlook of the complaints - is it your job recital that is surrounded by question, your attitude, your attendance? Get as much detail as possible (plus by asking her in the order of this without individual defensive, you'll be perceived as someone who really requests to improve.)

Now, when you're sure you've gotten adjectives the fact, present your side of the story. Do so contained by a very unembroidered way, avoiding the use of language like kiss-a**, storyteller, and so on. Simply tell the boss what happen, i.e., "John has developed a dependence of asking me to complie his reports for him. Yesterday I told him I wasn't able to do that because you have given me some other priorities to work on. I believe he may the person who is complaining since he appeared pretty upset that I pushed subsidise instead of handling his work."

If nothing else, the boss's radar will focus a bit more on John. In the meantime, look around for a unknown job and be as professional as you can below the circumstances. Good luck!
I believe your Supervisor is in the wrong to solely listen to him and his tales roughly you. That's why it continues to be a problem because your Supervisor has no clue into solving this problem. I would round up a couple of Supervisors and explain adjectives this to them. I would tell them that this hand is stressing you out, and has a fruitless history of doing this to you about what is said. Now you want to win to the bottom of it. Do this in a steady and caring Manner, you want to show the Supervisors how develop you are and willing to solve this problem. I would ask the Supervisors to witness you( surrounded by a meeting room or office)as you have a chat to the employee just about what the problem is with you. If he does not own a problem with you, he will afterwards state it in front of the Supervisors, and engineer yourself clear he leave you alone. If near is a problem, ask him what you need to receive him to stop so you can finish your daily work tasks as a thrilled employee. Trust me, he will stop, and deduce twice the next time. ~Good Luck~
Be cruel as possibly as you can to yourself. No mercy is essential. Come right out and tell the lier not to do equal thing again and stumble upon your supervisor to tell the truth.
Do not forget to communicate him that you can prove it to'm by leting the lier onto the conversation. You may not feel unpleasant. But who care? Why should you feel stressed? You can inter a individual deep into the ground by blowing a whistle. But it's not blowing a whistle at adjectives. It's just one of so masses ways of eliminating drawbacks to your day by day life.
Nothing's more exalted than yourself. Others' anxieties might become reasonable simply if you can feel beaming for a minute. It's justifiable. Besides, he's done something really wrong to you. There are times when you enjoy to bite the bullet. But if you think you should teach'm a valid lesson, let everyone know that he's a shrewd lier. Some peole never know that they've done something wrong till they are fruitless or beaten black and blue.

I'm a student..I own a give somebody the third degree on coverletters??

Question:
I'm a 17 year old girl and be wondering if you think its mandatory for me to enjoy a coverletter. If you think I inevitability one, what should I put on it...what should I mention on it. Could you please give me any other info you ponder is necessary to know for a cover note?

Answers:
Yes, it's a good thought to have a cover memorandum. Here is a website that have token cover letters. It will facilitate with what you inevitability to include in a cover dispatch.
I think cover packages are mandatory.
1. It's convention and employers expect it.
2. It's an opportunity for you to shine and demonstrate your writing skills and desires for the position.
3. You can explain why you're the right personality for the job and why they should hire you.

What should I update a propective employer when they ask why I want to quit my current opportunity?

Question:
My job call me at home last dark at 945pm, they do this all the time, I am going to look for another assignment. I have gotten call from work first thing Sunday morning, and as behind as 1030pm. I am not a manager, I am salaried by the hour.I cant leave the phone rotten the hook because of things going on with my kinfolk. If I dont answer the regular phone or am not at home my boss calls my cell. I hold been woken up on weekend mornings, overdue at night, interrupted during dinner, have weekend plans interrupted, etc. I have asked that they not ring me at home or on my cell during non work hoursunless it is a TRUE emergency especially late at dark, they stop for a week or 2 then it starts again. The give the name last dark at 945 was to reprimand me for a VERY minor mistake(we adjectives make mistakes) Potential employer will ask why I am looking for another job, I am thinking of relating them it is because I am on call and that be not part of the livelihood descrption.

Answers:
Yes, tell the "on-call" situation and the possibility of adjectives lay-offs. Good luck.

I really like what answerer Gais Caligula said. Be positive.
You can say aloud a difference of opion, because all contained by all if you them you boss kept calling they'll ponder your not a team player or you could say-so you outgrew the other job and your up for a alien challenge.
You are looking for a modern opportunity to develop your potential, but where you are in a minute is limiting.

Remember: the manager interiewing you will other tend to see things from the manager's point of judgment and thus be sumpathetic to your old boss, so never whine in the order of the old place.
Spin it positively a bit than negatively... something like,

"My current position doesn't allow me the opportunity for work growth I had hoped for."
Get a different charge. I have never hear of this sort of thing especially if you are not on call for. Tell your interviewers that you were prepared for a change, and that the company is planning to lay past its sell-by date people inwardly the next few months.
Just read out you are looking for a change.
you could influence it is because you want a more reliable or dependable job. or you could a short time ago say something else totaly resembling you need to work closer to home, or that you have need of stable hours and a stable company. just dont agree to on that there is a conflict because most employer dont like conflicting workers..
I'd tell them in the order of the layoffs... make it not your breakdown.
Ooh, this is a toughy! With this very, massively unique situation I would say aloud go beside the truth. When they ask about your current employer, be up front (sort of).

"I'm really glad that I enjoy a chance to reach a deal about that. At my current employer I simply do not think that I hold the opportunities that your company could bequeath me. I have a great deal of the responsibilities of a manger at my current employer, but unfortunately in that aren't any openings surrounded by their managerial staff. Here, even next to an entry level position, these is ample room for advancement subsequent."
if a prospective employer asks why you want to leave your current charge, a good answer is that you are outlook stagnant in your situation, with no signs of advancement. employer love to hear that a prospective customer is not happy doing simply the minimum to get by. they want to hear that you want to credit their business and take it somewhere. if they looked-for a trained monkey they have the money they could receive one. they are looking for someone who will be an asset to their company, someone who can take the duty and run with it. update them that you needed more room for advancement and they weren't challenging you ample and you will look better than complaining about how your current employer handle their employer/employee relations.
I would tell the prospective employer that it be that you wound up being on phone, and it was not a part of the pack of your job description. Your current employer should not know how to reprimand you on the phone. Check your company's policy. It sounds like you MIGHT hold a case of irritation, be sure to check on the laws and company policy for this, be prepared to support up your claims (proof- not just your word) and devout luck, I hope that you find what you are looking for.

If you are open to contemporary opportunities that might be a appropriate fit for your dreams and goals contained by life, email me. I enjoy found a company that I love and gives me the flexibility and freedom to stay at home next to my 3 very helpful boys , home school and still not transport away from our family's quality time. There is no inventory, no quotas, or collections.
I've interviewd potential human resources.

You always want to be positive.

You are looking to finance yourself professionally & personally. You reviewed the certificate for this position and know that you are a perfect fit for it. (be prepared to explain why you are supreme for it)

Best of Luck to you.
Say your company is in transition and going through some organizational change, and you feel it is time to move forward beside a more stable company...one which offers opportunity more in splash with your skills and interests...

The one who is more credible to get the available job is the one who has worked since he be 15 because he has more experience within the workforce. Sad, but true.
which ever one has the biggest muscles
ALWAYS THE ONE WITH THE EXPERIECE UNLESS SOMETHING IN HIS BACKGROUND IS AWFUL OR HAS A BAD PERSONALITY.
the one that have never worked a day within his life. and the one that looks the best because poeple are so judgmental thesis days..
The kid that never worked. B/c his parents probably have money and influence, so he will hold a more impressive roll of references.
The guy who have worked all his vivacity.because then the guy would see that he would if truth be told work and not slack around.
assuming everything else is constant, the first will get the commission, any kind of experience counts

Is 6 months of Sales Experience adequate?

Question:
I've been doing inside sale for an electronics store for 6 months now and I approaching it. I'm definately not the greatest sales party but I think I am above average and I present excellent customer service on top of that. Anyways I merely wanted to ask if 6 months is plenty experience to get a legitimate sales position that will give me some definite money? Cars? Loan Officer? What do you guys think? Any suggestions?

Answers:
It would so back you to stick it out another six months. It's usually a minimum of one year to start ramping up to the higher positions.

You may be surrounded by the high quantity of the season and doing okay; let's see what happens during the low season, for example.

Basically, potential employer want to see you perform throughout the fiscal year. Anyone can vend when the market is hot - try selling refridgerators to Eskimos, and you'll see a tough public sale.
Brush up the resume. Customer service is something you don't learn. You hold it or you don't! Sure, you have to cram the product line, but conveying to the customer who have a problem that you're the man to solve it, is like somone who is polite in math. You are or you aren't.
You're thinking too small. Think: Stockbroker. Realestate agent. Yacht Salesman. Private Aircraft Salesman. The bigger the ticket, the bigger the commission check. 6 months? You are a infant salesman. But you'll get near if you know the secret.

The confidential is...persistance. Not intelligence, not knowledge, not simple thorny work but persistance.

Just never accept "no" until they are slamming the door within your face or flaccid the phone up on you violently.
If you approaching what you're doing now, why not stay in that for another 6 months at least. If you similar to selling electronics, stay on and try to look for better opportunities inwardly the store or in the industry.
I agree near Nick about the pushiness. It is the #1 sales tool. Just net sure you know the difference between persistence and mortal pushy.

To answer your question, yes 6 months is satisfactory experience. If you are looking to get into auto sale, many dealerships will hire and train short previous selling experience. In this situation you are already ahead of the game!

Fine tune your resume to really play up (truthfully!) your selling skills. Also try to attain a good quotation from your current supervisor, if possible. Show your unusual employer an eagerness to succeed and you'll estate that new duty!

Good luck!
yes its enough esp. if you perceive confident about it -that's the first step - enthusiasm and knowing what you love to do.

the subsequent step now is on the way your selling skills. Read a lot of books , target on a honest senior sales being in your dept and take in what makes him tick. Observe as powerfully your customers on what makes them respond positively and what does not.

honourable luck!
What impresses a sale manager plenty to hire you are the following things:

1. How did you get to him/her - this is critical. Do NOT go thru Human Resources. Why? HR simply screens out populace who don't fit their profile. Their profile may say a college level required but a sales coordinator in the company may clear an exception if you can show him/her you know what you're doing.

Managers are all insulated for reason and one of which is to allow them time to do their jobs. This is why they hold call screeners & book-keeping help.

Show the sale manager you can achieve thru to him/her and you've got a strong shot at a livelihood! Why? Don't you think your customers are going to be difficult to win thru too? Of course! Thus show this sales chief you're tenacious and you know how to get around screenings to procure to a decision inventor and you'll impress them enough to want to homily with you!

2. Do research on the business you're interested within - such as "cars". Find out how many automobile owners live within your area. How oodles dealerships are there? Which dealership(s) lay it on thick the heaviest? How many investigational drivers turn 16 each year for this nouns?

If you call up Joe Fabitz at ABC Cars and explain to him that you're interested within a "career" (stress the word CAREER and not 'job') of selling cars by stating that you know there's X amount of licensed drivers in your county and you know that subsequent year there will be X amount of kids turning 16 who'll be getting their driver's license and you want to help put up for sale them a car, that will impress the director a whole lot too!

When you're interviewing, downplay your 6 months experience as a 'stepping stone to a bright future'. Do some research into the pasture of work you want to be in for good and tell the sale manager WHY you want to come into it. Don't be dumb and right to be heard, "I want to earn a LOT of money!" but rather, "I see great potential here for me to grow and to sooner or later be sitting in your position as a superior!"

You can make six data in sale at ANY sales assignment out there. It adjectives depends on you. Insurance agents can make that surrounded by under five years and so can stock brokers, mortgage officer, sales engineers, pharmacy sale, copier sales, etc.

But if you prove to them that you know how to draw from to THEM that will go a long means of access in proving to them that you're skilled of getting to a decision architect. You cannot present to anyone who isn't a decision author and expect to get a close on a Dutch auction.

Resumes are not as important as finding out WHO the finding maker is, their company's history, where on earth the company is headed, the company's clientele and how you can put your own skills to work to assist them succeed and grow as you grow and succeed!

To anyone who works at a movie drama...?

Question:
i mite get applied as a sweeper at this one movie show business. my questions are: if i do return with applied as a sweeper, do i stay as the sweeper for as long as i work there or will i return with moved to concessions, usher, or box on certain days? also, what category of work should i expect as a sweeper besides just sweeping lol.

Answers:
Well considering your language rules and spelling I'm thinking sweeping just might be the pinnacle of your working existence. So enjoy, and hey would you please attain all the litter off the floors between shows?

Man I'm tired of walking surrounded by popcorn up to my ankles. I paid my $14 I should be capable of walk around within a trash free zone.
well congrats on getting the undertaking, but usually and most likey you will not be doing sweeping the whole time that you are within...thats just probably where on earth you'll start...and for sweeping you'll most likey pick up the trash that everyone left within the actual theater.so good luck..and hold fun!
when i worked at amc they didn't have it where on earth you were hired for a in no doubt job. we be just crew member and we did everything. you just own to get trained first previously you do box office, concession or the projector. it might fluctuate at the theatre you applied to. you might freshly start out as an usher and if you do then after a coulpe weeks of working in that don't be afraid to ask to do something else like concessions or box bureau because they need citizens everywhere and it looks better on your part to your manager and supervisors when you want to do more. but if you are an usher for a while then you'll hold to clean the arena out after the shows and you'll have to stock the bathrooms and sweep the hallyways. i know it sucks but it's not that badonce you achieve the hang of it, you'll find ways to own fun. and if your theatre is approaching mine then you can travel watch movies on your break and see the movies earlier they come out.

and don't pay attention to fred f. he's only just an asshole who deserves to have someone piss contained by his soda.
