How can I fire an employee who fights back his/her employer?
Answers: Unless you have an employment contract in place, an employee is deemed an "at will" employee. Meaning they can come and go as they please and the employer can let go workers as they please. You do not have to give cause.
In my place of work with its seasonal nature, this happens all the time. Also, check your employment manual if you have one. The manual should clearly state employment is "at will." It helps to have a signed acknowledgment from the employee indicating they understood it was their responsibility to read and understand the rules set forth in your manual.
If you feel the need to give cause, I would suggest "refusal to follow instructions" and "repeated workplace disruptions contrary to company policy." If you go this route then remember to document. Your manual should have these spelled out as clear violations that can result in termination.
