Hi, I was wondering if someone could explain to me within a nutshell how a buisiness relationship works between an Artist and an Agent. I am considering going into business with a friend and wondering how to approach the activity. If we start a Partnership Company I dont think I would be protected ie. if I spend alot of time and money promoting this folks product and eventually things take past its sell-by date nothing is stoping this personage from just incorperating beneath another name and I get hold of left contained by the gutter. You are absolutely right: if you start a partnership (which is different from a "partnership company"), you are not really protected. Either get-together can easily stride away from the partnership.
Since you will be the agent for the artist, your best protection is to have an agent-artist contract, which spells out exactly what services you provide, how you are to be compensated, the time duration for the contract, renewal provisions, and the language under which any side can terminate contract.
Do not try to write this contract yourself. The few hundred dollars you will spend on an attorney will be economically worth the price.
