Illegal commotion to collect a debt?

This collection company has bought an behind the times online Payday loan account from a previous company that I deal with. Now they are faxing my employment threatenting legal achievement and on the front cover of the fax it states that a warrant will be issued for my possible arrest through my local district attorney and it outlines my debt for any passerby to see.

It was first sent over to another department, within which an employee re-faxed it to my nouns, then from here, another employee took it rotten the fax and gave it to me. Is this legalized?

Furthermore, they included my social security number on the fax.

You should remember that payday loan companies don't exactly play by the rules. That's why it's a discouraging idea to find mixed up with them to commence with.

If you give them a check which bounced or you closed the account, they might be capable of press charges for writing bad checks. However, I doubt the local DA would spend much time dealing beside payday loan company's collection efforts.

No, it is not legal. Next time you speech to them, tell them you are going to report them for violate " the fair credit reporting act" , that should net them tone down their actions.
You cannot be arrested for debt, unless, it is by the IRS. here is no debtors prision in the U.S.

This agency sounds dumb...you should bait them into some more mistakes...possibly record some call..(state law permitting)

Answers: DO NOT USE CREDIT SOLUTIONS!

After having be with Credit Solutions for more than a year very soon, I’ve come to the realization that the company promises more than it can deliver.

To start, and most importantly, Credit Solutions makes statements during its sale pitch which are not only misleading but downright false. The first time this is adjectives is that Credit Solutions promises to contact the client once a month to check up on such things as contact information and the balance of funds save. Though there may be one or two months where on earth this happens, of slowly, Credit Solutions has neither call or cared. In supplement, in the sale pitch, the prospective client is lead to believe that Credit Solutions have a relationship with the credit companies and can hence act as an intermediary to acquire the Credit Companies to wait while the client puts money into a money account and thereby compiles money to work toward a settlement some light of day in the adjectives. I, personally, remember this statement almost word for word as it be one of the most compelling reasons for taking on Credit Solutions. This is nil more than a bald face lie. The Credit Card companies (many of which do not work beside Credit Solutions) continue to make a payment interest, make harassing phone call and bill you regardless of any purported relationship says it have.

Furthermore, nothing is said during their sale pitch about how a credit card company can still turn the legal route (Arbitration, and afterwards a Lawsuit) at any time, other than to strictly point out that Credit Solutions will not exploit legally on the client’s behalf. Though this ‘disclaimer’ is made and made clearly, it is glossed over when the prospective client in truth asks if lawsuits are something to consider. “They almost never happen.” is the response. (Of the 12 credit accounts I hold handed over to Credit Solutions, 4 hold gone to Arbitration AND 2 others to Court. This is a whopping 50% of just one client’s accounts! There is nil to indicate that this number is out of the ordinary.)

Besides the misrepresentation of the lawful possibilities, Credit Solutions gives the client the hollow of an efficient and professional organization only until such time that the client in actual fact needs to contact the company beside a problem. Calls are not returned the same time, and most times not at all. When asked nearly Arbitration, the standard response is “We don’t handle Arbitration.” -thus departure the client uninformed and ill-prepared. It’s thorny to feel comfortable beside a company which doesn’t know its own shortcomings. When the fax is a legal memo, it makes things even worse.

When things do come to a official head, the client is not here with a outlook of desperation. No amount of ‘We don’t do legal probably you need to draw from a lawyer’ will alleviate the feelings of betrayal from a company one is paying (and paying heavily!) supposedly for their expertise (as okay as the fabled relationships with the credit companies.) Fear and anxiety cannot well be swept away when the client is left sitting by the phone hoping that SOMEONE from the company will bid AND that they will be able to relief.

In contacting Credit Solutions, the client is put through a security check and consequently into the phone maze. Credit solutions’ phone muddle is irritating to say the least possible. Besides being asked to confirm one’s client status not with the sole purpose on every call, but by every individual the client speaks to, the phone system will also drop calls, afford vague directions and circular forwarding since the client becomes frustrated or angry and hang up. Everyone that the client does actually speak to contained by person promises to intervene on phone messages, but as already pointed out: returning calls to a client next to a problem appears to be of low priority. The client is left angry, disillusioned and short recourse, as legal problems loom contained by their immediate adjectives. As for voice mail, it is sublime to suggest that it is a prank with Credit Solutions. I hold NEVER had anyone return a voice e-mail message and in certainty, was told by one 'Credit Specialist' that not a soul ever checks the voice mail.

Well, since I’m still paying the ‘service fees’ monthly, it seems more than feasible. I will spend my time as best I can doing what I can to educate other prospective clients of this company almost its misleading practices and performance problems.
