Ex spouse geared up to claim bankcruptcy. I am co borrower on homes HE owns.?
I have an ex spouse who could not refinance properties he in a minute owns in entirety because of bleak financial decisions on his segment since separation. I know now that I should not enjoy quit claimed deeds to him, while I am still on mortgages.but that is surrounded by the past and done. Now, he is defaulting on mortgages (were previously rented single kinfolk homes), does not have adequate equity or money to sell properties and foot closing costs, refuses to move about to family for assist in doing so, refuse to follow advice over olden 2 years regarding mart of properties, no longer has tenant, is out of money and going to a bankcruptcy attorney who is telling him Ch. 13 is his best best. I do not enjoy money to bail him out, nor take over properties, nor money off outstanding balance after foreclosure.I understand mortgage companies will come after me - sue me - and my unflawed credit will be in the toilet, but can the courts or mortgage companies sieze what little money I own managed to store in accounts?
Answers: They can come after you and nick all the money you own worked hard to salvage. Consider it part of the price to recompense for marrying the wrong character. I know that's hard to nick, but without such law, a couple could take out loads of loans, bring divorced, put all the liability in one person's entitle and the other one could take adjectives the assets. The one with the liability could declare collapse, and the other could keep the money. Then they could capture remarried and repeat the scheme.
