What should you do when a credit card is taking you to court?
Answers: call the attorney and ask if they will work out a settlement PRIOR to the court date. get any agreement you make in writing and never give them electronic access to your bank account--pay them by money order or cashier's ck. usually, the attorney's don't want to go to court either, they just want you to pay what you owe
Show up or they will get a default judgment.
You could check the Statute of Limitations (SOL) in your state http://www.fair-debt-collection.com/SOL-... If the debt is beyond the SOL, you can use that as an affirmative defense in court.
Bascially, if you owe the debt, they are going to win the judgment and will then be able to attach your bank account, garnish your wages and lien your property. Show up and hope you can work out some kind of payment plan.
you should of paid the bill... you may be able to contact them and work out a deal, payment plan. not sure. worth a try.
if you legally owe the money you will lose in court. And your paycheck will be garnished. Either way you will pay... hard way or easy way. Your choice.
The judge asks you if its your debt,if its YOURS you will lose... then you set up a payment plan that you can afford(hopefully). I ended up paying $15 on a 3,000 debt until I could get back on my feet.
But the outcome varies from person to person. My cousin went to court over 1,100 and got a wage garnishment.
It also depends on what state you live in as to what can/can't happen.
Contact your creditor ASAP to see if there is anyway you can settle out of court, you don't want a court judgment on your file as you won't be able to get credit for 7 years after it is put there!
How can a dune hold a lien on my truck after sending me the vehicle title?
My used 2003 truck has be paid stale in January of '06. I received the title and a reminder congratulating me that my installment loan was rewarded in full. So yesterday, I checked my credit report and it say my installment loan account is still amenable and I still owe money on the truck. Today I called the bank(Fifth Third), and they said I owe money and even though I enjoy the title, they still have a lien on my truck. Also, they are truism my last settlement was returned for insufficient funds, but when I go to MY bank, MainSource, they be saying that they be never notified and own no records of any check coming support to them. I paid my truck sour in 1 year, and Fifth Third sent me the title and presently want more money. How can they do this, and how bad is this hurting my credit? Or the Fifth Third have to send you documentation that the check didn't clear the hill.
If by chance the check didn't clear your dune, yes they can put a lien on your truck.
They are wrong, the law is on your side. Make them prove what they are dictum. Get all your facts together and show them.Make copies, never consent to them have the original.
Car Credit, What is my best to touch this?

If you two are still together, you can make the payments yourself so they will not be unsettled and he can pay you. If he does not compensate, you can take the vehicle and go it.
You can also limit access to other things.
