Credit card debt grill; advocate involved presently??

So, I decieded about a month ago that I NEED to transport care of my credit card debt. So, I did the credit report, get a hold of my credit card co, and told them I needed to work a payment plan out, but I will earnings. I did this in a memorandum to them...never heard anything put money on. I honestly just thought it took a long time for them to do paperwork. Well, today a missive came from a lawyer's bureau stating I'm being sued over that debt. WHAT!!?? I call the lawyer's office and he said that since my debt be forwarded to him there's nothing I can do but see him within court. He sounded pretty mean too. Is within anything I can do?

-I only enjoy 1 credit card.

Answers: First off...I don't believe you were sued. You are sued when you receive a summons and complaint from the county where on earth you live. This will normally be a form signed by someone at the courthouse and must be SERVED to you any physically (typically by the sheriff's office or local police or some other individual authorized to do so) or via certified mail. But you must own this summons from the court, otherwise it's really just second-hand goods mail.

Did you receive a decriminalized complaint along with the summons?

Is within a case and folder number listed CLEARLY and OBVIOUSLY by the court?

Second, I would phone up the county courthouse where you live and ask if in attendance is a case upcoming against you. I would bet that there is no upcoming lawsuit. If that is the suitcase, I would write a sternly worded letter to this 'lawyer' recounting them that they have violated the FDCPA (Fair Debt Collection Practices Act). If in that is no case impending, I would suggest that you copy this letter that you received and dispatch a copy to the attorney general's office surrounded by the state where you live. If an attorney did convey this to you, they are making some pretty serious errors!

A lawyer who sends you a notification saying he have sued you is a violation of the Fair Debt Collection Practices Act. This is tantamount to forging court documents within order to fool you into paying, and this is ILLEGAL. They can't speak that they will sue you unless they plan to do, and they can't send you documents which look or resemble court documents or furnish the impression that they are so.

$600 is such a small amount of money within the grand job! It will cost than more to file a casing in court and attorney's fees. Most attorney's on average more or less $185/hr (depending on their rates), and I find it doubtful that they would waste their money resembling that on $600.

You didn't say, but have your debt been sold to a collection agency? I can't see a hill suing for $600 unless you did something fraudulent like money launder or lie to capture your credit card.

You won't go to send to prison, either.

EDIT:
This is fragment 807 of the FDCPA, (9):
(9) The use or distribution of any written communication
which simulates or is falsely represented to be a document
authorized, issued, or approved by any court,
proper, or agency of the United States or any State, or
which creates a false impression as to its source, authorization, or approval.
You can do presently two things one is to hire a lawyer for yourself and move to the court or you can contact beside some debt consolidation agency who deals near the credit card companies. They will settle with the card company in the region of the problem.

First of all he can't hold you sent to jail for owing money. If you be in detain I wonder how he thinks you could even work on getting the money to wage the bill. But you cannot be took to jail for owing money. You can be sued and your wages garnish and stuff you own repo'd. Also you have other option that going to court. He can offer you a settlement, or repo your stuff, especially if you already agree to reward the debt what use would it be to take you to court anyway. All debt collectors and lawyer working for debt collectors are mean. How long have it been since he contacted you and told you that you have to goto court, because I think he is of late bluffing. Even if you get served beside papers you should be able to settle out of court. You should enjoy CALLED the credit company, instead of mailing them, they can avoid packages but they can't avoid phone calls as in good health. Also they are a thing call lawyer collection agencies, that's where on earth your account go if a regular debt collector cannot collect on the account, the attorney has the power to help yourself to you to court. I don't understand though why your credit company would distribute your account to a advocate first anyway. Usually having a legal representative try to collect on the account is close to the last piece they do after the account have been surrounded by collection agencies. They will usually send accounts to another collection agency also if the first one couldn't collect. I'd a short time ago tell that advocate to go leap in a pond. He's as full of it as a Christmas turkey. He's a short time ago bluffing you more than likely.

Another piece is hiring a lawyer will just cost you more money. However if you can afford to do it, go for it, it MIGHT oblige you, The lawyer is most promising to get the attorney in trouble, however I believe it is allowed for them to send the description to a lawyer first, but thats not a typical entry they do, and taking you to court is not the first thing the advocate does usually, they try to work out a settlement with you.
We don't own debtor's prison in the US. He's individual trying to scare you.

How mature is this debt? Your credit card company obviously sold the debt to a collection agency. Did you in truth receive a summons?

In the meantime, send a reminder (don't call or fax) to the advocate offering to work out a settlement. If the debt is more than 4 years old, proposal half. They would be more predictable to accept if you proposition a lump sum. Any payment arrangement would hold to be short term -- smaller quantity than 6 months. Get them to sign off on any settlement agreement and don't furnish them access to your bank tale.

If you do end up contained by court, the worse they can do is garnish a max of 25% of your wages.
Under your condition,I advocate here for you to have a pop in.http://creditcard.expertips.info/card-ch...

Paypal and Ebay?

ok. i sold an item on paypal, and if i bid on something else on ebay, when i win the item, will it charge my credit card, or the balance i enjoy on paypal? i really need give support to with this, appreciation...

Answers: Like the other guy said, the first post is senseless. When you win the item, ebay will send a form memorandum to your email and will ask you to pay very soon. When you follow the links and sign in to Paypal you will enter your salary preference nearby. You can pay next to the balance within your paypal account or beside any other means of funding you hold registered with paypal, or by using a credit/debit card or even sending a check or money establish if the seller allows it.

Paypal does not charge anything "automatically." You own to choose your options and authorize the transaction, so nought will be done that YOU don't know about.

Paypal is legally easy to use, even for first-timers. Just read every page conscientiously during check out and it will be easy. Good luck!
Ideally, credit card processing method ensure fast business transaction and shelter for the buyers and sellers. For credit card processing, a levy is charged by credit card provider. The service provider acts as an intermediary contained by credit card transaction processing. It validates credit card numbers and expiration date and obtains authorization from the credit card issuers. At the cessation of the payment transaction, confirmation numbers is sent to the taxpayers.

dont listen to the above idiots answer.
If you go somethign and you got the credit contained by your paypal account you can glibly use that credit which is in your paypal reason to pay for the item you bid on.
As a concern of fact when you try to pay packet for the item through paypal it will automatically try to use the credit in the details first and all external resources afterwards.

GL near bidding. Hope you win at the right price :D
You sold an item on Ebay..not paypal. When you win something...you pay next to paypal. If you have a paypal go together..it will always clutch from there first and later from your checking account. If you enjoy no blance, you can use "ther funding options" and choose your credit card.
