Question in connection with aged credit card & wage garnishment?

Long story short ... my husband keeps getting a communiqu¨¦ from a collection agency trying to collect $3900 from an old crdit card. I can't money the whole item but I called them and tried to arrange a settlement plan, which they would not do.

Today I get a notification saying they're going to frills his wages, 10% or $175 a week, whichever is greater. The problem there is that he's in part laid off from his profession, only working 1 time a week and then collecting severance for the other 4 days.

AND ... doing a search online I found a website beside all kind of info about this collection agency that say their practices are illegal. But I don't know anything around law and the court jargon is easier said than done to understand. I tried e-mailing the webmaster but bring back an auto reply.

Answers: Before you remuneration anything, make sure that the the Statute of Limitation for collection on this debt have not expired. Check your state's SOL using the link below,

If the SOL have expired you no longer have a allowed obligation to settle the debt. Send the collection agency a letter (by certified mail) informing them that you are aware that the SOL have expired. Keep copies for your records.

If the debt is still in SOL, debt validation is your best weapon against a Junk Debt Buyer (JDB) like Palisades (aka Pressler & Pressler). Send them a memo demanding that they verify that they own the debt (they have to prove a fasten of ownership from the original creditor through subsequent owners) and that they hold a legal right to collect from you (they would obligation the original signed contract between you and the inventive creditor). Most of the time a JDB cannot validate a debt, and as a result has no official right to collect.

First past its sell-by date, is the credit card secured or unsecured? If it's an unsecured credit card, they cannot garnish your wages. There is no proof what be purchased, etc and there is nought they can do about it except put a mark on his credit report.

And I totally make out about them not accepting pay plans. I got myself into some trouble around 5 years ago w/ credit cards, and it's not unlikely for them to demand the grant in full. Actually, I still owe one of mine because they returned a check that I mail them because it wasn't for the full amount!!

Now a secured loan (such as a student education loan) they can side dishes your wages.

Credit companies are going to do whatever they can to try to "scare" you into paying stale your balance.
In the United States, not a soul can garnish or levy your wages unless they hold first gone to court and obtained a judgement against you. If this have happened, afterwards they have a endorsed right to do so. However, you are probably dealing with an agency that bought this debt, and unless they own obtained a judgement against your husband, you should call for them daily and submit the $200 to settle this in full, "lacking recourse". Chances are, they'll take it.

Can i use a credit card to get an Australia Post Money Order.?

What you can do is - take a cash advance from the credit card and use the cash to get the Money Order.
No your going to have to use cash. Unless they have laws in Australia that allows you to get a money order with a credit card. I would ask the store clerk.
