Anyone experienced contained by arbitration?

I received a certified letter stating Moore & Assoc file a claim against me with the National Arbitration Forum for a credit card debt I never incurred.
I found sites admonish forced arbitration since it denies you your constitution right to use the court system. Also, the Christian Monitor found that less than 1% of cases are found surrounded by favor of the consumer (even in cases of identify mugging, or even when the claimant has no proof documentation, etc) since the arbitrators merely "rubber-stamp" 99% of the cases contained by favor of the claimant, since they're huge clients of the firm.

However... I cannot information that says what to do if you're hit beside one of these claims. I'm guessing an attorney cannot be used since this is strictly non-court & would be a shame to spend $ on something I deny was mine to instigate with.
If judgement is default against me, can they enforce it?
Any words of advice from folks who own been contained by this situation and prevailed would be greatly appreciated.


Answers: I would stay away from arbitration. I once incurred a 300 dollar debt from an apartment, but i paid it 4 months then. Then 3 YEARS later i see it on my credit report. I call up the apartment and told them i paid it 3 years ago and they should check their history. They said they deleted adjectives their computer files after 2 years so it doesnt show up. Then they wanted to progress to arbitration. I told the arbitraitor what happened, how i compensated it and how the apartment didnt keep history to even prove i owed the debt. Then the aribtraitor said, ok let me ring up the apartments and talk to them. I draw from a call put money on and they say "heres the operation. If you pay the 300 dollars, they will removed it from the credit report" I be like WTF? I remunerated it! I aint paying it again. So i just disputed it on my credit report and it be removed.

Hospital bill - collection agency?

Do not respond if you are a collection agency or an agent at a collection agency because many are on yahoo and answer the "Ask Yahoo" by in recent times Pay your bill. Very obvious it is a Collection Agency Rep.

I own a hosp bill which the colleciton agency failed to prove the debt despite my letters. I know they are not suppose to but can they deal in the debt off to another collection agency? Do collection agencies flog debts to other collection agency's? Thanks


Answers: Actually the debt can be sold as often as they want to put up for sale it. Passing from one collection agency to another. If you owe the hospital the money, I would contact the hospital and try to work out a payment plan and debris to speak or have any contact beside the collection agencies. You have a right, by tenet, to tell the collection agencies not to contact you again, and by tenet they have to abide.
Why do you suggest collection agencies aren't suppose to sell debts to another collection agency? It is done adjectives the time.

In fact your dispatch requesting validation probably triggered selling off the debt. Quite possibly they don't hold the documentation to validate.

Did you distribute your validation request by certified mail, return receiving and give them 30 days to respond? If so, you could use that to dispute the item on your credit report and gain it removed. However, it will probably reappear when the next collection agency starts working the side.

Can i give the name my credit card companies directly and request settlements?

Do I have to jump through credit agency? Can I just name the company myself and suspend payments or request a settlement?


Answers: Yes you can call them directly...they will not WANT to minister to as you signed a contract with them when you get the card. They will also list you as overdue on your credit report. However, they also know that working with you is better for them than you file bankruptcy, as later they will get ZERO (if it is an unsecured card)
