Credit Questions and Answers

I am on chexsystems due to chase?

I told them that I wanted to close my narrative one day (Chase) because I have not worked in 6 months due to man hospitilized and giving birth to my son. I was told I could not close the report because it was unenthusiastic. I tried saving up money but everytime I get enough they would append overdraft and returned item fees ( had not written any checks or returned an item). I finally rewarded them is there anyway I can carry off of chexsystems? Should I confront Chase more something like this!

Answers: There is no for sure way to gain removal from chexsystems. Chexsystems is a CRA. Everyone has the right to dispute.

Here is the course the process works:

CHEXSYSTEMS

Step1. INITIAL DISPUTE LETTER

Chexsystems has 30 days from the date they sign for the missive to
respond.

NOTE: If you got your report by requesting a free annual report, later
the law extends the dispute notification spell to 45 days.
After getting your letter they must:

1) Confirm that they contacted someone to verify the information.
-The disputed information next stays in your report.

2) Confirm that they could not verify the information.
-The information is delete from your report.
-You receive an updated report (minus the disputed info).

Step2. NO RESPONSE TO DISPUTE LETTER
-You Send a Demand for Removal letter because they did not respond.
-No response mechanism they did not confirm. Therefore, the information
must be removed.

*3. DISPUTED INFORMATION NOT DELETED
-You send a Procedural Request memorandum. If they say they confirmed the
information, the canon gives you the right to afterwards verify how they
confirmed. They must send the Address, and Telephone Number of the
individual or business they contacted inside 15 days, so that you can
confirm it.

*4. LEGAL ACTION
-Before pursuing legal endeavour, you have to build a "case". You should
know how to prove there be an error, you notified them, - but they did
not correct it. You want to also show their end to remedy the
situation has harmed you financially (unable to friendly an account,
etc.).

-If you applied for an rationalization and were decline based on the
information, that provides more documentation. Fines, etc. are
outlined in the Fair Credit Reporting Act. Most state regulation conforms to
the FCRA, but there may be a state statute where you live that outlines
specific remedies.

FCRA: http://www.ftc.gov/os/statutes/fcra.htm

THE REPORTING BANK

1. Has the sandbank made a reporting error? The law requires bank to
report information that is 100% accurate.
-If so, you dispatch a Demand for Removal letter to a dune manager or
executive, notify them of their FCRA violation.
-Examples: Incorrect pet name, SSN, address, dollar amounts, date of last
stir, date account first become negative.

*NOTE: Chexsystems allows the hazy "NSF" and "ABUSE" flags because they are harder to dispute and remove. There are no clear standards for what is considered NSF or ABUSE. They can mean anything a sandbank wants them to.

What proof do they hold to flag an account NSF or ABUSE?

2. Do the facts support file a complaint with the agency surrounded by your
state that regulates and handles bank? You can get the agency
information by calling the clerk surrounded by your state attorney general's
office. Will the complaint hold, or is here any statement in the
sketch agreement you signed when you opened the commentary that will
protect the bank?

As far as getting removed.I would suggest you read the info below
and see if it can be a facilitate to you.

Chexsystems removal help
This is the information needed since recommending a Chexsystems
dispute:

1) What does your Chexsystems report say-so . . . does it indicate a specific
dollar amount is owed, or does it list NSF Activity, Account Abuse,
etc. * The aim is to catch them reporting incorrect information
or an not exact amount.
If the report says NSF Activity or Abuse, be there a distrustful balance
on the tale? Has it been salaried?

2) When was the entry added to your Chexsystems report? If the article became glum - when was the first month it be negative? What month be it closed and when did the bank report it to Chexsystems? *This help determine when the five year clock should start ticking - and when the account should enjoy been reported by the mound.

Again, you are looking for any type of inaccuracy you can hold them
accountable for. The FCRA specifies that lone accurate information can
be reported, and it provides a time requirement for reporting negative
information. Banks cannot hang around and report negative accounts when they
want to.

3) Did you receive a collection perceive from Chexsystems?
*THIS IS VERY IMPORTANT! If you receive a collection notice, afterwards it is different. Chexsystems then must hug to the Fair Debt Collection Practices Act. The FDCPA says they MUST substantiate -- provide a full account history of adjectives statements, signature forms, etc.

4) Were you the primary account holder? *If not, did you ever sign a
signature form or use the tale? Yes Chexsystems is subject to the
same rules/regulations as set forth by the FCRA. You should first
"dispute" the item with Chexsystems and if it comes spinal column "verified"
within the 30 sunshine time frame, you should request "validation" of the
debt. BE SPECIFIC if you request validation.

Ask for original copies of your signature, etc. If you don’t , they
will transport you some bogus documents and call it validate and then appointment
it a day. Most relations on here have dug their own grave next to the
reporting bank, and are hoping the hill does not verify the chexsystems item within the allotted time frame. This can and does transpire. Especially if
you are dealing with a BIG dune (BofA, Wells Fargo).

There are several methods you can use for deletion. Some go for the method that essentially catch Chexsystems in a FCRA betrayal.
Oftentimes they use the "violation" as leverage for deletion.

Another avenue to go if you can’t bring your item removed. Being listed
within Chexsystems SEVERELY (if not completely) restricts your banking
ability. They can be held liable for multiple FCRA violations if the
information they enjoy on you is not correct..the inforamtion must be 100% correct.
Derogatory trade lines remain in ChexSystems files for 5 years. If you enjoy paid, your text should be marked as "paid". You could ask Chase to bear you off of ChexSystems. I doubt you will be successful, but it might be worth a try.

Good Luck
