Credit Questions and Answers

Debt/Credit Card query.?

Today I received a phone call from a attorney in NY in connection with a credit card of mine that I haven't been competent to pay since May 2007. This man told me I have until the end of this month, 4 days, to supply Bank of America $200.00 to start payments with them or "further trial action" would be taken. I explained to him that I have every intent on paying this debt but I purely don't have the funds at the moment because I just get getting married and we had to put alot of money out for deposits on our rental.

So I'm a short time ago wondering if they can even do that? Give 4 days or legal bustle will be taken or was he lately trying to scare me to put money forth.

Answers: Actually, they don't even enjoy to give you that. You haven't rewarded since May of 2007, they could have file suit against you already. As long as you are making an effort to discharge, even if it is $10 a month, they won't sue you.
Start paying the minium payments. Be thankful you still hold money in your vindication. The card companies usually just help yourself to the money if you stop making payments. Don't give your money to wall of america odds are they won't hold a clue what to do with it. You entail to pay the card company not the dune.

Can a collection agency phone call my hill and attain stability information?

I had an arrangement set up next to Allied Interstate for 01/30/2008, I called to metamorphose it to 2/1/08 and they refused. Then they put me on hold and said that I have the money in my narrative and why can't I pay it. He stated my exact symmetry. When I called my sandbank they said the can verify a certain amount for a post dated pay-out is available but they would never give out a match on an account short a signature or authenticating that it was the owner on the narrative. How did they get this information reasonably?

Answers: Without going into the this is why you should NEVER talk to a collection agency over the phone. They probably did something informal.

Banks allow for verification of funds. AA could phone call and state something close to they would like to verify if a check for $500(for example) would clear. The mound would tell them Yes/No, but they won't relay the company if you have $501 dollars or $5,000. This is not wicked to do this. But if he gave your exact set off he did one of two things. He pretended he was you(which is illegal) to catch this information. Or he did the verification ample times until he got to your exact amount.

You should at once contact your bank and speak to the fraud department. Let them know you enjoy reason to believe that someone call pretending they were you surrounded by order to return with balance information. Since they put you on hold you should know the date and time this happen. They may require you to file a police report to turn any farther. If it can be proved that this happened they not individual violated the Fair Debt Collection Practices Act as a company, but the individual who did it committed identity theft and can be arrested.

Once you find out from the wall you can decide on the subsequent step you can or need to appropriate.
Not sure if they can do it legally. But if someone know your name, address, social indemnity number, and account number (as the collector would), they could probably social-engineer the info from the the ridge pretty easy, pretending to be you, if they required to.

And yes, you do not ever want to give your bank info to a collector -- don't even give them your signature on a communication. Assume they are crooks. Pay by money order.
The wall should not give out this information, but if the collection agency have your account numbers, consequently they can do pretty much what they wish. The trick is to NEVER bestow them your account numbers. Send money information if you have to. The problem is that they in recent times love to wipe out your explanation without unfolding you. They get as much as they can, and after you get to examine as checks and debits start coming surrounded by and bouncing out one after another, leaving you so far contained by the hole that every paycheck from then on go to the bank. If adjectives your transactions are clear, I would shut the account down and undo another one. This time, make damned infallible that you do not let them attain your account number. Remember: you can other send them money information.
