Hello from Canada,
I have be dealing with my former employment agency telling me I that own received an overpayment on vacation take-home pay after termination (approx $250). Now, I don't really know if this is actually true.
I in a minute have a collection agent sending me notice in the messages. I have requested the agent to provide me near the documentation which states the overpayment. I am still kind of interested within how the agent can threaten my credit for this. I did not sign anything as a debtor.
At what point in the process can the agent put a doomed to failure credit on my file, would fruitless credit occur after a court decree? Doesn't the agent have to provide me beside documentation on this overpayment? I never made the mistake, yet I would still consider paying off the amount.
When I asked the agent for proof of over payment, he rudely informed me that, "Call the employer and capture it from them, I have be in this industry back you were born."
How can this affect my credit? When would it?
thnx
Answers: Legally they own to mail the proof to your - he's the debt collector. It's HIS responsibility to prove beyond doubt that you enjoy the debt.
Now, did you ask for the verification or did you emergency IN WRITING the verification? There is a subtle difference. If you call them (or answered when they called you) and only asked them to verify it, they have no object to do so & can still try to collect. If you write them and demand the substantiation, they have 30 days from the date the memo is received to obtain confirmation & mail it to you. While they are obtain this verification, they can not contact you, any. Like I said, subtle.
