Collection Question?

Question:My husband was sent to collections by a dentist's organization (in early April) for a bill he does not owe. We wrote a dispute communication and sent it to the collection agency. We didn't hear anything for 5 weeks so my husband called them and the collection agency said that they faxed a copy of our dispute reminder to the dentist's office the afternoon they received it, but had not hear anything back from him. So we wait. Now almost 2 months later, the collection agency have still not heard from the doctor. How long does the dentist hold to respond to our dispute, this has be put on my husband's credit report and they refuse to appropriate it off....Is nearby somekind of time frame that the dentist has to dispute our dispute???

Your state should have something approaching a consumer advocacy office (Georgia does), I suggest you telephone call them and let them advocate you. There are state offices that license dentists and oversee credit reporting agencies. Also, write a missive to the Better Business Bureau, they will write your dentist a letter.
If that truly "is not" your husbands sketch, I would suggest going to the link I provided and run to the medical forum. Read about using HIPAA.

If your husband sent the dispute note within the 30 days after acceptance the first bill from the collection agency, they have 30+5 days to respond. If they do not support within that 30 days but verbs to try to collect or verify with the credit bureaus, to be exact a violation.

The dentist did not place the report on your credit history, the collection agency did!

Quit playing around here! Your next step is to dispatch a final demand memo to the collection agency. Point out that the law give them 30 days to validate this debt. They hold failed to do that, so they must delete this report. Failure to do so violate the Fair Credit Reporting Act, as they are posting unvalidated information to your credit history.

Follow this up with a lawsuit. Go down to small claims court and report a claim for for $1000 against them. If you have adjectives of your letters and facts straight, you will confidently win.

My husband and I had to report bancrupcy and our medical bills were a big sector of that.
