Credit Questions and Answers

Creditor taking furniture, etc. from your home?

Question:
I had a man from a debt organization (credit counseling agency) tell me that if a credit card company took you to court and get a judgement, then they could transport things out of your home if you bought them with the credit card such as furniture, appliances, etc.
Was he freshly telling me this to try and procure me to sign up with his company or is this true, can a CC company really do this?
I hold a CC debt, but no household furniture was bought on it.

Answer:
If it is Unsecured debt, which credit cards are, they can not do that. Even if you bought the furniture on the credit card surrounded by question they could not bear it back. If you read the language and conditions of the card there will be a flash to the effect that "They do not maintain a financial guarantee interest on the items purchased"

They are not allowed to threaten you next to actions they can not lawfully take or hold no intention of taking. If you are in the US this may be a infringement of the Fair Credit Reporting Act. It really depends on exactly what he said. If it is you can actually wallet suit against them for damages, I beleive the current amount is $1000 per violation.

Now they can lift still take you to court. But the court may allow them to garnishing your wages or try to attach your bank picture but they can not take your physical property for unsecured debt.

If he call again, get his baptize, phone number, the time and date he called. Let him know that that it sounds close to a violation of the FCRA and if they ring again you will pursue legal commotion.
no, i'm afraid that this is true in most states.
It if truth be told happened to somebody my mother know a long time ago.
they actually even hold the right to take your house and freshly about anything that belongs to you.
lifes low huh?
Any creditor can repossess goods purchased and not salaried for. However, it is unlikely that a credit card company would do this. It is more likely that they would put a lien against your income and enjoy payments taken directly from your paycheck.
I would question this. If a collection agency take you to court and wins, adjectives they have is a judgement on a piece of thesis. In fact, I'd check the party credit act to see if what this collection agent told you be illegal. They're not supposed to tale to you about things similar to taking your furniture or throwing you in lock up. You could actually sue them for that and attain them into BIG trouble with Uncle Sam.
He be lying to you

If they sue and win, they cannot seize property to delight an unsecured debt.

It's just my judgment, but I would stay as far away from that CRO as possible.

Go to www.adviceontime.com and read the article on credit, this will help you out.
CC companies do not lug belonging
now if you have a department store credit line be it from an electronic or furniture store that's a different story. But since CC companies do not physically trade the merchandise but are merely vehicles of credit for such purchases as such, they cannot enter your house and retrieve items approaching a specilized store that has associated credit can.

They can individual get judgements against you ( and hence why those judgements stay on for a long time ) which next go on your credit profile. save in mind they also enjoy no method of retrieving and storing such items for resale and lowered costs.

stay away from such people who blatantly explain to such lies
he after all get a commission from everyone he signs up

What would be the approximate interest rate for poor credit when purchasing a contemporary saloon?

Question:
Recently discharged from Chapter 13 bankruptcy

Answer:
This is what I do for a living.

You should expect to retribution anywhere from 13.95% to 21% for a bad credit loan.

The rate will be contracted by the structure. How much you are borrowing in relation to what the vehicle is worth per N.A.D.A., how long you are borrowing for, how much you are putting down, how several miles are on the vehicle, how old it is, how long you own been on your job/at your residence and how much you gross a month.

As far as down payment is concerned, it will be anywhere from $500.00 to $2,000.00 usually it's $1,000.00.
You could pay between 11 - 19% - however, if you do, 2 years into it, you can refinance at a lower rate.

Personally, I would freshly save money until I could income cash - that's a hefty premium to discharge for a depreciating asset.
Poor credit car loan APR vary from 13.95% to 20.95%. Payments range from $539 to $751
Go to www.adviceontime.com and read the article on buying a modern car, they hold a lender that gives you I don`t know one or two points higher than a coustomer next to excellent credit would get. Dont get hold of cheated!
typically 18 to 25%
dont let anybody else fool you
even though you enjoy emerged from collapse you need some serious downpayment ot even achieve financed, well above 20%, ponder 40 to 50% down
go to a credit coalition
you get a better rate even at their tier5 rate ( the worst rates from any institution ) than from a purveyor

Too much credit available?

Question:
me and my boyfriend are having a disagreement... conceivably you can help. I own 2 credit cards, one with a 10k credit constraint and one w an 8k credit limit. I hold never even come close to maxing them out, never even used 50% of available credit. I do carry a set off but always salary ontime, never missed a payment. He claims that have 18 k in credit will prevent me from getting loans within the future bc of my spending "potential".... i deliberate that bc i always own kept my revolving balance low and settle on time it is fine. (also I enjoy student loans and a car loan that i also hold always salaried on time) who is right? Also, would it effect my credit score negetively if i remunerated off my cards and asked them to drop the put a ceiling on??

Answer:
Available credit is not debt no matter how you look at it. If it be, it would be called available debt.

It would hurt your score if you requested a credit limit decline. You would be negatively raising your overall utilization.
Even though you pass a low balance on your cards, you would still enjoy to factor in the utilization on your loans.

It is a misconception that lofty credit limits or have higher credit margins overall that exceed a persons annual income is a bleak thing. It's in truth quite the reverse - "as long as the accounts are continually kept surrounded by good standing"

That's not to say-so there isn't the "occasional" lender that believes within that same misconception, because there are a small few that do.

But, when a being takes attention to detail of their credit, has soaring scores and even have high credit confines, that one lender who believes available credit is debt does not matter. There are abundant lenders, who don't believe available credit equals debt, waiting in the wing ready and of a mind to not only bequeath that person a loan but to also grant them the best rates.
I would not ask to drop the limit because the more available credit you hold the better your credit score. As long as you are not spending beyond your system it is very accurate to have that much available credit. Lenders look at that within a good night light not a bad one. You might want to consider paying stale your loans with one of the cards as long as it have a low interest rate. That will boost your credit also as it will show that loan paid surrounded by full.
You shouldn't ask to drop the limit. Keep the utilization low on the cards. The individual time that you have too much credit is when you do not trademark enough money to afford the cards balance. A lot of the larger creditors will ask for income verification.
some places look at how much credit you own,.....even though you have impossible it, the chance is nearby that you could,.....how ever you have other paid the credit, and that counts for something,..... your credit ranking will not be affected on how much credit potential you own, but the lender might look at how much you could have,.....and that could effect how much they will loan,.....hope this info help you, if not contact me,.....
he's right.
they don't supervision how much you've previously spent or have spent it's what you might possibly spend that worries them.
ditch your 10k card and you'll be fine
you don't call for that much credit card anyway you'll only seize yourself into trouble.
Though I hate answering question about credit, (everyone seem to have their own answers), I own to answer this one.
Some answers here are not right. The folks who said that "Credit Potential" won't hurt you are RIGHT ! It is actually a righteous thing surrounded by the eyes of credit bureaus to have a biddable amount of credit. It will NOT lower your credit score. What will lower your chalk up is late payments, charge offs, default and such. Also too many inquiries. Every time you apply for a hot loan or new credit, your evaluation is checked and to many of these will lower your evaluation. So if you have credit, DO NOT eat up it or cancel it. Cancelling it can in actuality LOWER your score. So preserve the credit you have, and be responsible.....
How do you resolve how many credit cards to own? There are reason to have more credit cards, and reason to have not as much of cards. Here are reasons to own few credit cards:
1. Each time you unfurl a credit card, 20 points are taken off your credit chalk up.
2. It is easier to manage your nouns if you use only one or two credit cards. The more credit cards you enjoy, the bigger risk of damaging your credit you get.
3. If you have more credit cards, you should check more credit statements for errors.
Here are some reason to use more than one card:
1. The first reason is credit card embracing. May be American Express Blue credit card satisfies your requirements. But frequent merchants don't accept this card, so you'll probably want a Visa or MasterCard as capably.
2. Different cards offer greater rewards on different types of purchase, for example, some credit cards offer better rewards on gasoline. So if you have several credit cards you can trademark the most of rewards you get.
So how tons credit cards should you hold? Most experts say near is no magic number. It depends on the amount of shot and time you are going to devote to saving money. Never use more credit cards than you can oversee. It is much more better have positive crredit history. Besides if you approachable too many accaunt hill can decide your already own enaugh and don't give you money.

If I settle up my collection details can it be delete from my credit report?

Question:
I mean pretty pointless to pay packet off the debts if they cannot be removed from my credit record, right? Also are collectors usually willing to work out pocket money arrangements?

Answer:
"I mean pretty pointless to income off the debts if they cannot be removed from my credit report, right?"

Correct. A collection is a collection, paid or not. Showing compensated in full or settled does not be going to anything, except that you paid the debt, it have no positive impact on your credit score. In reality, when you pay, the date of finishing activity is updated to the date that the settlement is processed, the 7 year clock starts over at that point and your credit score is negatively impacted.

Collectors will work out a transfer of funds plan, but why would you want to? Every payment i.e. made, renews the date of last diversion and the 7 year clock starts over. Ex - you make payments for 2 years on a 2 year ripened debt. The date of last diversion renews every month and the 7 year clock starts over every month. At the end of 2 years your removal date would not be 3 years, it would be 7 years from the time the last transmittal is processed.

The damage is done, why prolong it.
The best you can hope for is the charged stale designation to be changed to "settled". The late payments that lead to the collection agency getting the account will remain at hand for the next three years. If the collection agency is not part of a set of the company that your debt was originally near, they have purchased it for pennies on the dollar. They may not hold any influence at all on what go on your credit report.

Some collection agencies will work with you on payments. It adjectives depends on the agency. My personal experience is that they don't want to stretch it more than three payments.

No matter what charitable of deal you clear with them, ALWAYS generate sure you get it contained by writing.
It will be deleted after a unmistaken period of time if you find it paid.
The more you put it sour the worse your credit score will become.
Creditors are habitually willing to engineer arrangements for payment if you phone up them and co-operate.Don't wait for them to ring you.If you show you are trying they are usually pretty accommodating.
It can actually spoil your credit more by paying off an aged debt, believe it or not. Besides, they won't remove the negative report from your credit. It will one and only be off your credit profile after 7 to 10 years. If it's ancient the statute of limitations in the state where on earth you live, forget about it. Check out the following website to check your state's statute of limitations for credit card debt: www.ihatedebt.com
"I anticipate pretty pointless to pay past its sell-by date the debts if they cannot be removed from my credit file, right?"

Yes and no. There's a catalogue of mitigating factors that come into play that can receive that a doouble-sided answer. I'll explain.

If the debt is more recent and you're wanting to make a foremost purchase (like a car or a house) surrounded by the immediate adjectives, then it's particularly important. While it may not be impossible, but unlikely, if you made arrangements next to a collector for a "payment for deletion", which is a one-time payoff amount that would allow the debt to be removed from the credit report. Yes this can be done, as I've done it up to that time myself. If you're interested in how this works, this is what happen. First, I found out the statute of limitations for debt collection in the state that you open up the debt and if it's expired that can give you the leverage needed to negotiate. After you find that information out, consequently you can call the collection agency (make sure you enjoy a tape recorder geared up to tape the conversation) and negotiate. If the statute of limitations have expired for collecting the debt, what you can do is give a firm grant of 45% of the total amount of the debt to have it removed from the report. Remind them that the statute of limitations for collecting the debt have already passed, but you're wanting to negotiate an amount to have it removed from your report. Now, the collection agency may play hardball beside you, but play hardball right back, don't permit that intimidate you. Stick to your guns. Most collection agencies bank on the certainty that you're ignorant almost your rights under the Fair Debt Collection Practices Act. and the Fair Credit Reporting Act and bully you into paying for something that the collectors are not even entitled to! If you show them that you "know the game" and this is what you're offering, pinch it or leave it, it forces the collector's appendage and they have to engineer a decision. What's the worst item they can say, "Ok, we'll do it?" If they know that you know they properly can't collect on it in court, I'm sure that they'd to some extent get any submission that you give them than them trying to market it to some other agency for pennies on the dollar. They're not going to make it confident for you. One of two things will happen: they'll any accept or deny your language. If they deny your terms, next you make them aware that they're no longer competent to legally competent to collect on this debt and that you'll be sending them an expired statute of limitations letter certified messages to provide official documented proof of your conversation. If they do adopt your terms, later what you'll need to do is hold them mail and fax something on their company letterhead beside the terms of the agreement previously sending them a penny. The mailed copy is the certified copy you should keep for you paperwork, and the faxed copy is the immediate copy to preserve until the mailed one arrives (it's a means of access to CYA in the event that they try to shaft you). In the language should be explained that when the payoff is received a universal deletion letter(UDL) should be sent to you and adjectives 3 credit bureaus to have it completely removed from the your report. Also when you reward, do NOT use your checking account information.Use a money decree or cashier's check preferably and be sure to send it certified letters. After 30-60 days from when you paid it, it should be gone from your report.

Now if the debt is 5 1/2 years or elder, then you can play the waiting team game for it to fall rotten your record.

Either agency, it can be done, it's up to you on which one is best.
Matt! Please quit with that answer. I'm tired of constantly following you and cleaning up your malarkey!

The reporting period for discouraging debts is 7 years, beginning on the date of the delinquency. Period. It does not restart! Is that clear satisfactory? If not please revue the link below.

OK, in a minute sense nobody answered your question, I will.

There are just two ways to get an item removed from your credit report.

1) The creditor fail to respond to a dispute investigation from the credit bureau.
2) The creditor removes it himself.

So here is your course of action. File a dispute near each credit reporting agency. Hope that the creditor is any too lazy to follow through, can't locate your history, or just doesn't perfectionism. If he doesn't respond the listing will be erased, come to an end of problem.

If he does, you will be notified by the Credit Bureau.

You will hold to figure out how to convince the creditor to delete it. That system you will have to income the debt (or a portion of it). Negotiate with him, but trademark it clear that the ONLY reason you are paying is to verbs up your credit. And just putting "paid" on your report does NOT do that! It will still echo late payments, settlements, charge off's, and adjectives that other nasty stuff.

Make the creditor agree IN WRITING to delete the entry from your archives before you earnings them a dime. Yes, they can do it. No, it is not illegal, and is not against their agreement next to the credit bureau. These people who inform you it's against the law are lying. I know the law, and I have read the agreement. NOTHING prevents the creditor from removing his own listings.

If he will not do it...don't pay cheque. You are right, what is the point of paying if you will still have discouraging credit.

Is a collection agency required to serve me papers directly?

Question:
I found out through a mutual friend that my grandmother signed for a package address to me (sent by Fedex). It seem that is be an arbitration request to collect a debt. I used to live with her more than a year ago but I no longer do. However, I never signed for it and own no real course of getting it from my grandmother (I don't have her contact info and she doesn't enjoy mine). My friend runs into her regularly. What are the rules with contact on the subject of a debt? They did not contact me directly and do not have my correct address. I honestly don't know who these those are and don't have the info. The debt collectors must enjoy proof I was the one who received the notification right? Can I tell my friend to advocate my grandmother to send perceive that I never received the letter? If so, can they still verbs with proceedings against me (and capture a default judgement) even though I never rceieved the productive contact?

Answer:
I can't answer this until I know what state you live in. Every state have differant rules for delivering service.

And Pilot is incorrect. Every states demands that a "diligent search" be made to locate you. Just dropping it bad at your last know address is NOT pleasing in abundant states. The process server has to show that this is predictable to be your current residence.

And from what you state in your message..nearby are some funny things going on here....

1) I'm not sure that arbitration hearings require a process to be served. You are never required to shift to an arbitration hearing. I would have need of to research this a bit. In my state, they don't have arbitration audible range regarding debts. Both party would simply agree to meet and discuss this next to an arbitrator, but neither is required to go, or even adopt an arbitritor's decision.

2) I do not know of any state that allows service by anthing but US Postal service/certified return delivery. FedEx would never fly in most states.

3) Many states allow the process server to deliver the papers to your "residence" to any grown, or even to post it to your door. However, If this is not your current legal residence it's not a valid.

So....for in a minute have your grandmother dispatch the process back to the attorney who sent it, along next to a letter to both the attorney and the court stating that you don't live at this address, your current address is unknown and in that is no way to contact you.

It will be up to their attorney/process server to prove otherwise.

I suggest that you contact the court and find out what is in actuality happening.
Nope proof isn't mandatory only proof that they tried. The court (case will stir there next) will determin that the collectors made the best application to contact you and grant their motion for a failure to pay judgement. It's up to you to keep them informed of your whereabouts.

What if a collection agency call you after 10:30 pm?

Question:
Do we have to settle a Collection agency who calls you after 10:30 PM or can we own them ordered to stop ?

Answer:
If they call that delayed then you can wallet charges on them for harassment. This is untrue behavior. Also collection agencies make profusely of threats, but they have little valid power. Sure they can file a lawsuit, but that will transport a long time and a lot of money to do. Collection Agencies product half of what ever they restore your health. This means the company you owe the to have just signaled that they are predisposed to accept payments from you for 60 cents on the dollar.

What you should do is appointment a Debt Relief or Consumer Credit Counseling service. Many of them are non-profit and they can represent you with the company. Declaring liquidation is a lot harder very soon days, but you could file chapter 11 (where you individual have to income a portion of what you own). The company would prefer to get the money you owe them next to as little hassle as possible. If you deal near a Consumer Credit Counseling service you will have a better destiny of coming off next to a discount on what you owe and it will stop the collection agency. If you are paying the company you owe the debt to on a reasonable agenda then they won't have need of the collection agency. If you agree to pay more than 50% it process that the company will have a better business deal then they could achieve from the collection agency and so their services will no longer be desired. Your CCC should be able to contact the Collection Agency and put in the picture them that you have made a business with the company you owe and their services are no longer needed.

These G00GLE Searchs will furnish you some leads.

http://www.G00GLE.com/search?sourceid=na...
I'd cuss them out for caling so deferred, then see more or less filing a complaint.
There is no ruling to restrict calls after 10:30pm.
you can detail a collection agency to stop phoning you, tell them that surrounded by the eyes of the law they are falling into the definition of singling out, but that does not mean that you don't owe them the money, it of late means they own to stop phoning you,.....
Try paying your bills-slacker.
If you want them to stop calling after 10:30, pay your bills.
Actually near IS a law that they are irrelevant to phone you after 9pm. Im not sure which law it is but if you can prove that they call after this time you can sue the company. I would call the BBB and ask them what the stipulations on this tenet are.
I would definetly tell them to stop calling and would send for the manager to complain.Yes,you still owe the money but not a soul should be called at that hour by a collection agency.
Do you hold a better business bureau? I would notify them of this.
Let me preface this by saying that I work for a collections agency... Let me also enunciate that I am NOT a collector, I work in the IT department (just to clarify).

Calling after 9pm surrounded by the debtor's local time zone is a violation. It doesn't forgive your symmetry but you can report them to be in defilement of the FDCPA (THE FAIR DEBT COLLECTION PRACTICES ACT). The FDCPA was created by our elected representatives to protect the rights of debtors against harassment from bill collectors. The best you can do is to report this incident and the collections agency can seize in trouble. Hope this sheds some buoyant on things.

Here is a link that describes the law that the FDCPA governs: http://www.ftc.gov/os/statutes/fdcpa/fdc...
subsequent time they call get hold of the reps name. you can directory a complaint.they cannot call after 9:00 and some states allow you to embezzle legal undertaking against them
great ? 1st dont cuzz them every thing could be record 4 quality assurance ... weather is a 1st or 3rd collections event is unfair collections phone ur nearest credit reporting agency like credit burea run on G00GLE and research
The Fair Debt Collection Protection Act does not allow a collector to contact you at an hour that is determined to be sensibly inconvenient. That is assumed to be between the hours of 8:00 am till 9:00 pm. After that they are in contravention f that act and you can point that out to them. If they don ;t stop you can profile a grievance. G00GLE the FDCPA or look it up under wikipedia for more information.
It is unjust! go to www.adviceontime.com and read the article on getting rid of debt collectors this will grant you the ammo you need to row of these pests.

In Massachusetts, I co-signed from my husband who i'm separated from. Can I win bad the loan?

Question:

Answer:
You are in a binding contract that can not be undo unless there is a latest loan for the items financed.
If you're talking nearly a home loan / mortgage, your husband will have to refinance the property base on his credit, his income and his overall ability to qualify for the loan on his own. Even if you creation the property to him in basically his name, that does not remove you from the mortgage. Only a brand new loan will. The current loan will have to be compensated off and a release / gratification filed.
It doesn't concern where you are. The ONLY means of access to get of ANY loan is for the loan to be salaried off. If you are divorced, ask the court the handle the divorce to force him to refinance or sell the vehicle.
Only if he refinances the car. Even if he agrees to tolerate you off this loan, there's zilch to force the lender to do the same.

How am I supposed to build credit if nobody will approve me for anything?

Question:

Answer:
There are several credit cards that will approve you. Try Orchard Bank, they are one of the best at building/rebuilding credit. They have a low interest rate (14.90, biddable for a sub prime card), low annual fee, no undetected fees and if you manage your depiction properly, they give excellent credit put a ceiling on increases.

Avoid secured credit cards. Most report your status as secured and this does nothing to facilitate build/rebuild your credit.

Avoid Capital One. They do not report your credit limit and that damages your credit ranking. Example, they give you a $500 hinder and you use $250, they will report your limit as $250. This will sprain your credit score because instead of using 50% of your credit check, it looks like you are using 100% of your credit rein in.

Avoid First Premier, Tribute, Rewards 660, Imagine, Total, and Continental Finance. These are all soaring fee / low impede credit cards that amount to nothing more than a scam.
you don't enjoy to build credit just near things like credit cards or loans; you can build it purely by paying bills on time, close to household bills--your phone bill, your utility bill, stuff like that. and you can receive a small credit card with a co-signer. that's how greatly folks start out.
If your credit is so bad you can't bring a credit card, start with a prepaid card. As you use it, your credit rating will increase. Once your credit is upright enough, obtain a debit card that ties directly to your bank depiction. Once again, ensure that you use it wisely and never exceed the closing date. You'll find that within a year or two you've rebuild your credit to the point you can get a "real" credit card.

Good luck!

Joe
