Credit Questions and Answers

Jail sentence for credit card fraud...?

Question:
...for a first offense, $700, in the state of Florida. Jail time, or newly
probation/community service?

P.S. If the only guidance you can offer is "the referee decides that" or "check your state statutes", please don't excess your time or mine answering this question. I am only looking for some simple advice.

Answer:
It depends upon the severity of the offense.

In other words, if tried and convicted of a felony-level credit card fraud, incarcerate time is entirely possible. But let's say for argument's sake that this is a misdemeanor-level offense, or at the most, a third level felony. If tried and adjudicated guilty, within will likely be a detain sentence suspended to supervised probation, possibly 1 to 3 years in length. I've see similar offenses get court fines/costs contained by the hundreds of dollars, full restitution to the victim, and 25-50 hours of community service.

If probation is violated, it's possible to be in motion straight to jail.

Hope this help. :)
It depends on the case, history of offenses, etc.

If a soul just used a stolen credit card, likelihood are it would be a few months in intern, a fine, and community service.

The more you get involved, the worse it's going to be.
Jail time and community service......if adjectives goes ably. What judge do you dream up is going to believe that story...that he had no intention of obtain the things he purchased on that credit card? What was he doing, somewhat shopping for the owner of the credit card?Just thought he would pick out some nice things he might like?If you don't want to hear S**t in the region of the questions you post, don't swing around with S**t,and you wont enjoy to worry your pretty little lead off in the region of it!
Simple advice: Don't pick up the soap within the shower room.
did he benefit in any route?/ the answer to your question depends on the amount involved and the level of the theft....first level...etc............if he never benefited then near is no crime..if he arranged for a third party to benefit it may as economically be him
Your question is missing some information. Did "he" use his own credit card or be it another persons card?

If "he" used his credit card later there probably is no fraud that could be proven by the credit card company. But the company will come after him for the money owed. This could eventually front to a civil suit, where they will sue him within court for the money. They will then attempt to frills his wages or attach any bank accounts he may hold.

If "he" used someone else's card without their consent, and if they find out he did this then yes he could ending up in Jail. But even though you don't want the answer that "the consider decides that", explicitly in reality what will happen. As they whip a lot of things into consideration, such as any prior criminal history and how impossible the fraud was. So he might capture a fine, probation, jail time or adjectives 3.

How long can a collection agency come after you for an unpaid debt?

Question:

Answer:
I was told abundant years ago, 30 or so, to never pay a collection agency. I own never paid a collection agency and never will. I business deal with the personage or company that I incurred the debt with.
If some one call and wants money I ask them if they are a collection agency and if they articulate yes I tell them I don't promise with collection agencies and sway up. I have told them to dispatch me a bill, which they never do. With all the scam going on currently you don't know who they are and they can get info from credit reports and this also go for any one that says they are from So and So looking for a donation, they own you credit card number and you are in the poor house.
it depends on the snag etc......indefinately until you get proactive by hiring a credit repair service to urge all derogatory info on report cheap and delete much base on creditors failure to verify debt inside prescribed time period
Keep within mind that they can also sue the person and it would cost them closely more.
For as long as they think you might money. Court judgments are usually controlled to ten years but can sometimes be extended. There are statutes of limitations on filing suit for collection of debt that rise and fall somewhat from jurisdiction to jurisdiction and may be affected by contractual vocabulary. Most negative items must be removed from a Credit Report after seven years.
Depends on your state of residence.

The Federal Trade Commission (FTC) refers to outdated debts that are beyond the point at which a creditor or debt collector can sue you to collect as Time barred debts.

The windowpane during which a collector cannot sue you is also referred to as the statute of limitation length and is usually between 3 to 10 years after the day of the debt or the later activity date on the commentary.

To determine the last amusement date look at your credit report.
They can "try" to collect forever.

If a person is bygone the collecting SOL, they can continue to try to collect but the cannot "legally" sue - though collection agencies are not usually prearranged for doing things the legal road.

They cannot re-age the debt and report it on a persons credit report historic the original obsolescence date. (again, they are not agreed for doing things the legal way)

If a being is past the collecting SOL and one dunned by a collection agency, it would be in their best interest to dispatch a SOL letter to the collection agency a bit than just ignore it.

That little act could liberate the hassle of having to answer a summons near a affirmative defense of SOL and having to show up surrounded by court to keep a defaulting judgment from human being granted.

edit+++++
I was not the one who give vince the negative mark off - mainly because the gist of what he have posted is correct - though the link he have provided is inaccurate surrounded by it's listing of states collecting SOL statutes.
For a correct book, you might click on my profile and click on the link I enjoy listed to find the correct collecting SOL surrounded by your state.
Normally they will do "hard" collecting for up to 3 years. After that they will try to collect on it if they think it collectible ei: already doing a money plan. Otherwise they too will find it uncollectable and possibly sell the debt again to another collection agency and the process would start adjectives over.

Question:
I originally wasn't going to get insurance beside my company then i did, but didn't recieve a card. the benefits bureaucrat called me subsidise with this info, i faxed her my social payment number so she could clear it. i recently get updated credit reports from all three agencies so my credit hasn't be tampered near (that is reported yet). what else should i do to protect myself?

Answer:
contact your local social security department and alert them - Also you should tell the credit beuras that you want a fraud alert placed on your credit info --- That opening if someone does try to open credit contained by your name the creditors are warn that it could be fraud and are instructed to contact you at a phone # you provide and sometimes they will require you to answer questions simply you would know... its more red tape for you to go and get credit but well worth the peace of mind.... Also, database a police report for your records too,
CALL local Police and FBI
contact the delivery service who the insurance is through, see if it's a typo or real identity nicking. If it is then record a charge against the person and see if the owner will give information in the order of who is using it to the police.

Have you ever hear of a loan where on earth they sent you a loan check every month instead of a lump sum?

Question:
You still make monthly payments also.

Answer:
Are the payments smaller than the check (cheque) they transport you? ;)

Yes, but this is extraordinary.
Never heard of that and it sounds fishy. What possible benefit could they derive from sending you payments and later you sending them payments?

Late Bill ?

Question:
Ok so I havent payed my bill for a jewelry credit card from Kay Jewelers in nearly 2 months..... Does anyone know if they will take me to court or transport me to collections?

Answer:
you will go to collections first
They will imagined send your database to a collection agency eventually, or call and aggravate you themselves.
They'll keep charging you interest, but depending on your language of agreement with the Kay Jewelers credit card, they could embezzle it up with collections.
Eventually, both. Pay your bill. If you read the question on this site, you'll see that non-payment of bills creates far more problems than anyone short of money for awhile.
many calls/mail reminders, after collection

http://letsgobble.com/
if you don't send them something, eventually they will, but if you're making some genus of payment, they can't, even if it's a partial compensation, they might threaten you or send a communiqu¨¦ to scare you ,but they can't and but they WILL charge you extra interest and slowly fees, and it'll go on your credit report, i.e. you loose points on your credit chalk up.
Because the lawsuit process is usually slow and more costly, the creditor will try every other available remedy, especially if you are judgement proof.

They may send you parcels or call you first for a salary, if that does not work.

Then they will send the rationalization to collection.

If your debt is less than $1000, it is unlikely they will pursue a lawsuit.

It Is best to a short time ago send the salary if you can, even if it is not the full amount.

They may be willing to workout a topical payment plan near you.
Probably.

Best way to find out is hail as them. If it goes to collections, they will trash your credit rating. Call them and explain you are have trouble paying and ask if they can work out an installment plan for you. Most companies are not unreasonable and are more interested in eventually getting your money next ruining your life.

Do you assume it's do for an employer to substructure your creditability on your credit report?

Question:

Answer:
I disagree with employer doing this. The employer has no thought what caused the financial problems (death, disorder, catastrophe such as Katrina) and to prejudge some one base on this is not right.
they are looking for responsibility.
It of course depend upon the reason your credit is either apt or bad. I hold bad credit, but not because I spent frivoulously beside a credit card. I don't even own one. Instead, I lost my job, have a couple of evictions over the last 15 years, and have a major stay contained by the hospital, which pretty much shot my credit to bits. I have no insurance, can't afford it. If at hand was anyone wh NEEDED a livelihood in establish to fix his credit, it's me. But if all they do is trendsetter by saying, "Well, this applicant have bad credit, so he's outta here no event what the reason," after yes I think it's undue.
Yes if you have a credit problem, most potential you have a problem taking aid of your own business i don't hire anyone that has desperate credit they just cant be trusted contained by my store. because they wont be interested in my business, verbs up your act and draw from with the program.
The single most describing document that a creditor, employer, etc can get on a prospect is the credit report. It tell about recent address, job history - to an extent, public annals, whether or not you pay your bills on the dot, and so on. I look at reports every day and can seize a good thought about a human being just by looking at it. Most of the time it tell a story something like: This individual had a impossible run in 2003 when he changed job and made a bunch of late payments and get a judgement recorded - something approaching that. Then it will show a clean register for the past few years. Whatever the casing, it reveals a lot almost the person - but not the reason behind them. It can be unwarranted.
If I wanted to hire you as a bank clerk at a bank, I would distinctly want to know if you are in a financial mess. So to answer your sound out - Yes..
As an employing chief for many years, I found a large amount of correlation between how one handles credit and how one handle a job. Both speak to a sense of responsibility, reliability, following through on promises, accountability.
No, employer see that you have some delinquent accounts ,but they don't appropriate into account that you may enjoy been out of work for 6 months or more. And i.e. the reason you wern't competent to pay your bills, but they don't carefulness. They just assume you lately didn't care and be being a deadbeat. So no it isn't open-minded for employers to foundation credibility on your credit report. It should be illegal for an employer to look at your credit report, unless your a supporter or have control over others peoples money.
It depends on what the situation is. I mean if u r going to work surrounded by a bank, consequently yes. If your going to be flipping pizza's then no.
1. Life is not 'fair'.
2. 'Fair' have never had a unanimously agreed upon meaning.
3. Judging base on you credit REPORT, I have no problem near.
4. Judging by your credit SCORE, is a problem for me.
I am in the process of eliminate my score by paying sour ALL debt and closing ALL credit accounts. My REPORT will show responsibility, but my SCORE will go away.
I THINK ITS FAIR
Well, your credit report CAN read aloud a lot more or less you.

If it looks like you are a irresponsible scumbag, afterwards they would rather know previously they hire you.

THAT SAID: I think they at most minuscule should tell you what they found and ask for the explanation. If it's because you get screwed, that's one thing. If it's because you own a "well I don't close to paying bills" mentality, that's another.
of course it is undue. i see a lot of ethnic group answering your question stating that it shows who you are and adjectives that kind of insanity. the bottom flash is that judging potential body by their credit score is profiling. they know it, but they wont accept it because this is a system that is used to hang on to the playing field unleveled. Did they use a credit win when there be an onslaught of hiring immigrant?? i work in the solid estate field. most of your foreclosures deal with immigrant who got homes beside no credit check. they had the job, so the lender loaned them the money to move in. explicitly another story though truth, the bottom line is still reviewing a folks financial stability has zilch to do with their wherewithal to perform within the work place. wake up america.

Fastest opening out of credit card debt?

Question:
no spam i will report you

Answer:
Add up all your monthly minimum payments later figure out the MOST you can append to that from your monthly budget. Then pay respectively credit card the minimum balance EXCEPT the on next to the greatest % interest rate. Throw all the extra money you can at it. Any extra money you draw from ex: tax return, extra chore, birthday money etc. also put on the worst one. Once that one has be paid stale go to the subsequent highest % rate. And this is the most earth-shattering do not charge anything else. This is the fastest way.
Pay your bills.... seriously... sorry thats not more profound but thats the confidential..... lock your card up or cut it up and set up a schedule for you to wages it back every month..... it might clutch a long time depending on your amount of debt. The Key is stop adding to NOW...
There are several ways to get out of credit card debt.

First, it really depends on how huge the balances are. In my baggage, I cut them all up and go to my financial institution (credit unions are best) and took out a two year signature loan next to an exact payment respectively month. I only own 9 more months and I'm done.

Second, there are companies everywhere that give this very same example, but they adjectives think it's their own. Say you hold 3 credit cards. One is through Bank of American with a set off of $1000 and a minimum payment of $20, second is a Discover will a $2500 harmonize and a $40 minimum payment, and thired is a Capital One near a $4000 balance and a $60 minimum settlement. What you do is see what extra amount you can pay respectively month, like $100. Pay sour the smallest balance first. So, instead of paying Bank of America $20 respectively month, pay them $120 until they are rewarded off, while you are still paying the minimums on adjectives of the rest. Once that's paid stale, start on the Discover, but instead of paying $40 each month, put in that $120 you were paying on the Bank of America, so foot $160 on the Discover Card until it's paid sour. One it's paid past its sell-by date, start on the capital one, instead of paying the $60 per month, add on the $160 you were paying on the Discover. Now money $220 on the capital one respectively month until it's paid sour.

This really works. People even pay past its sell-by date their mortgages in no time using this. I hope this help...
1. Ensure your spending/expenses (including minimum payments to the credit cards) are less than your lattice income.

2. Put the money that is gone over after your spending/expenses toward your highest interest rate debt.

3. Once you settle that debt off, add on what you were paying to the one you compensated off to the minimum salary on the next topmost rate debt.

4. Continue the process until your debt is paid sour.

If you spending/expenses are higher than your income, cut your spending/expenses to the undressed necessities, get another career, and/or sell things so that you tilt your income above your spending/expenses.
Cut down on spending. Don't buy things you do not need. Once you do that you will see how adjectives that money adds up and you can money off your credit card alittle faster

Should i contact a attorney in relation to the money i still owe after my saloon be repoed?

Question:

Answer:
There is absolutely zilch to go on near your question.

So.........

If the repo man breached the peace while doing the repo, if the untested creditor failed to provide you near all of the required notice before and after the public sale, if you live in a right to cure state and they inferior to allow you to cure it, if they failed to put on the market the vehicle in a officially recognized and timely manner - next you might contact a lawyer or knob it yourself - if you can prove any of it.

If you are past the 4 year UCC collecting SOL - later you might contact a lawyer or touch it yourself.
It won't help, and any clad lawyer will give an account you that. You signed the note next to recourse so you'll have to label up the shortfall. Sorry.
And what do you think the advocate can do for you? Not that contacting a lawyer isn't a correct idea, but it costs more money and you won't accomplish anything. You'd be better stale paying your debt with the money you own.
Unless you file ruin, you are responsible for the deficieny.

Good luck
The only entity a lawyer could do for you is negotiate a settlement for smaller amount than the deficiency. After paying the advocate, you would probably be better off including the allowance in your proffer to the creditor.
Unless there be a violation of the regulation on the repo peoples part, near is nothing a advocate can do for you.

You owe the debt.

I go to US BANK to apply for a HELP loan for 10,000 to repair my home and bring it up to code?

Question:
HELP allows homeowners in most Cuyahoga County communities to borrow money for repairing or remodeling homes at three percentage points below a bank’s marketplace rate for home improvement loans. the loan personage at US BANK then call a couple days later and told me HELP turned down my loan but she could hold someone from the bank hail as me and offer me a different proposal. He did ring up and told me that he could give me 15,000 for 7.99% I told him i did not want that much money however told me i had to embezzle out that much. Why would US BANK not give me 10,000 all the same approve and encourage me to cart out a BIGGER LOAN? Smells fishy. Also they stated HELP turned me down when in reality it was the US BANK itself. This make me question if they looked-for me to feel as if at hand was no other alternative later to go near their offer of what i surface is a subprime loan. They stated i did'nt qualify for the HELP loan because of my credit (in their words i was "50 points or so off")..i am confused it sounds awfully shifty

Answer:
I'm sure that the HELP loan is a subsidized loan which has strict qualification guidelines. You can check beside another bank, but I doubt that USB would disqualify you. You may be right that the loan they want you to transport is a sub-prime, and you want avoid that if possible. Don't borrow more than you need--you're right in the region of that.
shop around, thats very unusual
In adjectives actuallity - it isn't US Bank who provides you with the loan. I know how funny this sounds, but most bank go to other companies for loans. They don't do them in-house. The purpose they wouldn't finance you for 10,000 is probably because they are taking a risk of getting their money wager on. They have secure limits that they can loan out to those.
If there is not a prepayment cost, then why not freshly take the 15 and after take the xtra 5 and put it on the loan. Unless you are looking for a lower interest rate. Another substitute would be to look at your finances and see if you can use that money to pay rotten some bills with superior interest rates. This way you will be in your favour money on the other bills.

Collection Agency, Medical Bills, and My Credit?

Question:
Last December I had an abcessed tooth that be giving me very doomed to failure headaches. I go to the ER a few times. I owe them a few hundred dollars but I haven't contacted them about it so in a minute they sent it to a collection agency. What choices do I have? I want to reward the bill and I have the money immediately but who should I contact to pay? Would the ER adopt payments from me even though they got a collection agency involved? Is my credit ruined? it's with the sole purpose been 5 months and I didn't conjecture I'd have to wages them so soon. Money is hard to come by on the other hand I don't want my credit ruined. Thank you.

Answer:
Order your credit reports and see if the collection agency is reporting or not. You can get your free reports from www.annualcreditreport.com

With medical bills, below HIPAA, you do have the right to cut out the collection agency and discharge the medical provider. If you have any contact next to the collection agency you may be waiving your HIPAA rights.

If you want to use your HIPAA rights and pay cheque the hospital, you would have to discharge the full amount due. Which you say you hold the money to pay, so that won't be a problem.

The hospital would HAVE to withdraw the debt from the collection agency and demand the collection agency remove anything roughly speaking you in their files and remove anything they own placed on your reports.

You might go to the following site and read over the HIPAA epistle page. When you use it with your contribution, you would include (insert a ) in the notification.
http://whychat.5u.com/hipltr.html...

If you have any question about how to use that notification, etc., click on my profile (on here) and click on the last contact listed. Feel free to ask any request for information you may have surrounded by the Medical Forum (which is a sub forum of the Credit Forum)
You can do a couple of things, send a note to the collection agency telling them to call a halt all contact next to you and send the reason back to the ingenious place because that is who you would approaching to deal beside. Also include in the epistle if they have reported anything unenthusiastic to the credit bureau to have it delete from you report. Let them know that circumstances and whatever you do win everything in writing. The subsequent thing you can do would be to volunteer them a settlement amount but request that if it is accepted, they must delete any glum info from your credit file. Get this surrounded by writing before settling! You can also contact the ER and see if they own a income guideline for patients without insurance. Sometimes those are eligible for free care and they don't even know it. Next time don't be in motion to the ER for a toothache! Try a dentist and if one isn't open, acquire a hold to some strong painkillers until they open!
Good Luck!
Small steps similar to paying your bills on time and using simply part of the credit available to you. Also use your credit cards for making small payments regularly, so that it is reflect in your credit account. More tips available at http://www.acreditlibrary.com/buildcredi...

Thank you!

Answer:
Could be the %fee they charge the vendor.
Umm no I imagine it is the other way around, it is primarily MC which is standard but then again it depends what your mechants are using.
mastercard is are credit cards
visa cards are not debit cards so the merchant pays smaller quantity on % due to a lack of float
visa is permitted almost anywhere as if you used master card there some masked charge believe it or not
