Credit Questions and Answers

How may of you enjoy file collapse? Are you glad you did?

Question:tell us the pitfalls and the benefits.
I regard as this would be useful info for some.
I read somewhere that more than partly the members of congress own filed at some point.( don't know if that's true or not, but interesting )

Answers:
Yes I did.

Due to a ton of stupid mistakes, life span disasters, and unforseen problems my life be being destroyed.

The hot bankruptcy imperative was give or take a few to go into effect. I be like thousands of others who be on the "bubble". Waiting to file would cost us far more money.

I did not see any path of getting ahead for several years. If I filed for collapse I would be messed up for 5 years (the period of my "plan").

No, I am not glad I filed, it's a completely depressing time in my natural life right now. But the alternative would enjoy been much worse.

The discouraged part is if a few of my creditors would work near me....if a couple credit card companies would restore my low credit card rate (accidently went over my credit "limit" and get severely punished)...

None of them would. 20 years if extremely good credit get ignored. So in a minute they get zilch more from me....I guess that's the only silver facing in adjectives of this.

I read that 2/3's of all the chapter 13 ruin plans fail. I believe it.

Now I spend profoundly of time counseling people on how not to spawn the same mistakes.

Other Answers:
resourcefully it stays on your credit 10 years ,but it saves you money and next lenders will still be very jubilant to lend you after a year from bk

No. I have never file bankrupcy.

how to stop creditors wage garnishment?

Question:

Answers:
The laws and procedures rise and fall by state, so I encourage you to consult a local attorney for further proposal. As an attorney with experience setting up wage garnishments, I can donate a few comments.

1. Creditors are almost always of a mind to listen even if they have a acumen. Try negotiating a compensation plan you can live with.

2. If you are appealing the shrewdness, most states will require you to put up collateral for an appeal bond.

3. You might be able to database a claim of exemption. Some states have law that allow judges to weaken the amount of garnishment due to economic poverty. If you live paycheck to paycheck and need every dime to settle rent, the judge my reduced or stop the garnishment. You should see a local attorney or conceivably the court clerk to get the crucial forms.

4. Bankruptcy is an option to consider. Filing liquidation will stop garnishment right away. Consult a qualified bankruptcy attorney.

Other Answers:
It can't be stopped-- that's the point.
Set up clearing plan. Most businesses will work with you. Good luck!! Get next to credit counselor (credit union or local bank) and set up budget plan.
1) Pay the debt or
2) Consult an attorney and profile for bankruptcy if your financial situation allows beneath the new law or
3) consult an attorney and file to vacate the shrewdness if you have a valid defense
Creditor use wage garnishment as a final resort measure to catch what is owed. Your ONLY options at this point are money in full or a settlement payoff, or collapse. Get together as much money as you can to offer a settlement to the creditor; you might gain lucky and they will accept a smaller amount as a payoff. Bankruptcy will stop a garnishment but will screw your credit. If this is a creditor that reports to the credit bureaus, you are already messed up.

I work for a directive firm that does collections.
Even if you do not tell where on earth you work, there are ways to find out. We exercise skip tracers to locate debtors and find out where they live, work, edge, go to arts school, etc.
Like many citizens have already said, a garnishment ( a Writ of Execution) is a later resort that creditors use to get donation on an account. Your option at this point are very set. First, the writ will go through at lowest possible once. (the money obtained will be use to money for the costs of issuing the writ). No creditor will release the writ prior to the first garnishment. You can try to appeal to the angency, but this will only work if you hold been nice and cooperative. Which you most probable haven't or they wouldn't be executing. Another alternitive is to change job. The writ must have your poe (place of employment) on it. If you modify jobs the writ must be started again after they find out where on earth you work. You can pay it rotten, it will be much more expensive (i.e. court costs ect.)you can file for ruin, but because of the law convert it is very completely expensive adn not really worth it if the balance on the sketch is small.

Ways to avoid garnishment:
Don't tell a collection agency where on earth you work.
Don't pay near a personal check-they record this info and can execute on your edge account and rob it all!!

hope this helps-
p.s. If i didn't contemplation I wouldn't have told you these secret.
Source(s):
I work for a collection agency
You don't give details so I can't impart much advice other next very broad.

Assuming that you have already gone to court and did not follow the law lords order to pay envelope....the creditor had no alternative but database a writ and go after your wages.

It's be my experience from people I've counsoled that you are not feasible to negotiate any further with the creditor. After considerable time and expense they have to take your travel case to the very bring to a close. They are now guaranteed to bring back your money (as long as you continue to work there). It may purloin a while, but they will get it.

It's probably not plausible you are going to be able to recompense the whole debt sour, and the creditor isn't going to accept a gift plan from you (he has one immediately, remember? Called garnishment).

If he agrees to a payment plan and you evasion, once again he's back within court spending money and time. I don't think he will cooperate.

I'm surprised the two previous collection agents slid over these observations.

Bottom smudge is, you are screwed, they got you.

Now, if we are chitchat about the "possibility" of a garnishment, start negoatiating beside them. At what point of court action are you at very soon? Has it gone to trial? Has a judgement been ordered?

Good luck

Anybody within Ohio win a credit card debt statute of limitations defence?

Question:Credit card debt is more than 6 1/2 years old (no payments & no charges). Being sued contained by court. Other Atty said I owe this forever. Attys. I tried to have represent me said, Internet & Suze Orman do not prove decree - even though I gave specific Ohio Revised Code Nos.
I hold no money for an atty anyway - if I did, I'd use it to settle debts.
OR: Any Atty want to help me?

Answers:
Grace,

I'm still looking.
Take a look at this site....It pretty much confirms what I said past. Ohio law is fuzzy, and doesn't really say what credit card debt falls into.

Just curious, enjoy you sent a letter to the collection attorney requesting that he "validate" the debt even so?

Lemme tell you something in the region of Collection Attorneys. I've dealt near a few, and there is a clear outline.

-They are usually young, right out of college and purely got their inn licenses (barely)

-They tried to bring back into a legitimate imperative practice, but due to poor transcripts and low bar score, they are told to "go away and come put a bet on when you get some experience".

-They try their mitt at PI (Personal Injury) law, chasing ambulances and bothering insurance companies. After a year of this, they realize that PI work demands an expertise within negotiations. You are trying not to acquire it into court, where you own to face some high-paid insurance lawyer, and cases can drag on your years. And in several cases you are working on a "don't win, don't pay" basis. Since Collection Attornies don't hold a clue how to negotiate, other then "reimburse up or else", they must move on.

-They try their appendage at public defending, but that doesn't pay much.

-Collection work! That's the ticket! In most cases the companies are hand them cases that are a lock, and all they have need of is for someone to file, appear surrounded by court, and do some basic investigative work. Experience surrounded by repo work preferred.

I know there are Collection Attorneys reading this forum....how close am I to the truth??

Keep surrounded by touch, Grace.

Other Answers:
Credit card companies are suing like crazy at the present time because of the new collapse law within their favor.

You can be sued and a judgement will hold over you. If you sell anything of title close to a house or car and money made from it will shift to the suit for 7 years. In some states after they win a judgement against you they can file for lien on your wall account. Once they find your side they can lien against for 4 years and that is it.

However judgements of personal debts and debts can not be owed previous 7 years per federal law. No state can legislate beyond that length of time, they can only shorten it for individuals in their state. If the debt is 6 1/2 years since you remunerated anything on it, even if they sue you it will only be valid for 6 more months. It is not base on what they do but when you last salaried. Read the Fair Debt Collection Practices Act. Talk to a credit attorney.

Some states have law that can reposses items for judgements, some have property codes protecting folks.

how do I remove nothing go together past its sell-by date my credit report?

Question:

Answers:
That zero be a foil for is a good point its called a PIF (paid within full) it says that you hold made a payment on an information and will actually comfort to increase your credit score (depending on the type of account)

hope that help

Other Answers:
You can only enjoy items that are incorrect removed from your credit report. Otherwise, items will remain there for 7 years if near are no changes and afterwards it will come off.
You can dispute it as an invalid charge if you have a feeling it is in error. It will force the credit bureau to check it. If the creditor does not respond contained by time, they will remove the account.
To remove a zilch balance, freshly charge. Then you will have a go together.
You don't want to remove that zero stability from your credit. Being on there just helps your credit mark, especially if it is over 18 months old and never slowly.

and you don't want to close the account
I will assume this is a closed acct. If the tradeline be a loan, it is increasing your score. If it is a revolving acct, it will be removed 7 years after the reported date. Scorewise, its a tossup. I would guess that it improve slightly over null.

On you credit card statements, whats the difference b/w APR and the day by day rate? Are they 2 charges?

Question:

Answers:
The APR is the annual percentage rate. When this number is divided by the number of legal bank days (used to be 360), you get the day by day rate. The balance due on your credit card on any given hours of daylight is multiplied by the daily rate. The product is after added to the original go together due and carried over to the next daytime, then multipled by the each day rate again, etc, etc, etc. The finance charge per month is adjectives the daily rates added together.

Other Answers:
There is individual one charge, the daily rate is calculated day after day. The balance for that sunshine times the daily rate. Every hours of daylight is then added up.

At next end of respectively month a new amount is due some of it is the previous interest. Since interest is human being charged on interest it becomes a nightmare to amount out what is going on. Enter APR.

This is equivalent to the food labels unfolding you how many calories are within the box of cookies, they don't want to tell you but they own to. Same for the credit card. They have to report you what you real rate of interest is for EASY comparison to other forms of lend and other lenders. This APR is the one number you need to compare adjectives of them to each other.

email address for mastercard..haven't received my monthly bill?

Question:need to find mastercard email address. Hve not received Feb bill I hope this "answers" is not another circular solution that doesn't work

Answers:
I outstandingly suggest you look at your past statement and find out the website address where on earth your bank keep its online website for credit cards. If you don't have a ancient statement, G00GLE could no doubt bring back it for you, or the people at the 800# on the posterior of your credit card will know it. Then get on the website, register yourself on the site, and next you will be able to bring up a copy of your up-to-the-minute statement, including past statements (usually 6 months) and even current stir.

Then in the adjectives if you don't get a statement, it's other easy to bring the information you need sour your computer.

You can even go a step further and accessible a checking account that have free electronic bill pay (Bank of America, Chase, and Citibank are three). Then you won't even obligation the credit card company's payment ticket and envelope to foot your monthly bill. Depending on the bank, electronic payments gain to their destination in 0 - 2 days if they enjoy electronic payment arrangements near your bank. All the credit card companies do, base on my experience. My experience is Chase's electronic payments go the fastest, sometimes getting in that the same daytime. Bank of America's always transport exactly 2 days. Weird!

One more bit of advice. I've found that adjectives the credit card companies are flexible as to when their individual statements close for the month. If you call respectively company and get adjectives your credit card biils and other bills coming it about like peas in a pod time every month, it's easier to know when you're missing something and go looking for the information vital to get them compensated on time.

Other Answers:
Problem is they adjectives master cards don't go to like peas in a pod place.

Look on the back of the card for a customer service number. If it don't hold one, call any number on it.

I'm convinced they do this because if you "accidently" forget to compensate your bill....guess what? Late payments trigger their penalty clause and your interest go up to over 21%!

Or just look on a previous statement. Um, you are keeping your past statements and NOT tossing them within the garbage, are you?
My Master Card have a 1 800 423-4343 for customer service. Give it a try.
Call the phone number on the back of your MasterCard.
