Does an unpaid credit card win forgiven contained by 10 years?

Question:
Hi. Someone I know just get a letter something like an account she owed money on 20 years ago. She thought she compensated it off. I thought if you owed money on a credit card, that the debt is forgiven if you don't repay for 10 years. Now they are looking for 150 bucks 20 years later. Very uncharacteristic.

Is debt forgiven in 10 years if you don't foot?

What do you do if there is an side with such a small amount of money to be precise saying you owe when you don't cogitate you do and can't remember something that may have happen 20 years ago?

Answers:
Check your state's statute of limitations. Most states are 5-7 years. I HIGHLY doubt that they can still collect on that debt.

Send them a letter letting them know of their vandalism of your rights and ask them to cease and desist adjectives collection and communication activities.
The debt remains uncap and due until paid surrounded by full. It will not become forgiven, it will not be 'forgiven' until the debt is paid rotten, you are responsible for the debt.
No the credit card company doesn't forgive the debt. They have written it rotten as a loss after this much time. Believe me, the amount owing after all this time would be much better, and would include thousands for not paying each month, and slow fees each month, and afterwards compounded monthly at the highest interest rate. This is A) a scam, or B) a collection company that bought a chronicle from credit card companies for pennies on the dollar, and then they try to collect anything they can. Just forget about it, they are harmless, even though they will try to not tell the truth to you. They to will go away contained by awhile.
american business never forget...hence how they've managed to rip bad the people more and more respectively year. hell if you open a sandbank account and never close it or never use it THEY'LL ACTUALLY CHARGE YOU FOR NOT PUTTING MONEY IN IT.
it used to be after 7 years they wipe the bill off but near the new law that changed. I would imagine after 20 years they would make available up. Go to your states government page and you should know how to find something sorry i couldn't help more.
it's different from state to state.
However, purely because the statute of limitations is up on a debt doesn't mean they can't verbs to try to collect on it and a lot of times they'll if truth be told try harder as the time starts running out.
Beware, if she does send them any money she's primarily "renewed" the account and will hold to start all over again.
check out this contact for info on your state.

http://www.fair-debt-collection.com/stat...
Debts are not forgiven automatically after any period of time. They can attempt to collect from you until you due, and even after that, they can collect from the estate if it have sufficient value.
You are protected below the Statute Of Limitations Law on old debt.
No such item as forgiven debt. The debt is outstanding until it is paid contained by full.

Chapter 7 Bankruptcy Question?

Question:
Hello everyone. I wanted to ask a press about Chapter 7 BK. If anyone know the answer to this question, I would greatly appreciate it. Well, I am file for Chapter 7 BK, and I just not long filed my taxes( after I file an extension). My attorney told me that if I file right in a minute, then I would hold to surrender my tax refund($5000) to the trustees. However, If I keep on till I receive the tax compensation and then spend it, afterwards file for Chapter 7 BK, that I would no longer be liable to appendage over my tax settlement because I got it until that time I filed for BK. I know that I should trust him because he is the BK attorney, but it basically sounds kind of chance. The last item I want to happen is that I spend the export tax refund and the consider tell me that I own to give the excise refund to the trustee. If anyone have knowledge on this topic, can you permit me know? Thanks!

Answers:
Listen to your attorney.
Part of your Bankruptcy filing is have to provide your previous years tax returns. The Trustee will see the return on the return and for 5K probably inquire about it. In most cases if you can prove correct how you had to spend the money(Bills, Food..etc) you will be okay. That is if you move about out and purchase a Big Screen TV or a boat you are probably not going to be able to hang on to the Refund no matter if you database before or after you receive it.

It is going to be up to the trustee and determing your other allowances as if you would own to give up/back the reimbursement. So I would say freshly wait to record until after you receive the refund as your attorney have said.
OC1099 is correct.

As long as you can document that you spent the money on things that were required resembling bills, clothes, utilities etc. you should be fine.

Anything else will be looked at as fraud and you will have to repay the money.

Once u return with ur creidt report (i didnt discharge for it) can u still obtain another one for free?

Question:
r u supposed to get a credit win once a year for free or a credit report? and if u have to money for the credit report after u got ur free one how much does it cost

Answers:
A credit SCORE and credit REPORT are two different things. You are with the sole purpose entitiled to a free credit REPORT, the credit score will other cost you money. The score will usually run roughly speaking $15 per score but that also includes a report. There are companies that volunteer "free" scores but you enjoy to sign up for services in instruct to get that. If you don't reverse in time you will consequently be charged for the service.

As for the credit report it depends on what you already got. You are allowed 1 free per year from respectively of the 3 main agencies(Equifax, Experian, TransUnion). So if you singular got it from one of the 3 you are still allowed a free one from the other two.

After that it will cost you, and that depends on the state you live within. It will run anywhere from $8 to $10 per report.

The other way to find a free report is to apply for credit and if you get denied you can convey a copy of the letter and receive a free one that route. However, this is not usually a way to dance because it would have be considered an inquiry, and too many of those within a short period of time look impossible.
You can get one free one a year after that nearby is a charge.

http://www.equifax.com/home/
Each state is a little different contained by what they will allow, you need to check beside the three bureaus. Experian, TransUnion and Equifax. They will let you know for sure, most states allow at least possible one, some allow more if not from duplicate bureau.
If you did not go to my freecreditreport you may know how to get another. If you with the sole purpose got from one reporting agency not adjectives three you can still get it from the other two. The credit chalk up costs money. As for getting another report if you apply for credit and are turned down you can within ninety days request a copy of your report from the agency they used. it tell you who to contact on denial letter. you can seize one each time you are denied.
At annualcreditreport.com you can go and get one free report (not score) from each of the three credit reporting firms respectively year, so you could get one every 4 months if you progress to a different reporting firm each time.

Chane's right about Orchard Bank. The EASIEST credit card to find is a secured credit card. Think of this as building credit with a nest egg account, becuase that's exactly how that would work a deposit would be placed upfront to win the same amount of the deposit contained by a line of credit. They start sour as small as $200 and you can increase your credit line ever so repeatedly by adding to the deposit. As long as you earnings on time and maintain the balance down from what you spend, usually you'll obtain the deposit back after a year, and any a better card is offered, or the card changes to a regular one. I posted links to several secured cards that may work for you.

716 is a good mark, but which credit reporting agency
do you have the ranking with?

716 on Experian will bring you approved for several
American Express cards if you have definitely NO
bankruptcies surrounded by the past.

American Express have instant approvals on their
website and they seem to use Experian as their source
for credit score. If you do apply for an American Express Clear, Blue Cash, Green, Gold
and not get an instant approval, apply directly for
their Gold Delta Sky miles. And/or apply for HiltonHonors while you are there on the AMEX website.

American Express will one and only 'ding' you once for multiple inquiries in sometime from them on your credit score. (5 points or so).

Finally, jump to financeglobe.net for parallel scores
and credit cards.

yes, you are at or very close to the bottom fringe of the 'excellent' credit level; in that are, of course extenuating circumstances such as how heaps accounts you have very soon and how much of a balance you hold on them
You own a good credit gain. You shouldnt have any problems getting approved for a credit card.

In California can an 9 year mature phone bill effect your credit rating? in that have be no attempt to collect.?

Question:
the phone company has sold this debt to an collection agency .We own had service beside the same company and no attempt to collect have been made contained by 9 years. The phone company and the collection agency both have our address and threaten to report to credit agencies

Answers:
I agree near Chane, send them a SOL dispatch.

There are only a few states where on earth original creditors are bound by the FDCPA and California is one of those states.

If both the productive creditor and the collection agency claimed that they will place it on your reports, then both of them enjoy violated the FDCPA by not only using threats, but surrounded by using the threat of placing it on your reports unless you pay - since they enjoy no legal right to re-age it and place it on your reports after the inspired 7 years has run.

You might click on my profile and click on the final link I hold listed to find a SOL memorandum template
no time limit on this. capture a copy of your credit report and see if it is there.
9years dated? if you have fruitless credit your credit restarts back fresh after 7 years, surrounded by california. Thats how people who wallet for bankruptcy seize back on their foot. It just take awhile.
old debts can be collected for up to ten years from the date they go into collections. After seven years they generally slop off your credit report. Usually though if it is a utility company and you want to return with service with them again you will not be capable of until the old debt is taken prudence of and then a immense deposit may be required as well. Get a copy of your credit report to check for any inaccuracy and you can dispute those. If they are not resolved within 30 days the credit bureau have to remove the unvalidated items.
As long as it is unpaid and out standing, no matter what state you live contained by, it is a negative factor to your credit score. Even if they do not call you to collect the outstanding stability, it remains on the credit score until salaried in full... after you should get a reminder from the collection company or billing company saying it is compensated in full.
Bottom strip is you are responsible to pay bad the debt.
Inform them that it is past the statutes of limitations and the debt can no longer be collected on.

Ask them, contained by writing, to cease and desist adjectives communications. By law, they enjoy to stop contacting you and it is illegal to report the rationalization to the credit bureaus. You are entitled to $1,000 per violation of your federal rights if they verbs to violate them.

If u rate past its sell-by date 2 or ur credit cards how long does it purloin to show on ur credit report and?

Question:
how will it raise ur rack up?

Answers:
I recommend:

1) It usually takes at lowest possible a month if not two for the lender report the symmetry to the credit bureaus.

2) How much your credit score change depends on what stae you were contained by before.

If you have excellent credit, then it will singular change slightly... if at adjectives.

If you had a giant utilization (meaning you were maxing out your cards), consequently you would see the pay down to be more of an impact.

However, if you also have an on-going delinquency (i.e., you're 30 days or more in behind time payments), then you will not see a generous immediate improvment. Whatever you gain by lowering the usage of your credit line will be wipe out by the recent late payments.

In direct to see the real impact, you would hold to give it some time, 6 months to a year, to see the development in credit evaluation. The way FICO mark works is that the negative event will be weigh less the further it is contained by time.

Just Be!
It can take 30 to 90 days for creditors to report, but usually by the winding up of the month. If the major factor for your rack up being low is your balance, your score could stir up significantly, sometimes 60 to 120 points, depending on your balances and what else is owing. If here were other leading factors, resembling late payments affecting your evaluation, the payoffs will have smaller amount impact.
30 to 90 days to come off credit report.

Credit repair business or opening?

Question:
Does anyone here work in credit repair or have a credit repair business, if so are you making money. what's your approach for customers and how do you charge , im curious

Answers:
I am a credit repair specialist. I love it also! We make deeply good money. (There are profusely of people near bad credit!)

I work beside a mortgage broker and realtor. They both have plenty of ancestors who apply for home loans with desperate credit. We get them into our credit repair program and bring them a house within 3-6 months...sometimes sooner. It adjectives depends on the customers unique situation.

We charge anywhere from $570-$750. We own a home ownership guarantee.
I do, and I love it! The money is very virtuous. The best part is when you own someone's credit fixed up and they are able to catch the things they want. I can't think of a better mode of making a living than by helping people. As far as approaching customers the best style is to get referral from the intersection of credit and denial - get referral from car dealerships, realtors, bank, mortgage companies. As far as the charges, it depends on the credit report with my company (average 600.00).
Good luck!

Question in the order of debt?

Question:
My brother was relating me that he did not pay around 15k in cc debt on going on for 3 cards. Now that 7 years past he have good credit. he told me that he be threaten by collectors bad two years ago and sent out correspondence asking them to verify/validate the debt. after he did that never heard from them again. Now those things hold fallen past its sell-by date. Any one have hear of this

Answers:
By law, cynical consumer debt items are removed from one's credit record after seven years from the date of closing activity, commonly the date the last expenditure was made.
It is possible that these items hold fallen stale his credit report. However if they are still unpaid, then they are still valid debts. If the collectors choose to inaugurate reporting the items again, or if they sell them to someone else who reports them, these things may still pop up on his report again.

He did do one smart piece, which is asking them (in writing) to validate the debt. Since you never know if/when a collector might market the account, it's other a good theory to know (in writing) if you truly owe these companies any money.
Yes, it's true bad debt does topple off after 7 years. However, some things don't. Judgments (which way someone tried to sue you for the money), student loans and any tax orient debt. However, keep surrounded by mind that if you pay a costs on the debt, the debt statue of limitations (time they have to collect) starts over. Because he moved out it alone for 7 years, without any communication it fell past its sell-by date. I don't recommend this though. Good credit habit is the passageway to go. I imply turn the tables, would you similar to it if someone borrowed money from you and said they would pay you pay for, but never did because they found a loop hole? Think about it.

Need answers from someone who works near credit?

Question:
I have three different credit cards, adjectives in devout standing, and all next to excellent payment history. A Bank of America Gold card, an American Express Clear, and a Chase Visa. I've have the Bank of America Gold the longest, since sometime around June of 2005 I guess (Bank of America is also the bank I use). It started as a $500 consideration secured card (where you give them $99 to deposit within a safe tale for a year, and they give it final if you do well). I made multiple payments some months...so much that they made it a regular credit card in 10 months instead of 12 and I get the money back precipitate. The bank woman had never see that before. Now I own a $5,000 credit limit on it, and almost no be a foil for. The only drawback is a $29 annual charge. I think this is singular the second time I've paid it (for the month of June) since I've have the card, just to hold on to the history and credit limit going for almost another year.

Answers:
Don't take a Home Depot card just to get hold of a card.

I'd call BofA and ask them to waive their annual duty or you will be closing your account. Start near that and see if you can keep that card and bring back rid of the fee. Otherwise, any card you go and get is pretty much the same as long as you are paying sour the balance respectively month. Some have bread back or frequent flyer mile programs approaching Citibank is tied in near American Airlines, but there are other programs, too.
Tell the mound who wants to charge you the levy that you will close the account if they charge it.
Oh my God! if you be that wordy with a csr I own no doubt that you would be given grief within response. Take a minute to compose yourself, catch up on your breath later ask a simple question.
No you do not involve more cards. It is important to live on change and only hold one or two excellent cards that you use and pay without blemish for emergencies. Pay adjectives of your bills, this includes utilities and rent perfectly and do not apply for more credit, it drags down your credit chalk up.

Drop the one with the annual charge, you can send for them and request it be waived, but that may not finishing. Just keep two beside low balances and flawless payments. Do not ever ask for increases, as they will do it automatically when you pay without blemish.

Put your money in the sandbank and use your debit card if you like using plastic and save a check register as if you were writing checks. This channel to live on your money instead of borrowed money. Good Luck.
Keep the BOA card. It is your oldest and has a useful 'history' that factors into your FICO ranking.

Apply for BOA Signature card and you should be approved no problem with a 752 ranking. Also, find out if you can transfer your history from the secured card over to the unknown BOA Signature credit card without a loss of points.) >>No more $29 annual tax and a lower % apr.

Don't cancel your cards doesn`t matter what you do. You will lose
history by getting rid of tradelines that factor into your FICO scores. Your 752 ranking will be
reduced because you'll be losing your 'POSITIVE' available credit line.

Just hold on to your unwanted card usage at least at a 1-3% utilization. Why? This also factor into your FICO scoring.
No utilization (not using the card) means no positive reporting by the credit card company.
