Credit Questions and Answers

Who do I contact when I know someone is loading up thier credit cards prior to going in receivership?

Question:
I know for a fact that someone I know is maxing out adjectives thier credit sources and then they are going to claim ruin so they don't have to settle any of it back. I requirement to report this person brisk. They are spending like crazy.

Answers:
Yes it is a crime once they wallet. Until then in attendance is nothing wrong(legally) near them doing that.

Now once they file you can report them. The connect below is to the Department of Justice and who you need to report it to. The more information you know the better.
No One to report this too. it is not a crime
and is not fraud because they enjoy not filed.

Rest assured, the trustee of the court mail EVERY creditor the borrower owes and the credit can dispute the spending of the borrower as fraudulent - high hum JUST before file. The trustee can force sanctions on the claimant - zilch serious but they may have to repay a better percentage.
don't worry, lower than the new guidelines for ruin, they won't discharge the debt anymore, they set up payments and make you pay cheque it off over the subsequent several years.
I would call the individuals themsevles.and ask them to buy me something nice...:-)
I'm pretty sure the current bankruptcy law are in effect. A mediate can look at what this person is doing and they can still be repaying something. Every situation I'm sure is different, but this could be a costly bout of irresponsibility.

And knowing this person's behavior to try to defraud the system, in the adjectives, will their credit report show any of this to a lender? Would you give a mortgage loan for $150,000 to a soul who behaves resembling this? Maybe at 15% interest when everyone else is at 7%. Do they want to incur those costs the rest of their life?

Maybe put on alert them to look into this a bit. I doubt it's smart. The big screen is probably going hindmost.
talk to the creditor or christen a lawyer but if you know this creature and they are not using company credit cards or someone else stuff like that. they can do it
It won't work. The liquidation trustee will see this and could deny the bankruptcy petition.

I am pretty sure your credit info. Your address might though. I would ring up Paypal to double check.

I own be summoned to court for a debt. What can I expect never have be surrounded by this situation formerly?

Question:
I don't remember this ,apparently it's from more then 10 years ago. It's not a student loan. Do I enjoy any recourse in this event?

Answers:
If this debt is actually 10 years infirm then you are outside of the Statute of Limitations contained by just something like every type of debt and state. If it is a credit card debt you are outside of it in every state, but other types of debt within are a couple of states that extend out to 10-15 years in some cases.

Your first step is to transport an "answer" to the suit. In your answer do not admit to the debt. All you should do is request validation of the debt. This includes the history on the picture including original contract/agreement as capably as payment history. The most considerable payment date would be the date of concluding delinquency. As this is where the Statute of Limitations starts. You may want to at smallest consult a lawyer contained by forming your repsonse. Most will give you a free short consultation.

You still obligation to go to court, do not only just skip court or a judgement will be entered surrounded by default. When you step to court they must have provided you the date, if the dates are outside of the SOL the regard as being will dismiss the case. If they claim a stipend was made in the last few years where on earth the SOL still applies you will have to prove that you did not breed that payment.

Below is a relation for the Statute of Limitations by state and type of debt.
yes, pay the debt!
you really don't requirement a lawyer because you are pretty much resourcefully already charged the companies like that will save all of the proof you should any pay it or if it is to much and you don't hold great credit file for chapter 7 bankrupcy if you can't do anything or chapter 13 if you want to hold on to everything and make a plan. chapter 13 i would recomend over 7 unless you enjoy nothing.
First, going forward every six months carry a copy of your credit report from the three major credit bureaus to look for errors. Call and request a copy right presently, you may have be a victim of fraud and you do not know it even so.

Now. Call the lawyer’s office for the company that is to say taking you to court. Talk with the advocate assigned to the case. Tell him that this is the first you enjoy heard of this debt. Ask for copies of the bills, since at this point you do not know if they are really your bills. Keep really apposite records, since you are going to stipulation every bit of documentation that you can get. Write down every detail that he or she tell you, and make summary (time and date) of every time you call and start out messages of talk beside someone. You’ll need to write down whom you are going away the message with as okay. Ask the lawyer for annals of calls and packages sent to you, the phone number and address they’ve been contacting you at. If it is your bill, manufacture arrangements to pay the debt, and remuneration it as quickly as possible.

After you’ve remunerated this debt, send the documentation to the credit bureaus and request that it be removed from your store since as soon as you were notify of the debt it was promptly salaried. You may not get the debt removed from your credit reports, but a transcribe can be added to the record.
check the statute of limitations within your state. My state is 5 years after the bill was submitted to collections.
Dont verbs the statute of limitations has expired. All they did is dance to the local court house and pay a $25 charge to file for "sue" they are tring to startle you so that you can settel out of court with them. All you stipulation to do is tell the consider that the statute of limitation have been up and the trendsetter will dismiss the case. to find the statutes read this article http://www.adviceontime.com/credit%20tal...
Robin C is correct in most of her answer..The with the sole purpose thing I would notify you is if the statue of limitations has not run out for you when you do make a settlement arrangement near the lawyer ask for a deletion rotten your record.I get one
Nick,
You are a complete blithering idiot. Don't ever answer a question again. What the hell are you even truism?

Is it sage to convert lenders for a vehicle loan after solitary 5 payments?

Question:
The reason I'm considering it is because the guard I'm paying is out of state, and I have made a couple of belatedly payments, however I wouldn't have if I could own gone to a physical location of the bank to breed the payment. I would usually just set it up to automatically discount from my account, however, due to other circumstances this is unfeasible and there's no way around it.
So I'm a moment ago wondering if switching lenders could hurt my credit, or do some other financial damage that possibly I'm overlooking.

Answers:
Simple answer is yes. You don't pay interest upfront contained by a auto loan. Hopefully the few missed payments wont hurt your credit but depending on the bank and how overdue you were it shouldn't. Refinancing next to good credit will never hurt and you don't recompense interest upfront in auto loan close to you would in home loan. Go for it, try credit union near you for better rates.
surrounded by order to switch you would pinch out a new loan to earnings the first. Shouldn't hurt your credit.
Switching lenders wont hurt your credit as much as the late payments will. Lenders one and only list your compensation history in your credit report, and whether the commentary is active or not. The report WILL roll the payments as late, which will lay waste to your credit rating. If it will prevent this by changing to another lender, next by all finances do so.

Has anyone else have their APR fro Citibank travel through the roof...18- 32.5%?

Question:

Answers:
Once when I was ONE daytime late. I remunerated the card on time for 7 years straight and ONE time I be late and they go from 6.5 to 32.5%

CitiBank is a ripoff company and they will screw you in a heartbeat.

I get a new card and transfered the stability the next year. I will NEVER do business with them again and will form sure to tell everyone how they are ripoffs.
That happen to me a couple of months ago. Went from 3.9% to 33%. I called them up and after making it through the oral communication barrier get them to change it put a bet on.
If you're late on the description, yes, it will go to the non-attendance rate. Normally if you're late twice contained by 12 months billing cycle, it will go to the failure to pay rate.

Sometimes you have to contract with the non-attendance rate and rebuild your clearing history 6 months before the mound lower the rate. But don't give up, call for them first and ask if they can drop down to a reasonable rate.
This happen to me. I was never past due ever. When I called them they said they get my newest credit report and since they reckon I am a risk, they tripled my apr rate. I had read contained by the paper nearly my rights when something like this happen. Call them before you use the card or sort a payment next to the new apr rate, and share them you don't approve of this new rate. They will reverse your card after it is up for renewal, but your apr rate will stay as it was contained by the old bill. If they are going to screw beside you, you don't need their crappy credit card anyway.
Cancel this type of cards and budge for some others. Discover have some cards next to 0% intro apr rates and also some rewards.

Help I necessitate a homeloan! I devise i hold desperate credit!?

Question:
I really need a home loan because my current home is falling apart! I reckon i have discouraging credit! Are there any lenders that will pre approve me? I dont know which home i want however! Can they lend me enough to also buy furniture?

Don't lose hope if you're looking to buy a home. There are so various different ways to fund a home now, of late about anyone near any kind of credit can capture into a home, regardless of credit situation.

Of course, some will cost you more money in the long run, but a home it's still one of the best investments that you can craft, so, in frequent cases, it's worth it, especially for the first year of ownership.

You should shop around, and ask different lenders what kind of programs they hold, and if they can help. Try to find a lender that specializes contained by bad credit mortgages. You can find some discouraging credit mortgage lenders listed on this page on and sour:

http://www.axalda.info/bad-credit-mortga...
You can get a loan, but do a great deal of research. The best loan is a fixed rate loan. You can only bring back the loan for purchasing the home. You can rent to own your home, but make sure it is the home you really want to buy after a year. You clear rent and extra $. The extra $ is put in an sketch for you to use as the down payment. If you don't buy the home, consequently you lose the extra money. This will give you a year to work on your credit. Once a year you can check your credit at www.annualcreditreport.com. If you enjoy no credit or bad credit, next open an checking/saving details. Get a gas, department store card, and pay rotten the balances in good time every month. If your FICO score is to big, then you can still find the loan, but at a higher interest rate. Even so it is worth it to own your home. Keep working on lowering your mark, and then re-finance for a lower rate.
If you own bad credit taking a loan could bring you to lose your home. You should do a lot of research on the subject of what repairs are needed and how your credit is.

Is near any practical plea to request a lower credit card control?

Question:
I just get a credit card. They set the limit at $10,000. I'm sure I'm never going to put more than $2,000 on the card. Should I phone call and have the credit restrict lowered? Why?

Answers:
If you feel more comfortable to get a card with lower issue, you certainly can ring and lower the credit line. It one and only takes smaller quantity than 30 second to lower the credit limit. However, contained by the future, if you necessitate to use the card for more than $2000, then credit card company have to check into your credit report before they can increase the credit stripe.

You're not responsible for any fraudulent charges on the account. Some society are afraid if they loose the card with a highly developed credit line, they'll be responsible.

If you enjoy only one or two credit cards consequently $10.000 is not a whole lot.
Unless you don't trust yourself near that high of a keep a tight rein on there really isn't any practical object to have it lowered. Obviously you own good credit of you wouldn't gain that high shorten. As long as you continue to be prudent near your spending you should never have a problem near your card limit.
I reason that sometimes, too much credit can actually lower your probability of getting a loan. For example, if you have $2000 on your card and you own a $10K limit, a wall will look at that as another potential $8000 in debt you could ensue. If you owe $2000 on a card with a $5000 delineate, then you can merely accumulate $3000 more.

Of course, this is lone one of many factor involved when you apply for a loan. It may not make satisfactory of a difference to change a yes to a no when you apply for a loan.

What are the largest sources that make happen bleak credit?

Question:
why are people "allowed" to verbs bad credit practices...until it is time to buy a home...and they find out they cant get hold of a proper loan anymore?

this would appear to be a systematic problem, not just a issue of personal finances...who is resposible bad credit...?

Answers:
"bleak credit practices" make the credit card companies money! They don't thoroughness if everyone is in debt, their interest lately keeps adding together up and people hold on to making little payments but never paying it off...
In my feelings, having credit surrounded by too many places cause bad credit. It's uncomplicated to use the credit, and hard to money everything off.
Lack of personal responsibility. Instead of working, earn, or saving to seize the things, too many folks want it and want it NOW. They can't distinguish between "wants" and "needs".

Yes, it's method to easy to attain credit cards and there are lots of loan companies selling "creative financing" to folks who can't afford anything they are buying. But it's still individuals who should take responsibility for their own impossible credit.

Personally, I think financial organization should be a required high institution course.
Have seen lots of relatives asking info on bad credits. Well, if you involve to get your problem solved on<!--bad credit, you must know to how to confront it. Of course, Even if you hold bad credit, you can capture loans. Many factors can contribute to someone getting a "doomed to failure credit" rating, among these are non-payment of an vindication or late payments over an extended length of time.

http://badcredits.awardspace.com/...

You may find want you want. You can effortlessly be labelled as a discouraging credit risk by financial companies. This can make it more difficult to-->arrange loans or other nouns, and usually means you will salary more interest on any loan you take out.
doomed to failure credit is caused by

have the ability to owe more than you earn. So if you own a bunch of credit cards (even if the balances are 0) there's still available credit if you considered necessary to use it.

having a history of past due payments

They're probably the biggest causes

Who's responsible ... the human being who applies for a bunch of credit cards and then doesn't clutch care to be responsible for those cards. Yes you can be offered credit till you choke it doesn't connote you have to use it to a condemn. But these days everyone looks for someone else to blame. Credit cards are not free money - it still have to be paid vertebrae plus more - so a great bargain on a credit card could cost you more than you truly saved on that wrangle.

Seen too many friends and family circle fall into these graceful "buys"
No one is responsible for having impossible credit than the card holder themselves. Discipline is the key. Don't buy if you don't hold the money to pay spinal column in a month or two. Some citizens rely on future profits when they're not earning any money at the present time.

It's not credit card companies that rationale problems. It's people who are irresponsible and deficiency of discipline. Not because people selling drugs, doesn't tight-fisted we have to do drugs.

As someone mentioned, financial responsibility should be qualified in soaring school. I hold lots of people calling me and asking how to use the credit card. I thought it's only common sense. You use it, you compensate when the bill comes but there are some inhabitants still don't understand how credit cards work and how to foot their bills..
the one thing is not paying bills on the dot

Shared Loan Info..?

Question:
If I get a loan next to my BF for $1500 and I have great credit is credit isnt, will my credit grow as we pay packet on it, or will it go down without beating about the bush because im taking on his low rate. He is good for the 1500 but im discussion about surrounded by terms of my credit rate beside me being the primary holder. Once its remunerated off, will my credit be better than previously , or not as better because of his credit?

Answers:
Very, very bleak idea to co-sign a loan next to your boyfriend. Your boyfriend got desperate credit by not paying his debts on time. Chances are you're going to draw from stuck paying off the loan adjectives by yourself. But not till your boyfriend has made tardy payments which will trash YOUR credit.
Better speak to the place where you get the loan

Should i close this reason, or suck it up and foot the $60 twelve-monthly excise?

Question:
I made the mistake of trusting the operator when they said in that was 'no annual fee' for the card i applied for. When i get it in the letters, i didnt even think to double check, and go out and used it right away.

A month later, a $60 per annum fee be applied to my account. I call & complained, and they lowered it to "$25 for the first year"

I dont want to have a card beside a yearly allowance, thats a waste of money. So what should i do? Call & complain again almost the yearly allowance? Close the account? Has anyone be able to convince the credit card companies to waive a once a year fee for you? Thanks

Answers:
Mastercard did that to me - however I didn't even apply for the card. When I call and complained about the annual allowance bill I got they said they would trim down it. When I said I just considered necessary to close the account they now gave me to a supervisor who probably would have given me his first born if I have actually needed the stupid card (I'm Visa 100%), but he finally gave contained by and let me close it.
So, I would christen and tell them the woman you spoke to offered you a "no annual fee" and you accepted on those lingo. Tell them you want that honored or you would like to close the picture.
Good luck !
Yes. Just call and read out "Hi, (Gary, or who ever answers) I'm mad and I want to close my description immediately." Of course they will ask why. Say, "I don't even want to reimburse a dollar for an annual fee. I don't want to reward anything." They should say, hold on one minute and I'll see what I can do. Do anything to formulate it sound that you can't enjoy your mind changed. Works for me. If I ever have deferred charges on a bill, I get them taken past its sell-by date, annual fees are a bit harder but it works. Remember, no small talk, be straight to the point.
I say-so if your not happy near it and they will not drop it, than dump it!
They might waive it for one year if you complain enough but that's it.

There are so heaps cards with no annual excise that you don't need this card. First gain a new card and after cancel the out-of-date one.

It's always best to read back you sign as you can't really hold someone on the phone responsible unless you want to fight a court combat. Plus the cancellation will make higher a flag on your credit report. However, it's best to get it over beside now.
I would contest it. They told you in attendance was no annual levy. Find out who to talk to contained by the company and explain this to them. Be persistent. And yes, let somebody know them you'll cancel.
I would close the picture. I agree with you, a once a year fee is ridiculous! Even if they waive it --don't use them. They lied to you!
yes thay will waiv it. its adjectives a matter of how unpromising you want to work for it. Tell them you where told thier would not be a tax and thats what you want or your closing the account. when on the phone beside them, a good instrument to think just about it is whenever thay say "cant" it meens "wont". When i worked for a credit restoration Co. i used to draw from annual fees nocked of as well as removal of current ballences(not huge amounts) for people adjectives the time.
There are plenty of credit cards that won't charge an annual fee - close down your current picture and open one lacking an annual fee.

I'd also contact your current credit card company and ask them to waive this year's annual levy, since you were mislead into believing at hand would be no fee. They absolutely have the wherewithal to waive the fee for you, it's really basically a matter of will they be of a mind. You never know, they may accomodate you - it's definitely worth asking.

Cash Call keep calling me they enjoy the wrong number.?

Question:
I purchased a new cell phone Saturday, and that hours of darkness started receiving call and messages from someone, I on Monday told the person calling they have the wrong number, they called again, I call back tues, and spoke to them, they call an hour later,
This morning call again, I returned the call and told them again it be a cell phone to stop calling me, he said it was a home phone and would appropriate the number off the account, they just call again, I looked them up and they are a preditatory loan company and call populace up to 20 times a day. I am bothered by these call at work, and just bothered by them, Is in attendance a action I can embezzle? I live in Ohio.

Answers:
Call you phone provider & ask them how you can report this company. If you let somebody know a company NO don't call they can not harrass you. There are #'s to name to block telemarketing even on a cell phone. Your provider s/be able to lend a hand with this.
Tell them if they telephone call again you will report them, then block their number!
lately call ur phone company and block their #
give the name them and let them know whats going on and that they own the wrong person.. or bring back a new number
Go to donotcall.gov You can capture on a do not call detail and learn the how to get hold of them to stop calling you. I was getting equal phone calls and I told the relations I looked up donotcall.gov, and that what they were doing be illegal. I enjoy not received one call from them since.
Contact the cell phone company and see if there's a mode to block the number. Or if that isn't possible, ask for a new phone number.

Collectors tend not to believe that you in recent times got the number or the individual doesn't live there. Folks who don't income their bills tend to lie.
Those kind of collections people are relentless and regardless of what they say-so, they don't believe you that you're not this person they're looking for. They in recent times think you're trying to dodge them.

Call the cell phone company and complain give or take a few the harassing calls. They may know how to give you proof that you are who you vote you are, and that you just lately got your cell phone and number. You can dispatch this to the collection people so they will depart from you alone.

Or, the cell phone people may be capable of block the number.

Or, finally, you can ask the cell phone people to tender you a different number.

I used to regularly get call from some Spanish speaking woman who would keep asking for "Mario". She didn't read any English and I know about 4 Spanish words. I kept relating her "no Mario" and stuff, but she would call again subsequently or the next hours of daylight asking for him. Finally, she called one darkness and my Spanish-speaking girlfriend was over, so I have her explain to this woman that she was calling the wrong number. She said okay. Then 2 months latter, she starts calling me again, wasting my minutes. ARGH!

What happen if you charge more than your credit ceiling?

Question:
I have a BB&T credit card near a $500 limit. I charged a Dell computer on it closing night, which cost around $550. The order go through and everything, but I'm not sure what to expect. I'm trying to contact the bank. What will come to pass? Will Dell be gracious and just charge me twice, after I've rewarded the initial $500? Do I do jail time? Are they gonna draw from me? WHAT

Answers:
The credit card company don't want you in intern, they just want your money.

BB&T will most predictable chare you an 'over the limit' fee. I'd telephone call the number on the back of the card, speak to customer service, and see if they'll put on a pedestal your limit (and possibly pinch off the cost for going over the limit).

It never hurts to ask.
No they let you budge over. Likely today if you used it it wouldn't work and the interest rate will be high -

I enjoy a business card and charged over the limit to get hold of an order surrounded by - and it worked.
But the bill to pay be ouch, hot and you can't use the card again until it's under $500.
You will be charged an astronomical excise, maybe as soaring as $35 for going over limit. They will probably tilt the interest rate that you are paying. And it will have a glum impact on your credit score. I would verbs to try to contact the bank and see if you can distribute a check immediately for the difference and if they will white horses the over the limit payment. Explain that it was a mistake and see if you can smooth things over.
u will receive a fee
Since the credit card company approved the transaction, you're covered next to Dell. They'll never be the wiser.

BUT your credit card company will charge you an "over-limit fee", which is typically anywhere between $30 and $50. They'll do that any month in which your be a foil for is greater than your credit limit.

Can and how do you negotiate near a credit card company for a lower interest rate?

Question:
My husband has an details with Dell that have around $900 left to clear on it. We pay around $100 respectively month on it, always prompt and thats well over the minimum. At the time he open the account, his credit be, well, smaller quantity than desirable to say the smallest and they gave him an interest rate of around 18%.

Since passage the account a few years ago, he have made drastic improvements to his credit (to the point we qualified to buy a house). I was wondering if it is possible to carry the company to lower his interest rate considering things are a lot better and he have paid them more than the minimum and other been in good time with them. The 18% is slaughter most of the payments we are making, and it sure would be nice to get rid of this bill once and for adjectives!

What approach should we take? Thanks!

Answers:
One entity to consider is a balance verbs onto a lower interest credit card, or you can try to call them and a short time ago ask them to lower the rate, you'll probably have to argue somewhat bit, and keep asking for a superviser if the party you are talking to tell you "no". I did this once, and it was frustrating, but worth it, Just stand your ground, and save asking for a
superviser until you get the answer you want. Hope this help.
You call them up and ask, but surrounded by Dell's case, I doubt they will do a entry. You could try to transfer the stability to a lower rate card.
Call up and ask. But 16% is about par for the course in our time, and you may not get much. If you are paying $100 a month on a $900 go together, you'll be done in smaller number than a year in any armour, so I don't see it as a big issue -- the finance charges are merely about $15 a month, and will be decreasing.
I've done this several times over the years.

First, freshly call up and ask to enjoy your rate reduced. Feel free to mention the need to cut expenses due to the house purchase.

I've gotten 19% and 29% cards cut down to single digit percentage just by making the phone call. Having, or claiming to have, a go together transfer extend in your appendage will give you more leverage.
I have a Dell account next to about $1000 financed and I salaried at least $100 a month on it and after a year I still owed over $500. I contacted Dell and they said that they do not refinance. So I used my Capital One card to settle it off because the interest is much lower.
Generally speaking, credit cards from a hard to please company (ie Macy's, Lord & Taylor, Lowe's, Home Depot) are pretty much fixed and rather sophisticated than bank cards (Visa, Master Card, Discover). I know next to the banks, if you've be paying on time, for a secure length of time and a certain percent over the minimum, you can speak next to someone in customer service and endow with him/her the reasons: 1. paying in good time 2. _ % over the minimum payment every time 3. credit history have improved. I won't vote that this will guarantee you a lower rate, but it's worth trying since every company or bank is different. It's only just a matter of what their rules are at the time.

If they do not, you'll only have to hold paying until you pay it bad. Part of what makes a obedient credit score is paying a long possession loan off on the dot. With credit cards, you need to preserve those at a minimum - a balance of no more than 10% of your credit mark out. I hope this helps.

Good Luck as I know how you perceive.
Sadly, the answer is no! Credit companies will never reduce their fixed interest rate once it is agreed. However, Credit Cards work differently as they are flexible. As the remains interest rate (fixed by Government) increases, the credit card charges increase but when base interest rates fall, the credit card companies will take a long time to mute their rates thus boosting their profits. The only possible process to avoid paying interest is if you are in serious debt, you can request that they freeze the interest. If they prohibit, you can apply to the courts to have the debt frozen, no further interest can be added after that date. If contained by financial difficulty, you can also offer to money 50% to 70% of the money owed as final settlement and the company will be highly predictable to accept to some extent than risk getting nothing if you are declared penniless. In your case, as you are solvent, you enjoy NO CHANCE! You have to payment what was agreed. However, as it's simply $900, ask your bank for a small loan, wages DELL off next to it and try to pay the sandbank $200 per month. You will be clear of that debt in smaller amount than 6 months. In future, don't touch DELL. Their PCs are crap and built next to both substandard and obsolete parts and as you own now see, not only are the PCs a rip sour, their finance is too.
I do not assume Dell will do this.
Have you gone to Experian.com to see what you credit rating is?
If it is now flawless you might look into another card that will let you verbs the balance at a much lower rate. Make sure you do not own to make approaching 2 purchases a month to maintain this as some require it. Check on dash to see what other cards are offering. You don't need to bestow them any info to do this. I recently get a super deal from Advanta but consequently we have excellent credit. But you s/be competent to find something around 3 to 9% I would think. If you hold other balances and own a home would it take-home pay you to do a equity loan/ refinance at a low rate making sure your payments do not exceed what you now reimburse on your cards & house? There are lots of possibilities here.
If you can cancell this card immediately. When in that are cards with 0% intro apr rate next to so many rewar programs afterwards why are you going for this card.
