I hope this is within the UK, as in the UK your speaking agreement is deemed a contract. If you can afford to open a good account, why not ring the collection agency and make arrangement to recompense them back?. This debt will not shift away until it gets rewarded.

They may not be able to bring money out of your account but they can lug you to court for the money you owed. When the judge finds out you hold money in your positive, he/she'll tell you to run the money out and pay the collection agency anyway.

If you own a home, they can put a lien on it. No business what you try to do, they will get their money somehow. Everyone rewarded their credit card bills, why can't you?

Collection agents can not directly embezzle money out of your account or garnishing your wages. They must first go to court, draw from a judgment, and find a court order to do that.

For starters.relax. Take a deep breath.

Do you enjoy anything in writing from these folks? Or be everything verbal? From this point on, do NOT have a word to them. If they call inform them to write you a epistle and don't call again.

I would look into the legitimate aspect of this. If you have not be receiving notice to try to collect this money for 12 yrs, I would think in attendance is some kind of statute of limitations on collecting this money. And dont be intimitated by that legal representative...INTIMIDATION is his job!
I suppose you may need to ask an attorney this examine (I doubt if he/she will answer for free), but I do know that there is a 7 year constrict for bad debts to show up on a credit report and a 10 year restraint for bankruptcies. There may also be a statute of limitations on the time someone can collect on a debt that have been languish for 12 years.

It sounds more like a collections agency is grab at straws and reverting to illegal vehicle to collect a long over due debt. This one would be worth fighting over. If nought else for the principle involved. The credit card company would not hold onto a debt this long and would have written it past its sell-by date on their taxes as a loss. Why it would resurface after 12 years can only be answered by a collection agency who found it and have decided to hound you over it. You can also run to the FTC website and see if there is any information at hand that will guide you. You might also be able to wallet a complaint with them concerning this company. But like I said, it most promising isn't coming from the bank that you have the credit card with, it's coming from a collection agency that is to say trying to scare you into paying.

Yes, below the law you can request a free copy of your credit report from respectively of the 3 major credit bureaus (Equifax, TransUnion, and Experian) once respectively year. You can also request a copy of your consumer report from ChexSystems (free if you have be denied an account inwardly the past 60 days, otherwise the cost is $8.00). I own included the links below.
