In chapter 7 you must include every portrayal you have when you folder, but you can reaffirm on any accounts you want to keep by simply signing a reaffirmation agreement.

If you turn this route be sure and call every lender that you reaffirm next to and make sure that they verbs to report to the bureaus.

Once you file liquidation your creditors automatically stop reporting to the credit bureaus even if you reaffirm with them, so be sure and christen.

This is the only opening that keeping existing accounts will help you re-establish your credit.

If $3000 cr card debt is chargd bad &consequently sold 2 a collector &they sue you, how does this affect your credit?

Question:
What will it show as?
How long will it show?
Any other info from experience with this type of situation?

Answers:
You are going to pilfer three hits on your credit.

First the credit card company will report it as "Charged off". A accounting term that simply channel that they have given up on collecting the debt. Not that you don't still owe it.

Second the collection hum will show in the public store section of your credit report.

Third the taste will also show in the public documents section of your credit report.

So for this one debt you are going to catch dinged at least 3 times and enjoy a hard time getting any other type of loan minus large down payments, fees and State maximum interest rates.

As far as how long it will show on your credit. Each item will show for 7 years from the date of end delinquency.

O.B.T.W. once they get the sensitivity, they can attach your bank accounts, trimmings your wages (if your State allows it) and file liens on any other property you may enjoy like cars, boats, lands and homes.
First it will show the credit card company charging it off. Not so Good.

Then it will show the Collection Company Collecting it. Not so pious.

Then it will show the Judgement that you get when it go to court and you Lose. Not so good any.

You will get hit 3 times, they will be on your credit report for 7 years unless you can work out a buy and sell to pay it and hold them remove the bad information.
Well I have a lot of credit cards return with charged off over a year ago and the balance ranged from 5,000.00 to 300.00. It hurts your credit bleak but I have not be sued by any of them. I just maintain getting letters for settlements and I preserve tearing them up and throwing them away.( Mind you, unless I win the lottery here is no way to wage them off) You need to opt how important your credit is to you and hold a step fast if you wanna fix this. Maybe you can capture a co-signer for a loan to pay this one bad and save what credit you still own and start re-building. good luck!
It will show from imaginative debtor, then the credit agency it be sold to then the judgement and consequently it may even be sold to another credit agency and then another agency. Its call re-aging the debt.
it's bad. remarkably bad and will show really poorly on your credit.
IF you even can get approved for a loan, they will gouge you next to a very soaring interest rate.

your best bet.pay it bad...somehow.talk to the collections ethnic group and work out a payment plan, or reach a deal to a debt counselor and try to get some give a hand.

it will be on there for 5-7 years, i believe.

cart care.

I'm person sued by debt collector. What will ensue?

Question:
I don't have the money. Should I progress bankrupt? Are in that any upsides to bankruptcy?
What will begin in court? Will they trimmings my wages?
How long will it stay on my credit report?
Will I go to lock away if I don't have anything to administer them?

Answers:
One are you sure you are being sued. Were you in actual fact served?

Make sure that is the defence. Many collection agencies, use that as a threat and send note looking like a suit or come from their "officially recognized department".

If so, then you can still trade name a deal near them outside of court. Yes, you can file BK and put the debt surrounded by BK. Usually you have to very soon have x dollar amount to report BK and in some courts they craft (your payment plan) payment majority of the debt back.
They can gain 25% of your pay check. Go t o court and ask the court to decline the fee becasue you can single afford 50 bucks a month. They will work with you. Go out of business only if you own tons of bill and will receive sued again.

They can not take you to send down!
They're suing you? For how much? That seems awfully excessive. Are they going to try to gain a judgement? If so, they can certainly accessories wages and state tax returns. Which, upon acceptance a judgement, they certainly WILL DO. Have you have a dialogue with this company roughly speaking your financial capabilities?

My best proposal to you would be a debt consolidation loan (you need not enjoy good credit)- a private company will essentailly buy your debt and afterwards you can pay them (usually at a lower interest rate). Don't consent to this debt collector take you to court!

You will not be put within jail - don't verbs about that. You could affirm bankruptcy, but that requires a cost/benefit analysis - which I could lend a hand you with. If you own $100,000 in debt and are surrounded by danger of losing your home, motor, and livelihood because of the debt - bankruptcy is near to protect you. If you have $5,000 surrounded by debt and just can't rather afford to pay it stale right now - don't affirm! There are multiples ways to handle it.

A shrewdness stays on your credit for up to 10 years but usually 7.
The upside to bankruptcy is it is an automatic stay of excution for any decree suits or judgments. Also you bring back your unsecured debt wiped out so to be exact a positive.

If you allow the lawsuit to continue unabated they will out of harm`s way a judgment against you and expected start garnishing your wages 25%...so you need to fixed if you can afford that or if you would rather trash what is disappeared of your credit (honestly not much is left at this point).

why within the world would you want it to show up as bad credit. Lord man, be grateful it doesn't. The reaason that it is not showing is that NOT adjectives places report anything to a credit bureau. It is their perogative if they wish to report it. Whether angelic or bad. Question:
Which one do you have...? and which one do you suggest for us associates trying to fix our credit?

Answers:
It really depends on how bad your credit is. I enjoy a bankruptcy on my credit and so my credit is really doomed to failure. I have an Orchard Bank card (as does my hubby). His card is a $500 aim with a $5/month excise to have the card, mine is a $300 restriction with a $39/year charge to hold the card. I also have a Tribute Mastercard and that have a $150 application fee and a $29 annual allowance...so it was much easier to obtain, but a lot up front...it be worth it to me to get a card to renovate my credit.
There are many choices. Get one that doesn't want an annual tax. There are lots of choices at this site

Death and debt?

Question:
My mother passed away and left down a 16,000 credit card debt. Who is responsible for paying this debt? Does it die as well. My mother be a house wife...my father works out of the country and any estates are in a house trust. I keep reading things more or less creditors collecting from the estate but if the estate is in a trust, can they still step after the money??

Answers:
Yes and they should
yes thy can sorry
yes if it is a community property state.
email bud hibbs
www.budhibbs.com
Very good examine!!
I suggest since everything is in a house trust, you should contact you family attorney .The debts may incredibly well be avoided, or possibly even settled < 100%. The attorney could answer these and other question you may have.
Yes, if the estate is within a trust they creditors can collect from it...the trust only protects against inheratance taxes.
Assuming your father and mother be still married, the debt is part of your father debt now.

However, if they be divorced, then the debt falls to the estate.

They can jump after the money and at the very most minuscule place a lien on the Trust -- they get remunerated before you acquire anything.

You probably want to speak to a Probate attorney if she has any true helpfulness in her estate.
If it is surrounded by a trust they cannot get at it, but they will try.
I dream up this may help you pretty a bit. I read this a week ago.

How to stop Debt collectors?

Question:
For one debt I owe approx 500$, last month I sent contained by 500$ wich was partly my balance. I still enjoy no income, and have told them that. What bothers me is the week after I sent surrounded by the 500 they called me rear asking me to send contained by more. I said I cant. Then I was asked how I come up with the 500 i sent contained by, I told them I borrowed it. They asked me to borrow more from someone, I said "how about you, will you loan me 500" to my suprise he said no..

anyhow he keep aking how I come up with money to drink pay cell phone etc..etc.. fnally i win annoyed my him and say "the tooth carry paid my phone bill" and "a leprechaun leaves me lately enough gold ingots to pay for food".

I recount him to stop harassing me by phone and only contact me by messages. he says he have the right by law to bid me by phone.. By reading over the Fair Debt Collection Practices Act i believe i do have the right to recount him to stop calling..

Answers:
You need to come up near a plan to pay this rear. They generally will acquire off your hindmost if you have a plan that they can work next to. For example, if you can work in your neighborhood mowing lawns every weekend at $10 per grass, and do 10 lawns -- that wll be $100 per week. Take out expenses of gas and food for the day, and you can dispatch them $75 per week. You will have the debt rewarded back contained by 10 weeks, with interest, and later they can stop calling you.

As to the Fair Debt Collection Practices -- you can force them to stop calling you, and they can take you to court for not paying your debt. If you don't want a judgement, clear appropriate arrangements to pay fund the debt.

Then work through it and complete the steps you proposed.

Much as we want to complain about debt collectors, they are solely doing their job. Most would to some extent not have to contribute you a call a second time. If you breed arrangements and KEEP them, they won't usually bother them.
He can call you, but you can speak about him when and where. Don't convey them any more money unless it's to settle the debt, and then enjoy the deal contained by writing.
Yes you do have that right. Put it contained by writing that you should only be contacted by e-mail. Also as long as you send them $5.00 a month and they brass the check, there is zilch they can do to you because you are trying to pay your bill and they official the payment. It's none of their business how you pay packet for anything and you can tell them that too!!
Next time make clear to him you will contact your lawyer if he continues to harrass you and stress the word "harassment" to him.
I believe you are right. If you ask them to stop calling you after they have to stop calling you. You read the Fair Debt Collection Act so a moment ago let them know according to this I enjoy asked you to stop calling me and you need to stop. If you verbs to call me I will own no choice but to report you. I don't know something along those lines.
in Ohio he would enjoy broke the law calling you turn him surrounded by tho the state attorney general department and stop talking to him turn him contained by now
distribute them a letter certified re tun getting requested and ask them to stop calling you make copies of everything you convey tell to contact you by correspondence only at smallest that way you hold a paper trail and not a he said she said sort of article. You do have rights lower than the FDCPA.
pay them
Under the Fair Debt Collection Practices Act, you do own the right to tell them to stop. However, it must be within writing. You can send a 'Cease & Desist' communication by certified mail, that should hang on to them quiet. Once they receive this note they cannot call you or they will be within violation of the FDCPA.
They can singular contact you if they decide to stop midstream further collection activity or if they may or are going to bring further action. Just be aware, that while this is obedient to keep them from harrassing you, you could be forcing their paw to seek decriminalized remedy.
For now, newly pay the best you can and don't bother next to anything else.
You can stop a debt collector from contacting you by writing a letter to the collector recounting them to stop. Once the collector receives your notification, they may not contact you again except to say in that will be no further contact or to notify you that the debt collector or the creditor intends to take some specific performance. Please note, however, that sending such a communication to a collector does not make the debt stir away if you actually owe it. You could still be sued by the debt collector or your resourceful creditor.
If the debt collector violated the law, you can wallet a case against them surrounded by the state or federal court within a year from sunshine the law be breached. You can get the compensation for the damages you suffered as in good health as extra amount till $1,000. You can also be awarded the court costs as well as lawyer’s fees. You can also sign up a group and get damages till $500,000 or 1% of the network worth of the collector whichever is lower. You can contact the state Attorney General's office and the Federal Trade Commission for reporting any problems you may hold with the debt collector. They can inform you around your rights under the debt collection regulation of the state.
Get valuable tips on debt from http://moneymentor.cashmatter.info... . It's a totally useful website.
They do enjoy the right to call you, but they can not, by regulation, call you at a number which you enjoy informed them you cannot or are not allowed to receive call at. If you tell them not to christen you at a certain number, you MUST provide them near a number you can be reached at.

Your sarcasm toward these collectors will solely fuel their fire and they could end up contacting the creditor axiom you are uncooperative and advise them of their rights to report suit against you.

You can stop the calls by writing to them beside a payment plan, stating your valid misery, telling them how much and when you will know how to pay, and STICKING to that plan. They consequently have 30 days to any reject or deny your offer. If they deny you, they will write fund with another submission, but *do everything in writing*.

Use your guest id and agree to the machine pick up the phone call. If they leave anything on your answering domestic device beyond their name and phone number, they are within violation of the FDCPA for third bash disclosure, which can be upheld by you in court should it budge that far.
He has a right by ruling to contact you. But you also have the right for him to stop calling you!. Just simply communication the agency a letter preferbly by registered messages with returned acceptance. And state in the reminder for him to stop calling you by telephone. After he receive the letter he cannot with authorization contact you by telephone. You shoud refer to the Federal Trade Commission network site or you state attorney generals website for a list of unlawful debt collecting practices!

Does this suggest quiting??

Question:
Ok i worked in a department that lately closed and im trying to get my severance because i was layed bad. Now i was offered a position within an other department but, i am not able to work these hours. So i have no choice but to be unemployed. Well the company very soon does stated to unemployment that i quit when i did not I have no choice. By me not taking the the offer does that tight-fisted im not able to collect because specifically considered quitting?

Answers:
I think it depends on the law of your state. I thought I read somewhere that if they change the hours on you that you are not competent to work then they still technically fired you. I *thought* I read something along those lines somewhere but you may of late have to look into it for yourself. Try resembling a search for severance + your state. You will come across something.
Since you were offered another dept. it probably is considered quitting. They may enjoy known surrounded by advance that those hours would not work for you, so to hang on to from firing you they forced you to quit. But if you are seeking employment with flexible hours I hold something you might be interested in.
The best track to find this information, is to look at EDD's website.

They differ from state to state.

If you are in CA

http://www.edd.ca.gov/

I would also articulate to your unemployement agent. If the department has closed, I would feel that there something you can do. Did you verbalize to the other department about the hours. If you don't show up or your delayed, then they HAVE to fire you, which you afterwards can get laying-off.

I assume this is a mid size company, so that they don't have to take-home pay unemployment.

Hope that help!
Yes...if you are called stern from a layoff (which you were) and you turn down the position offered you quit. You will not be able to collect severance, because you turned down the job. You obligation to show legitimate proof that you have no possible way to work the hours offered to you, but still it be a choice to turn the job down, and dismissal only pays folks who lost their job due to circumstances they could not controll.
Sorry, they offered you a position and you turned it down.

No job loss for you.
