Can a creditor report neg info for 7 years & later market it to a collection agency & the 7 years start over?

I was going fund thru some of my old credit reports to resolve some issues next to my newest one.....I saw that I have a bad debt let's enunciate with "Acme Loans" - The unequivocal date was August 1997 & they continued to report until 2003 where on earth it was after sold to a collection agency - their open date is 08/2003 - Can I own the credit bureau's delete the collection agency since the original debt begin reporting in 1997? Also have another one where the artistic debt was 02/1998, consequently sold to a collection agency & their open date be 8/2000 should have fall off this year....but they later sold to another collection agency in 2005 & their clear date is now 9/2005? Can they do that??

Answers:
The clear date with the inventive creditor means nought. You need to know when the date of final activity be (DOLA) with the productive creditor, before the information was charged bad and sold.
The original creditor should enjoy it listed on your reports.

If you are unsure of when the actual date is, dispatch a letter (not a dispute) to the the credit reporting agency's and request - the date of first delinquency on the productive creditor accounts.

There are many things that an inspired creditor and a collection agency (or junk debt buyer) cannot place on your reports.

A few examples:

If the orginal creditor charged stale the account and sold it, they call for to report a zero match.

The collection agency cannot show - a past due, unequivocal account or claim they are a factoring company.

And the register goes on and on.

I would suggest doing some research. You might want to read the FCRA and the FDCPA. Which are natural to find through a search. But are immensely long reads.

One other place you might check out is the association that I am providing. There is a great deal of well brought-up information on that site.
It is a self credit repair site. You can research the info on there and/or ask question with the empire who have be through this before.

Other Answers:
No they can't. Check out the FCRA website. It is against the directive and let tham know that. You could sue them for it.

I am not totally certain, but I suppose you can dispute having a relationship near the new company.

The debt, regardless who have it, has a 7 year natural life.

Except for foreclosures, school loans, ruin (maybe something else), debt stay for 7 years. Bush just changed the rules for liquidation.

You may want to call a couple of collapse attorneys for the "debt rules."

Here's some network sites that came up when I G00GLEd it. My sister-in-law is have this problem right now, not sure what she's doing around it but maybe one of these sites would be productive.
seattlepi.nwsource.com/local/1...

www.wcpo.com/external/dwym/16a...

www.ufs-debtmanagement.com/old...

Good Luck, Don't pay the debt and don't contact them any if it's over 7 years old they shouldn't be collecting for it.

You can only find the marks removed if the statute of limitations have completely expired. That changes within every state, but the big thing is: it have to be x-years from the last time you made a gift or promised to make a compensation. 6 years and 364 days after the statute has expired is the ending day that the holder of the debt can mark off your report without you have the ability to own it instantly removed if you see it and can prove that these conditions have be met to the satisfaction of the credit bureau. NO THEY CANNOT. IT IS AGAINST THE LAW. I AM DEALING WITH A COMPANY RIGHT NOW WHO IS DOING THE SAME THING. THE CREDIT CARD COMPANIES HAVE TO RIGHT THE DEBT OFF WITHIN 180 DAYS OF YOUR LAST PAYMENT. THIS WOULD BE THE DATE OF LAST ACTIVITY. SO SEVEN YEARS WOULD START FROM THAT DATE.

Have a couple of items on my report for credit cards I never requested or received ...?

Do I need to contact the company to request a copy of my signature showing I applied for them? Will they provide this to me?

Answers:
Are they inquiries or actual reports of credit. Credit accounts get hold of sold constantly so you may be looking at an account that you did enjoy, but that was sold. If they're inquiries, you'll see various of those. Creditors routinely make permitted inquiries into your credit in charge to market to you.

Contact the creditor programmed and ask them to send to you, surrounded by writing, a detail of the account -- when it be opened, the credit vein, a statement of charges and credits, etc. If they can't provide this to you, you can ask them to remove it from your report. Is the pay history perfect? It may even be someone else's that was accidentally reported on your commentary (a SS# that is similar or dub, etc). It's worth looking into.

Other Answers:
credit card and insurances companies can check your credit whenever they want unless you opt-out. ( you can do this online with the 3 highest reporting companies)

If the credit cards are indeed tabled as being within your name, you necessitate to dispute them and possibly put a fraud alert on your credit report. You should also think more or less identity theft.

Ask the companys and inform them more or less this situation. More often than not, they should cooperate, lest they capture bad PR.
However, if they aren't liable to cooperate, try these ideas:
Contact your credit card company and consent to them know about your concerns roughly speaking this possible fraud. Most card companies have departments which give a hand research about fraudulent purchases, and they should know how to assist you.
There is also the better business bureau, who look into businesses which give poor service or criminal events.
If these things have be bought without your knowhow, but with your information, your identity might enjoy been stolen.
If you ruminate this is the case, contact your financial agents and possible decree enforcement for help.

First and foremost contact the credit bureau and dispute the accounts. Let them know that you may be a victim of identity pocketing. Then contact the company and make sure they are not yours. They may be third bash company's trying to collect for an old debt on another card. If that is to say the case carry their info and send a call a halt and desist letter describing them to stop any checks of your credit and remove themselves from your report because you intend to work with the ingenious creditors only. I hold a company claiming we owe money that we never owed and they keep refuse to give me written proof. those companies will be difficult. I have a fraud alert placed on that part of my report. I hope this help. Good luck Of course you should contact and state that you didn't apply an that you don't have their credit card-unless you want to payment for charges you are not making-I'm sure the company by law have to provide you with what proof they own that you applied and that they sent you the card. If charges have be made there should be charge slips. I'd do his right away for time within your case is money.

Is going over your credit shorten basically as bleak as making a past due settlement?

I always rate my husband and my credit card payments on time. However, because both are close to the credit aim, a few times they have gone over the control by a little bit because of the monthly nouns charges. Does this hurt your credit score as much as making a tardy payment? My husband doesn't give the impression of being to think so, but I DO. We merely tried to get a loan and they said we have "deliquent payments", however, we have never have a late allowance, just gone over the reduce. Is it the same article in creditors eyes??

Answers:
Not other. Many credit cards, if you have little or no go together and push the limit on RARE occasion for extraordinary purchases, will use that as an excuse to increase your limit.

But within your case, it sounds resembling this happens more frequently, and near the speed of modern financial transactions, being a light of day late hurts of late as much as being a week belated, or skipping a month entirely.

Used to be that you could write a check on Sunday, mail it on Monday, and it wouldn't clear the wall until Friday (at the earliest), or the following Monday. Now, if they get the check tardy on Wednesday, it clears your bank Thursday morning. Can't "float" checks any longer. And beside more folks paying their entire balances respectively month, the banks are getting to be TRUE pricks about behind payments -- used to be if my payment be due Tuesday, and the check arrived Wednesday morning, they'd forgive the finance charges. Not so any more -- they want the interest money and screw the card user.

I recommend, if at adjectives possible, that you start reducing your credit card use to bring those balances down as soon as possible.

Other Answers:
Curious what you're paying your husband for. Thinking everything roughly him should be free being that he is your husband...... hmmmm.........
I dont regard as so, you might want to get a copy of your credit report. Sometimes in attendance is a bill you didnt know about that get put on your credit.
The delinquent payments may have come from the cards themselves - if you exceed your mark out, whoever you were trying to rate didn't get remunerated.

So, IF you can be responsible, request a credit line increase, and ASK your representative what's what more or less THEIR policy and what gets reported to the credit bureau. Also, and I know it's scratchy, read the TERMS & CONDITIONS on your card - you have more rights than you chew over!
Go to www.annualcreditreport.com . Go to one of three reporting agencies and look for yourself how everything you do affects your credit score. You receive 3 free credit reports from the government a year - through this website (this is not a scam progress look at the website). You can pay around 6.95 to see your actual evaluation which is like 500-900 inventory and then they relate you what certain things you hold done or are doing that affect your score.
No, going over the inhibit is not specifically marked on your credit report. It might show something resembling "1000 limit, 1050 current balance" but will never be distinct.
Making a late salary is MUCH worse.

If your report shows "delinquent payments," then it will not be your credit card within that situation (if you've made all your payments on time). Delinquent payments are ones that own gone to collection agencies. Perhaps an old Dr bill that you haven't remunerated or an old phone bill.

Your best bet, obviously, is to spend the $35 and get a 3-in-1 credit report which will show you everything, including what is helping and what is hurting your report and score.
Yes, it does hurt your score to stir over the limit... and your chalk up is probably not great to begin beside if your that close to the limit! I own no credit card dept but when I went to buy a car- my evaluation was just meduim because they weighed contained by college loans, morgage and other depts you don't always focus about.
I would sit down and reach a deal to a finical adviser who can better give an account you how to clean up your debt and your credit score.
I think so..
No. It's not that impossible for your credit score as long as you verbs making your payments on time. Making a behind time payment is one of the worst things you can do to ruin your credit. That said, you probably want to bring those credit card balance down so that you don't have to retribution additional interest above your mundane rate.
Listen, this is how it works. If you are ever more than 30 days late, it will affect your credit win. If you are more than 50% over your credit balance, it affects your credit mark. If you are a slow payer, it affects your credit score. If you draw from credit counselling it is treated by the lender as if you did a chapter 13 bankruptcy. I am a mortgage loan officer so I know what I am taliking in the order of. Judgements, collection accounts and BK's will all affect your credit mark. Get a copy of your credit report from www.annualcredit report.com and see what is being reported. Ever hear of Pre-Paid Legal? If you requirement extra money and looking for a P/T job that doesn't nick alot of your time check out my website at www.prepaidlegal.com/go/janice... e-mail me at mitjan1@netscape.net if you hold any questions. You will never enjoy to worry more or less going over your credit limit again!

MAKING LATE PAYMENTS ARE MUCH WORSE THAN GOING OVER THE CREDIT LIMIT.
Going over the restraint is bad, because it will verbs to come up on your statement every month, like a dosh advance. You a moment ago keep on and on and on beside the payments but it never goes down...If you are not sure roughly the delinquent payments, look at your credit report and see what THE creditors show your records to be from their point of vista...
exceeding you credit limit shows creditors that you are or going to be strung out. it method to them that you can't manage your credit properly and are continuously reaching your confines. pretty mcuh everything yo udo or don't do hurts your credit. Credit is like a bully, no situation what you do to it it'll always thump you down. And when you're down, it'll spit in your obverse just for added means. be wary. but here is always an opportunity to go back to the beginning.
Yes, it does. Being in the mortgage business I see this on a each day basis. Maxing out your credit cause your credit scores to drop. Not lone that, but isn't your interest rate on the credit card super high because of it?

The best agency to increase your score after this is to pay cheque at least 50% of the card stale, and stop using it. If you can pay bad the entire thing, do so, of late don't close the account.

Yeah that's is really apt. You can show them who's the Junk mail boss presently and send within all their trash support. Just don't put the part next to your name and address rear legs in the envelope.

Why don't you just ring up (888) 567-8688

It's where you opt-out on acceptance anymore pre-qualified credit card offers.

I never thought of that. hahaha... Sure, why not. Maybe add a record in bold packages telling them NOT to dispatch you anymore junk and to cart your name bad their mailing document.

I always shred everything that comes to my address near any personal information on it.

If you take junk communication for pizza companies and other such places, stick the pizza adverts into the envelopes for the credit card companies and vice versa. That process you kill two birds next to one stone. I'm sorry but that is f***'n a hoot.I wish everyone would do that.Maybe it would cut down on some of the wastefulness of thesis STALKERS.I call them stalkers b/c no concern where I walk there THEY are.

Just don't send hindmost any of your info...such as address, name, etc. Send them the coupon for pizza LOL
It keep the mail contained by business and the junk company have to pay for it!! Love it!!

I think it sounds approaching a great idea. You get my vote. Now I know what I'm doing with adjectives these.
Source(s):
Always wondered myself If you are really that bored send the the rest of your second-hand goods mail as powerfully. no sense in anyone discriminatory right??

that would be really ignorant of you to do such a item. then you run the risk of a total stranger space it up again, and applying for credit in your first name!

I usually put all that stuff, pluss adjectives te other stuff I get near my other creditcard statements, plus cut up magizines and flyers etc.

I just take home sure that nothing next to my name and address is on it.

I once sent an envelope need $4.85 in postage to HSCB within Nevada.

I also mail stale all of thoes Business Reply post cards I get hold of in magizines too. I am sick of getting a bright readers Digets or other magizine and have 100 post cards flutter to the floor.

I don't fill them out, purely drop them in the letters with nil on them and then the company have to pay the pstage

Andy Rooney from 60 minutes suggested just that a couple of years ago. He even add extra to the envelopes like pizza flyers, hearth rug cleaning, etc. to each envelope.

I do it too - and I OPTED out ending year

credit is the ruin of the American economy

Yes...At first it seemed approaching I wasn't with the "in crowd" plastic is the point afterall...But I don't get as much stupid second-hand goods in the e-mail and my bills are kept to a very dull roar. Cool isn't it? Yes, I do. My husband does enjoy one but is only used if we can compensate it off right away. I instead would find excuses to constantly max them out so I stay away from them!!

No not immediately, but I will soon by paying them off. Yes, we will start positive money to buy the things that we from the savings statement. Why pay interest to someone else when we can be earn the interest myself.

Yeah, but I still have abundantly of liabilites and VERY few assets, so it's kind of close to I'm still in like hole (i still have to hold a job).

i do not hold any credit cards except American Express that has to be rewarded in full at the terminate of the billing cycle and a visa check card that deducts what i buy right out of checking. credit cards are butchery America. Ronald Regan knew this and tried to grasp Americans to stop using them. it was working for a moment but the credit company's fought back and won. i cant transmit you had much cast-offs mail i find from credit card company's trying to get me into that financial trap. forget, not for me. i work sturdy for my money, i don't need to waist it on credit card interest. yes make happen after racking up so much debt i closed accounts and threw away all my cards...except my visa debit. do hold one more credit card bill...butit isn't much! IT IS NICE....THE FEES AND INTEREST CAN ADD UP IF YOUDONT' PAY IT BACK QUICKLY

i don't have one......
its the smart item, until you are very responsible

I have one but nil on it. I hate it! But I own to keep it for emergency and for things resembling car rentals that in recent times take credit cards! No credit cards for me any. Why would I pay interest to anyone to spend my own money? Ha!

To extra_37:

A FICO score is not a requirement to obtain a mortgage. Just look around for a mortgage broker who will use a lender that _manually_ underwrites your loan instead of the snatched and dirty automatic underwriting that's customarily done. Fannie Mae doesn't require a FICO score.

It rules as long as you never have to buy a house or a coup¨¦.

Just because you have credit cards does not tight-fisted that you have to max them out and be debt ridden.

If you own a good mixture of core cards, store cards and loans, and low utiliztion - good history on them, when you apply for a mortgage or a coup¨¦, your interest will be considerably less than if you own no credit or bad credit. It even affects other things such as your coup¨¦ insurance etc.

If you use credit wisely and pay envelope in full every month, you will pay packet no interest.

Unfortunately our country is a plastic driven country. If you do not have the plastic - you will reimburse - in greater interest.

Do the math, you could be paying an extra 10% "or more" on your mortgage for 30 years if you try to get a mortgage next to no or little credit history - thats a huge chunk of change to be paying simply because you don't hold credit. This is a mix issue. You need credit to cause big ticket purchases. If you want to buy a home, car, etc you will involve some sort of credit so that lenders can get an theory if you will repay the loan or not. The only population I know that don't use credit cards are the wealthy - because they can afford to buy things, change. If you budget your money and control your spending habits, you can still establish a vastly healthy credit history and be debt free. And when you're prepared to buy a home or new saloon, you will be offered the best rates.

i've made $20 payments to credit card co for 4mo- can they sue me?

i haven't made a minimum payment contained by 8 mo. they are charging it off, but can will they sue me for it? my credit card cut-off date was 1250 and next to fees and interest it's up to about 2200. i don't hold a job bc i whip care of my son. my husband get laid off and we can scarcely afford to live. i only own a '92 saloon that's not worth even 800. if i continue to construct payments, can they sue me? we can't afford to pay right immediately and we certainly can't afford garnishments or court costs. what can i do?

Answers:
Best bet, phone call the company and try and make an arrangement. What be spent on the card isn't what's killing you, it's the over-the-limit fees, interest fees, and fees for fees. It get to be a racket sometimes what they charge, believe me, I know. If they won't come to some sort of a settlement plan, freezing the account and adjectives thier fees, then you stipulation to call a credit counseling group FAST. Credit consolidation offer them a way to assure getting their money, and you the luck to pay wager on what is owed without have the final balance hit 10s of thousands of dollars. I can't recommend any picky group, but make sure it's one of the non-profit types, that are subsidized by the political affairs to help nation with mounting debts.

As for the actual 'being taken to court'... it won't begin. You are making SOME sort of attempt paying what little you do.. which must be taken into account by the credit card group. Also, for so little $$$, it wouldn't be surrounded by their best interest to try and pursue anything. Sure, they'll threaten and huff and puff... but worst case scenario is that they'll write bad the amount completely... and put it against your credit rating, where it sits contained by limbo hurting you for 7 years down the road for getting a good deal on anything credit-based, including some types of work now-a-days. So.... best bet to amass your wallets, credit evaluation, and future, try and arrange something beside the CC company or through a CC Consolidation firm and get posterior control of your financial stability.

Hope this helps! :)

Other Answers:
they will probably transport it to a collection agency, and you'll have to craft arrangements with them.

no credit cars are insecure loans,, they cannot take your wages.
they can try to sue you but it is hugely hard..

basically try to work it out.
but they cannot take anything from you..

but if is be a secured loan than they can sue you...

so i think you are ok...
purely don't let them drive you nuts.
you can also dispatch them a letter to stop calling you.

No they will not sue you but they will bother you and get collection agencies to your house. But I am sure you can recount them you sitiuation and you and the credit card company can work something out. By paying $20 shows that you are trying to pay them bad but due to you inconvience you are currently able to take-home pay $20. If worse comes to worse I suggest you to go collapse (but I hope you do not have to budge that far)

P.S. Good Luck

I would telephone them and tell them that you will verbs to make the $20/month giving. Ask them if they have some sort of credit counseling program you can bring in that will lower your interest rate, verbs over the limit and belatedly fees.

If they tell you they will not adopt the $20/month, tell them that they can consider your bill rewarded in full, if they won't cart your money.

You have to be adjectives with them, they are going to be particularly rude to you!!
Also, if they keep calling you, you relate them that they are harassing you, and not to call anymore. They are NOT allowed to hassle you! Most credit card companies have insurance within case you lose ur opening or are hospitalized they make the minimum clearance. Try to enroll in that program and this should lend a hand you til you get rear legs on your feet.

all right, not really, but you may be able to telephone call the credit card company and get the date, time, and store mark then hail as the store and ask for a duplicate receipt. They will involve the date, time, and purchase amount to do so.
No, you won't be able to acquire that. Just how much you spent and where. You hold to keep your receipts hun, put them surrounded by an envelope and keep it surrounded by your purse. I keep adjectives my receipts for that month in an envelope within my purse, and when the month is up I file my ancient receipts and start a new envelope. Trust me it help a lot.

When I checked out this site to find out why my rating was so poor, it turned out that a company selling home cosmetics (i worked for them ) have made a mistake and although I had salaried the outstanding balance, they slapped on a unsettled payment of lb5 on my depiction, neglected to tell me and registered me as defaulting on the portrayal. That was 5 years ago and I merely just found out. I own never been competent to get credit since and although I have to pay only under lb15 for the service, it be the best lb15 I have spent, as in a minute I am able to procure the problem sorted out and restore my credit rating.

Do your very best not to borrow at adjectives, certainly at any APR's that are giant. However if you really do need to lift up money go to the Citizens Advice first and get hold of their support and idea's.

collection ageny and resourceful creditor?

I sent a Validation of dispute letter to a collection agency and to the innovative creditor 30 days ago and as of today I havent got any response. What are the subsequent steps Im to do now? The debt that I be disputing is a debt I never had near the original creditor. Its not identity theif because I call the original creditor on the phone and give my ss# and they couldnt find any account within my name. Then I mail them a VOD, but its been over 30 days and I havent received any response from them or the collection agency.

Answers:
VC1109 wants to supply me with a source for her info. I know of no law allowing creditors 60-90 days to respond to a VOD.

We are following the Fair Credit Reporting Act here...that that gives the creditor 30 days to respond.

Now, I am assuming that you sent them this communication by certified mail and you can prove the received it? If not, start adjectives over again. You need proof they received it, and their 30 days starts on the afternoon it's delivered.

If you hold this proof, then your subsequent step is to send a certified notification to the credit bureau, along with a copy of the memo you sent to the creditor. Demand that the debt be removed due to "lack of validation".

If they still do not remove the listing, sue them. You can confidently do this in small claims court.

It's completely important to follow the FCRA rules exactly! I be recently within court and saw a lady beside an excellent case against a creditor! But since she didn't figure out the law and didn't come prepared, she have the case dismissed.

This is a period of war! Knowledge of the law is your individual weapon! The creditors are armed!

If you need more minister to contact me. I am not a lawyer or credit counsoler, only just someone who has be down this road (and won).

Other Answers:
Call both and see which one is handeling it and in what stage of processing the vod is surrounded by. It may take them a couple weeks to bring the account of their systems, and it may bring a phone call to find that information out.

I would await a response. They are probably just slow. You should convey letters certified / confirm delivery / signature required so you have physical matter evidence that they received the letter. You could also call upon them and inquire. If they haven't responded by now, it should be pious news for you. Now you can remove that credit profile from your history. It was probably a mistake contained by the first place. make sure that this credit entry does not appear on your credit.

Just wait. Most states allow 60-90 days to respond to a VOD. You can also dispute the item next to the 3 credit bureaus if it is on your credit report.

source: state and federal law, I work at a payday loan company and hold had to concordat with this sort of problem.

If you sent a VOD memo 30 days ago and got no response, is it not locked to assume that they realized their mistake and resolved the event. If the original debt be not yours, they have no must to contact you and tell you of their error, however, it would be nice for them to do so. and NEVER, present out your SS# to anyone, you are opening up yourself for identity breaking and entering. If it ain't broke, don't fix it.

Dispute it right away near all three credit bureau. Let the Collection or Original lender prove its you.

It gives you some packages to write after you tried to validate the first time. I agree beside Studly.

The collection agency has 30+5 days after unloading your debt validation to respond.

The original creditor is not required to "validate" a debt, but they are required to "verify" the debt (in the 30+5 days after unloading you debt verification letter)

Re-send the validation reminder to the collection agency and send a validation letter to the artistic creditor, sending both certified mail return receiving. As soon as you get the green cards put a bet on, send your disputes to the credit reporting agency's.

It is a defiance of your rights if they verify with the credit reporting agency's until that time they validating/verifying with you.
