Do I own to rate collectors I do not owe?
Question:
Help! I was contacted by a bill collector who stated that I owed roughly 1600 dollars to a credit card company. The bill collector kept saying "so are you going to pay envelope it?" I said "I guess". I didn't realize until afterwards that she was trying to trap me. I checked my credit report and call the credit card company and it turns out the card doesn't even exist! I have asked the credit card company to distribute me a letter stating this. When I notify the bill collector they stated that it doesn't matter. Because i told them that I would take-home pay, I legally enjoy to and they will sue me if I don't! I asked them to send validation of the details and they refused. I also asked them to dispatch me information on how to handle this and they refuse. What do I do? Will they really sue me?
Answer:
no way. speak about them you rights. get a hold of the dune and don't leave them alone until you return with proof the debt is not yours. (keep records of everything) put in the picture the collector you know that you cannot be sued for a debt you never occurred,(even if you mistakenly said you would) and if he is to communicate next to you in writing (send a certified message to follow this up). do not talk to him on the phone again. report to the credit card company you will sue them if the collector does not get sour you back next to this extortion scheme. find hold of a copy of the fair debt collection conduct yourself and know your rights and what to do.
no
and with no proof they could be sued for extortion.
Tell them to budge ahead and sue you and if possible bring back recorded proof respectively time they call you. Ask for the cross of the person who is calling you and take an address of where they want the money sent. It sounds resembling a scam to me. Turn them in to the Attorney Generals department of what ever state they are operating from. You might want to tell them you are doing this also. It will probably support them off.
Notify them contained by writing that you do not intend to pay (for the justification stated). Also inform them that all further communications next to you are to be in writing. Then permit them sue.
Or, you may want to hire a lawyer and sue them first for what is unsophisticatedly attempted theft by ploy.
The easy agency out is to ignore them and merely hang up on them. They will not sue you. Don't own to anything, don't be rude, just swing up. If they persist, ask for the coordinator and tell him other not to call.
First of adjectives, never talk to a collection agency on the phone! The one and only thing that matter is whats in writing. Under the FCRA, they MUST provide proof of the debt...but asking them to 'send validation' process little unless it's in writing. Send a missive to them requesting validation and send a copy to your BBB. Tell them you don't owe the debt and not to contact you again in connection with it. They cannot sue you for a debt you don't owe. And don't say 'I guess'. You might inadvertently agree to retribution a debt you don't owe! Another good use to stay off the phone. Wait until you see the debt beforehand you agree to pay anything.
They're full of crap. There are plenty of shady collection agencies (Allied Data comes to mind right now) that will try to trick you into paying debts that are any not yours, or that you have already compensated. What you said on the phone does not mean squat, and they won't sue any because it's civil court and even if they won, there's no way to force you to income. Tell them to provide you with proof of the alleged debt, and after send them a end and desist letter to stop them from harassing you on the phone. I put the relation for the letter below. If they can't provide you beside proof that you believe, then no agency do you have to salary. One warning though, they WILL report it on your credit. Fraudulent reports close to this are easy to attain removed though, have have it done several times. Be sure to obtain copies of your credit report from adjectives three (Experian, Equifax, and TransUnion) in a month or so, and look for this to appear on within. If it's there, dispute it hastily.
Length of Credit History for Target Credit Card?
Question:
I start having credit strip 6 years ago, since then, it be a bumpy road... and now thinking something like applying for a Target Credit Card with a chalk up of 610? I also have 2 positive items, 3 collection rationalization and charged off picture on my report.
1. Is my credit history long enough?
2. Will my win be good satisfactory to get a Target credit card?
Answer:
You will not know until you apply. But be sure to research the card thououghly first. Why Target? Do you want their card a short time ago for the rewards? Can you use their card anywhere, or just at Target? Otherwise, I would suggest you try for a different card. I own found that the cards I like are not restricted to in recent times one store. If you are looking at getting a card to help rearrange you credit rating, and are concerned about one turned down, look into getting a secured card with Bank of America.. They help me to bulid my credit score when I have some rough times!
Its best to give the credit officer at Target a appointment. I would think you would be ok, but it may be a low credit card.
your polite! go apply at a store, you'll obtain 10 percent off your first purchase!
If you're afraid of rejection, do it online.
You won't know until you try.
Do denial remarks drop rotten your credit report contained by 7 years and if so how does that affect your credit win?
Question:
I am of low income and when I was 18 my mother signed me up for a bunch of credit cards. I am immediately 23 and have not have the means to pay envelope off the maxed out credit cards. I am contained by college and i work part time. What I would close to to know is how can I handle my debt? 85% percent of the items on my credit report hold been charged bad. I heard that even if I earnings the amount owed it would still have a refusal impact on my report. I also heard that after seven years the items drop sour of your report. Well if the items are no longer on my report will they still affect my credit score. I don't really construe how this works. Please help...
Answer:
Your credit chalk up is made by using a formula that takes into side all the items on your report. If something drops rotten after 7 years (which yes, it does) then your win would be as if the item was never there-- so if its a charge-off, it would budge up.
You cannot pay a charge-off. The credit company took a export tax write-off and basically give up on the debt-- so they cant turn around and collect on it. However, they may have sold it to a collection company- so dont be suprirsed if some hot accounts/collections pop up. If you pay a collection company without beating about the bush when they contact you, often times it stays stale your report.
As far as any cards you have that are NOT charged off-- contact them ASAP. Often times they'll waive overlimit/late fees if you agree to a dependable payment respectively month- it saves you money and your credit.
They can be collected up to seven years, after that they cannot be collected but will show on your credit report until you dispatch a letter of dispute that it wasn't you who requested the cards contained by the first place. This will affect your credit and it will take a long time to catch off of the credit reporting. It take time to establish credit and will take someone who will trust you to start by giving you a credit card. Once they do get sure you pay in good time and do not ever be late not even once. Over time as you clear your bills on time you will start to establish dutiful credit and it will show on your credit report and your credit score will start to increase your credit rating to difficult scores.
Good Luck.
Here is how credit works...Credit reports are made to label the consumer look bad..Whenever you own an account to be exact in derogatory or collection gloomy remarks will show and stay on your credit report for seven years. The longer the debt stays on your credit in refusal your credit score will drop. Eventually depending on the creditor these accounts will be transferred to collections and for that one report it can report 3 addition times...making it give the impression of being that u owe more on that account..also preserve in mind that collection agency flog your account to whomever will by them and charge you more. When a creditor bring tried of sending the account threw collections afterwards the may go threw a court and return with a judgement on you and that can report for up to 10 years...Also one more piece find out what the status of limitations is in your state..For example surrounded by Maryland it is 3 yearsThat means that if you don't settle up that debt in three years to the creditor after the 3rd year they can't report itIf you are not sufficiently expert to pay your debts afterwards you may have to database a bankruptcy..which can hurt as ably
If the negative remarks are no longer on your credit report they can enjoy no future implication pass the destroy they have already cause. Often times though you have to request the remarks stale of your credit report even if they have gone beyond 7 years. Bankruptcy is another story though. If you pay envelope the amount owed in full resembling you are suggesting, of course you will be better past its sell-by date in the long run, but short occupancy, the damage have already been done. My suggestion to you is that if you are deliquent on your accounts and can't afford to pay them as is currently, DO NOT agree to them get to the 6 month fleck of deliquency, settle your debt. The longer you are in deliquency the worse it is, once you settle the debt you are doing a tour to moving your credit score up. Also, the longer your debt is influential, the worse it can be, because the same debt can be transferred to a collection description, then an attorney. So necessarily you are getting hit 3 times for the same details, one by the creditor, one by a collection agency and lastly by a legal firm. You can email me if you own more questions.
Yes, the collections will enjoy a negative impact on your credit even if you repay off the debt. Like contained by (American) football, if a team get a 15 yard cost but scores a touchdown on the subsequent play, that 15 yard cost will still count as negative yardage.
The singular two things that raise your credit evaluation are a) paying your bills on time and 2) lowering your debt ratio. Since you're not really surrounded by a position to do either, you will enjoy to sit tight until your income improves within order to trademark a signficant impact.
Yes, collections do fall rotten of your report after 7 years, but be aware that the collection agency (or the original credit if the debt have not been sold) can still come after you and try to collect the debt. You be in breach of the jargon of the cc and as long as you still owe, they can still ask for money.
I'm sorry to hear that you're in such a pickle at a immature age! I've totally been within...it simply takes time to do from scratch your credit. Good luck.
The seven-year rule says that the information will stay on your picture seven years “from the date of last activity”. So if the later activity is when it is charged bad then seven years from that date it will crash off. If you would clear so much as a penny on this balance the seven years will start adjectives over again from the date the payment of one penny be received. From what you have posted and short knowing any more I suggest you ignore “everything” and consent to everything fall rotten. Then when you are ready to start over apply for a “secured” credit card. You will after be on the road to starting over.
1. You can retribution a charge off. Pay by check and transport a copy of the cancelled check to the credit bureaus. Then demand that they delete the details and adjust you credit score as expected.
2. Contact the other credit card companies and try to settle your debt. Make sure they give you a written agreement that when you foot the negotiated amount the commentary will be settled in honest standing.
3. You can wait for the seven years to intervene but you credit score does not necessarily advance by waiting.
how can i receive a complaint around my credit card company?
Question:
On holiday in the USA i get billed by my credit card company for someone elses room bill. I payed170USD cash towards the bill.
This be not taken off the billed amount. The bill given to me at the hotel on checkout be in an envolope on not signed by me.
The credit card company and myself hold tried to contact the hotel
accounts but have have no cooperation. The credit card company has not contacted me twice when they said they would. This have been going on from september. Help!
Answer:
Sorry I am confused. You said you be charged for someone elses room? Or were you double charged for your room? Meaning you compensated cash and afterwards you charged on the credit card? If it is the first, then the dispute should be simple.
1. Immediately database a WRITTEN dispute with your credit card company. Send it regular communication and certified. If it was a Visa, MC, AmEx, etc in attendance should be a set process. Phones calls are usually worthless.
The notification should be simple, On Sept X, 2006 I was charged $y by company ABC. I did not authorize this charge. I am disputing this charge. Please reverse this charge directly.
The problem is when YOU try to solve thier problems. From your comments I am sure this is what is happening. Don't verbs about the credit card company or the hotel. You want to stand on the most simple and defensable position. In broad these type of charges are prima facia reversable, meaning you right to be heard it is diputed and not authorized, reverse it. DO NOT get into any other discussions, this is only giving the credit card company a way to influence lets linger, or look into this later, or a short time ago forget about it. The time for you to dispute the explanation may be at or nearing expired. So send the notification today.
You need to recontact your credit card company. The card company should settle near you and then charge rear legs from the hotel.
The credit card company themselves have a dept that deal with this you won't hold to pay it at adjectives even though it is on your bill also ask for all interests to be taken stale so that you don't have to freak out. They will do this for you it isn't a problem for them at adjectives or it shouldnt be.
I would give them a phone if you still don't go and get any help afterwards i would suggest you write a letter of compliant to your credit ard company giving full details of that happen..give them a while to respond ( this can pilfer up too 51 days) .. if that doesn't work contact your local CAB and thay will help you fright the shield.
If you're Canadian go to your adjectives ministry of business practices or corporate affairs and complain listing date and everything you've done in wiriting.
Second complain to the better business bureau contained by Washington DC about the hotel and the credit card.
Third if you hold a local consumer reporter, write him or her and get them to investigate it , zilch any business loves more than seeing a reporter and camera person come knoccking on their door. And if you don't obtain satisfaction locally step to the ceo of the hotel chain.
On the wager on of your credit card statement, about 3/4 of the channel through the "fine print" should be a Corporate address for disputed charges. Write them a letter, distribute it certified, return receipt requested (so you can prove they received your letter) convey a copy of that letter to the hotel, certified. Now you hold the weapon of proof.
Once you know they have your written complaint, phone the credit card 800 number, wait for the "report fraud" prompt within the (*&%$!!) animated system, you'll be transferred to a real human. State you "will not be responsible for the unauthorized charge including nouns charges, late fees for that amount, and will not clear it." Then be quiet, the human should remove those erroneous charges from your report.
Worked for me. Good luck.
If it comes down to it you can contact your state Attorney Generals office and ask for assistance. Sometimes they will aid and sometimes they just don't trouble. It depends on the state. Also there are some free consultation places within some states where you can acquire information from lawyers as to what you can do and if you entail to get one involved. If the credit card company is at quirk, you may be able to set it up where on earth they have to rate any attorney fees incurred.
Try Bank, Card provider, police, your local MP, then find a lawyer if adjectives that crap doesn't work.
First - it is important to check your bill in the past paying.
Second - credit companies have different mehtods of dealing near complaints but all are govern by the financial ombudsman whom you should contact if this is not resolved
Try the Financial Services Authority in London. website: fsa.gov.uk.
How long does it lift for a delinquincy ,if at adjectives, to be erased from your credit copy?
Question:
Answer:
anything debt that has not be acknowledged within seven years will be erased, what will happen the creditor may give you a deal to wages it off right back the seven year mark, if you acknowledge the debt surrounded by any way, you are stuck beside it for the next seven years
around 7 years
7-10 yrs depending...
I wish I know what you meant by delinquency. Was it a unsettled payment? Lots of times you can get those go away a moment ago by writing a letter that disputes it.
It depends, what age and also type of delinquincy.
If one is a pubescent it may be erased soon after one is
an adult. If an developed, it will all depend upon the type/kind of
delinquency. A serious one may never attain erased.

I requirement a lawyer warning, my husband is human being sued by a credit card CO. due to a debt. What can we do roughly speaking it?
Question:
We don't have money to spare. We hold 3 kids, mortgage and bills. He couldn't keep making payments to the credit card CO.He's get a job, but hi get cut on hrs. His got to jump to court and we don't have a lawyer(we can't afford one) what can he do? Is in that a solution to our situation? our debt is $6,000.dl What paper work does he wants to file? I'm desperate. Please some suggestion. Thanks
Answer:
Make sure you are actually person sued, first off. If you haven't be summoned, you aren't being sued. So plentiful collection company's blatantly violate the fair credit perform, and misrepresent themselves as "liaisons to lawyer."
Look up your local BBB, and find a reputable debt counseling service. (They should be non-profit. By Design is who my mother used.)
OR
Find a *lawyer and have them negotiate the debt. Most CC companies will settle for MUCH smaller amount then what is owed.
Most importantly, don't consent to them bully you. If you get harassing phone call, letters, misrepresentation, or they are speaking to an unauthorized party about your debt, stir after them like near is no tomorrow. Contact the FTC, your state attorney generals office, and the bureau of the controller of currency and file complaints near all of them.
The culture in this industry, commonly, are nasty and underhanded. They do not support if they break federal trade laws, so receive sure you call them on it!
*If you can't afford a advocate, go down to your local canon school and they will relief you, if not set you up next to a student lawyer.
And don't rob it out of your 401K. The IRS will have you by the ball if you do.
Wow, your debt is only $6000 that's great. Most general public are so much worse than you are. Since it sounds like you own your home and cars since your debt is so low, I'm sure you could work something out w/the creditor. You and your husband can go and get a partime job to retribution them off. Ask for a settlement.
First of adjectives don't let the credit card company bully you. Your debt is small. Put them offdont pick up the phone when you see a number that you dont spot. They are not by law competent to call your relatives or contact you at work. Know your rightsthey are barred to harass you. Every week put a short time money aside. 20 bucks even. Eventually they will contact you give you a settling amount. This is usually partly of what you owe. If Your debt is 6,000 they will probably settle for 3,000. But you have to consent to them know that you dont have the moneythey can not attach your foot check. Or put a lean on your house. If you dont have money for a advocate, thats o.k, just put money aside so you can eventually take them off your support for a cheaper amount. In the mean time..procure rid of your credit cards! If you dont have the lolly to buy something.dont buy it.
If you are to the point of actually human being sued, then you haven't sent them any money for a long long time. You've consent to this go for too long to resolve it confidently.
I don't recommend credit counselors often but contained by your case, it may relieve in keeping you from getting a ruling against you. It will be WAY better for you long term to obtain this straightened out without going to court. However, if the court date is tomorrow or something, he better progress. Not going at all would be even worse. But if it go to court, you're just going to achieve attorney's fees and court costs tacked on to what you already owe.
Get some oblige. I've posted a couple links below. The first is the department of justice approved credit counselors for liquidation. This doesn't mean you are file for bankruptcy. It's purely some reputable counselors by state that you can call. I've also posted a knit to Consumer Credit Counseling. They've been around a long time and hold a pretty good reputation. Call someone. Get some minister to.
Settling isn't a bad concept but you need a money source for the settlement whether it be your tariff return, borrow from a 401k , or tap into your home's equity. I recommend a lolly out refinance of the home to get a better rate , payoff debts, and possibly lower your return since you are so strapped for cash. I also recommend Hamlin Mortgage as they hold helped abundant folks out in yesteryear. You can contact them via the online evaluation form at

How to construct a binding contract beside a friend?
Question:
I recently co-signed for a saloon for a friend of mine. I believe that she will pay the motor note in good time each month but to be on the protected side I want to create a contract. What information / key points should I include surrounded by the contract? ( I am going to request that she remove my name from the title after 10- 12 months of non behind payments)
Answer:
It never hurts to put these things in writing. In the contract, spell out that you cosigned the loan ONLY so that she could carry the loan, but that she intends to and is obligated to pay every expense, and pay them surrounded by full and on time. It should also say aloud that the car is hers, and that as long as she make the payments, you have no claim to it. Put contained by the specifics of the loan-- bank, loan number, pay-out schedule, vocabulary, etc. Then have it notarized, and both of you sign it. Sadly, this will singular help if she does fall through and you end up going to court to try to get hold of your money back from her, but if that does come up, having it adjectives in writing is your best defense against her adage that you were supposed to formulate half the payments, or anything. Good Luck!!
Shake hands on it, God will support you
I dont believe nearby is a whole lot you can put within a contract. No contract can null the contract you both signed for the vehicle, meaning if she doesnt wages it will hurt you and they will come after you no matter what contract you own.
see a free lawyer at your community foundation to help you write up the contract.

Are the credit repair programs worthy ?
Question:
I have have a few people approach me roughly speaking paying $250 for their credit repair service and it would help to increase my credit scorehow does this service work?
Answer:
NO NO NO
you should NEVER hold to 'pay' anyone to 'fix' your credit!!
just be smart almost it. pay current bills in good time. don't accumulate investigational debt. work at paying off frail debt. contact creditors directly and explain the situation they may work out a better deal beside you. sometimes you can pay stale credit card debt at a lower settlement.
but you do not need to earnings anyone to do this!
No.The best way to a superior score is to settle your bills on time and never owe more than 20% of your credit rank.
Please read the Federal Trade Commission link (below) on credit repair services.
If you must use a credit repair service, turn to the Department of Justice link (also below) and find one of the ones they own approved of for debt counseling. At least you enjoy a decent shot of getting an ethical one that mode. A lot of them are total ripoffs.
Bad idea. . .usually those kind of services are ripoffs.
try www.creditboards.com --you can do it yourself--its a lot of info when you first start to read--but it's experience that will help you very soon and in your adjectives.
I will keep it short and simple. Credit Repair is a wage. Credit Repair companies try to dispute all remarks contained by hopes the creditor cannot produce the proper paperwork to defend themselves. If you owe someone money, they will produce the paperwork. Now, if nearby are actual inaccurate remarks, thats another story. Pay bad or settle your debts and start rebuilding.
No need to wages someone for something you can do yourself. I used a "do-it-yourself" credit repair kit that costs a tiny fraction of what those companies would own charged me, that I purchased from the below website
Try http://www.newmillcredit.com It's a lot of info that you may not be aware of. Maybe you can find what you are looking for. And yes it is true. You can do it yourself. Question:
Hi. I only own $1,500 left contained by my car transmittal and also received this month's bill of $480. I'm wondering if I can just rate $1500 off from principal and shame the bill. Thanks.
Answer:
The final bill will alwyas be an adjustment, based on the date when payments were received, to arrive at the final interest be a foil for. You can send within the $1500, and you will receive a final bill with a payoff date. There will probably be a few dollars on in that because of the final accounting.
im pretty sure you can.call the nouns company and ask for a payoff amount it may be less than you surmise
if you call the nouns company and ask them what the payoff is they will tell you. They pass you the amount if you pay it inside a certain amount of days
Yes. Of course!! Pay it sour!!
You can pay it stale anytime. Just be sure to call the company first previously sending the check and ignoring adjectives bills. You'll want the payoff amount as of the day they expect to receive the money. Payoff amounts tweaking due to interest compounding and payments received.
Well, that depends on how you know that you have with the sole purpose $1500 left on your vehicle payments. You will need to contact your lender and acquire a "pay off" amount as of a confident day. They will know how to tell you the exact amount you requirement to pay and the timeframe that discharge off amount is virtuous for. You will need to take home that full payment in that time frame, or else your discharge off will money and you will still owe them some money. The most important point is, contact your lender.
