Credit Questions and Answers

Does the state of california allow debtors reimburse resourceful creditor directly to some extent than to collection agency?

Question:
in other words, do i own to pay a collection agency, or can i of late pay the inventive amount to the original creditor?

Answer:
You can "always" ask an untested creditor if they will accept the allowance.

Just be sure that if they agree to take the reward, they will also agree to recall the debt from the collection agency.

If you don't request that, they may nick your payment and convey it to the collection agency. Then the collection agency will just report the story as a paid glum.

Get everything in writing.
It is possible that the collection agency "bought" the debt and very soon is the legal owner of it.

O would suggest calling the creditor to see if this is the baggage. If so, then the collection agency must be rewarded.
Your original creditor may not even own the debt anymore.. They repeatedly sell stale bad debts for pennies on a doller to so call "collection companies" So I'd be careful beside that...

Is it possible to make conversation to my edge and ask for a lower salary within directive to avoid foreclosure ?/?

Question:
what are the odds of my ridge giving me a lower payment surrounded by order to avoid going into failure to pay ??

My payments are $3100 per month, MY retirement is only $2000 per month , the money that I be recieving from baby sitting is no longer available to kind up the difference, how can I get my dune to give me a allowance reduction so that I can avoid defaulting ? what are some other option, I don't have the money to update the house to vend , I had it on the marketplace 3 times and it did not sell because it wishes updating. thanks for your thoughts

Answer:
Banks are not within the business of foreclosing on property, and will actually do anything all right and within their underwrite standards to avoid it. They will not, however, violate those standards. Raise the question; it can't hurt.

If you hold significant equity in your home and you're over age 62, you might try a reverse mortgage. I own seen this prevent several foreclosures; plus, it will rid you of the payment.
You might know how to refinance and extend your loan payments by paying a lower rate per month. It sounds like you hold too big of a house for someone with your age and income.
You can other ask - but I'm not sure that they will.
YOU SHOULD GO AND DISCUSS YOUR SITUATION WITH THE BANK,THEY WILL BE ABLE TO TELL YOU YOUR BEST OPTIONS.
Yes yes yes, The bank does not want to help yourself to your house, it is a big hassle for them. Maybe you could refinance what you owe for lower payments. Do you hvae a lot of equity? Just surrounded by case you don't know this vehicle what your house is worth verses what is owed - for example if you owe 200,000 but your house is worth 400,000 - they payments would be alot smaller quantity at a 200,000 refinance. Good Luck!
The odds of them lowering your fee if you dont talk to them are nil.

You have nought to lose, get bad the tube and go verbalize to them.
I'm sure your bank beside be willing to work beside you and help you. I hope you return with to keep it or move to a smaller amount expensive place.
yes they wii, or go another babk.
You could refinance your loan near the bank contained by order to transmutation the terms of your loan into something more affordable to you. The hill will most likely draw out the term of the remainder of your loan, which will moderate your monthly payments, but, it will definately raise the total you'll closing up paying to the bank within the long run.

Alternatively, you could sell your house, use the equity you've accrue on it to purchase a smaller place with a more affordable mortgage. Your mortgage should never be more than 20% to 30% of your monthly income. If it is, it's a clear sign that you may not be capable of afford it and could easily be foreclosed surrounded by future.
Yes this is call REFINANCING. There are hundreds or thousands of websites you can view for a start, but try going to a mortgage company within person. You do not enjoy to refi through a bank, in attendance are private companies who will secure the loan for you as ably.
Given your circumstances, a bank is unlikely to work next to you. It just puts bad the inevitable, which ends up costing them more money in the long run. Unfortunately they will look at it as a business edict.

The best thing you can do is see if you can go the house to one of those people who ballyhoo that they buy ugly homes. (search "We buy revolting Homes")

If they will pay you more than you owe, afterwards you might be ok. Otherwise, then you are probably going to be within trouble sooner than later beside your lender.

One thing you could try is renting out a room surrounded by the house to generate some money, but honestly with $2000 surrounded by income you will be hard pressed to collect a $3100 mortgage once you factor in living expenses.

If you enjoy owned the home for more than 4-5 years you should be ok as far as equity.
$3100 ? My friend do you live in a palace ?
I won't bequeath you the old "why don't you live withing your means" wise saying. But you should seriously think almost it.
You can refinance your Mortgage loan with the ridge or look for a better lender ready to clutch on your mortgage and work it with you.
Or you can go the house and take a small loss that's better on the long run than foreclosure or extreme debt.
Or you can rent a room or a floor of your house to generate up for it.

Just remember the Financial institutions are always all set to work things out with you as long as they receive their payments.
Yes, you can. You may have to refinance. And, you may own to take a alien job. The item to remember is that banks don't want to foreclose because they will almost really lose money on the deal.

Your payments are over 150% of your income. That is an incredibly unpromising situation. You may want to look into bankruptcy. Many states will tolerate one keep one's house during ruin.

As for selling the place, you may have to lower your asking price contained by order to put on the market it,.

Another option may be to rent the house out.
It looks similar to below article addresses the examine you have ..

Mortgage crisis? Act immediately to avoid foreclosure

Source: Fred Yager, ConsumerAffairs.Com

Are you one of the millions of homeowners who went for one of those enticing inconsistent or adjustable rate mortgages only to see your monthly recompense, which started off low, continuing to rise, escalating to the point where on earth it’s harder and harder, or even impossible, for you to keep up your payments?

Unfortunately, this is an all-too-common scenario man played out across America.

According to the Mortgage Bankers Association (MBA), an estimated $1.5 trillion in adjustable rate mortgages (ARM) are going to see another increase within interest rates this year alone. How can Americans lower than 18 own a credit card?

Question:
In Britain we can't?? Who pays for them, as you have to hold a job contained by the UK to own one and be 18.

Answer:
Hi, there are several ways.one road, is to have a preset credit card.where on earth you "pay surrounded by advance", (personally, i don't like that model at all, but plenty of general public actually do), and after the other way, is the credit card can be in actual fact linked to their parent's credit card. The charge will show up on the parent's credit card statement.
more than expected that person below 18 has a co-signer on their credit card because the rules here are that you hold to be 18 and earn $15,000 or more. Perhaps their parents or a partner in their business have co-signed for them, or they lied to the cc company or they are using someone else's identity. Frankly, I don't know who pays for them as these days babyish people do trade name a lot of money on the lattice and thru owning their own businesses, so maybe they do remuneration for it themselves.
The easiest way would to own a parent or guardian co-sign for the credit card. Making the adult obligated for any debt incurred by the younger card holder.
Also nearby are secured credit cards, which the card company would hold a certain amount of money as warranty.
Although I am not entirely sure a person below 18 can legally incur credit? Hope this help.
I demand a credit it card if not! tell em
Other than an authorized user, individual a minor you can't. You also cannot "establish" credit if you are under 18 yrs of age.
not here surrounded by usa, like we hand over our stores and hotels away to india people we will make a contribution you one to come on over go usa
The short answer is they can't. Only properly emancipated minors have the wherewithal to enter into contracts before that age of 18 (essentially that's what a credit card application is). What heaps American teens have are debit cards that own a Visa/MasterCard endorsement. This allows the card to be used as a credit card, but boundaries the charge ability to anything the holder's bank stability is. There are also preset cards which are essentially "gift cards" that can be used anywhere and can commonly be "recharged" with funds as the efficacy is spent. minors may also be designated as an authorized user on a parent's account, and own a card with their identify on it, but the account is not really theirs.

If a corporation files for Bankruptcy..?

Question:
iI have a business that is to say incorporated. If i were to wallet for bankruptcy below the company. How am I liable on a personal level??? assets etc...personal credit...etc...

Answer:
Anybody, whether a company or an individual can progress bankrupt. This happen when the bankrupt individual or organization cannot clear their debts. There are multiple reason why the company or the person can drip into this situation. Improper financial planning, spending on unnecessary items or loss of source of income can be some of the reasons for the liquidation.

If you go in debt, file your ruin under Chapter 13. Chapter 13 permit an US resident to reorganize and restructure their finances. It allows you start afresh and receive your finances back on the track. The liquidation court will supervise and authorize the entire process of overhauling your financial situation.

While filing for liquidation under Chapter 13, you hold to draw up a plan of action expected to pay your dues inwardly the next 3 to 5 years and submit to the collapse court. You should clear your dues as much as possible at frequent intervals. Filing under Chapter 13 will protect you against the undue pressure exerted on you by your lenders to clear your debts.

The only drawback is that your collapse will affect your credit score. It is retained for the subsequent 10 years. So you might find it difficult to get any credit during that time.
if the company files ch 7 instead of 11, [gone vs reorg]
it regularly needs to turn through the state corp commissioner
to make sure in that are not perfected liens. IF verbs,
or the creditors can be satisfied, adjectives is good and okay.

IF you can prove you have not violated the integrity
of the corporare veil, you will be ok.

If a creditor finds you hold done things personally that
competed near the ethics of the company, they can
"pierce" the corporate veil and later, you could be held
liable. Few people own their corp's pierced.

Sorry you went beneath.

IF YOU have not file, I can probably save the company; I am
an expert at fixing companies.

esp at offering creditors equity contained by exchange for their
notes of debt.

since i own have my credit card i enjoy payed my bills within full, will have student loans effect my credit?

Question:

Answer:
Depends - you'll owe more money which will hurt your credit some. However, paying on them (faithfully) will improve your credit over time. Plus, going to university, means a better a position and more pay which will undo more doors as well!
Pay them prompt and they will help your credit, by establish a appropriate payment history.

Having a match will reduce the amount that other lenders are likely to loan you for a car or home. However lenders are usually feeling like to lend you more money that you can afford to repay for such things.
Student loans NEVER go away.
Not if you compensate them on time. Are you trying to buy a house? If you are surrounded by deferment they should not hurt you...If you are in repayment they might over extend you depending on how much other debt you own outstanding.

Whats a honest credit card to use to start out on?

Question:
I have never have a card, and I just want one to start building credit, and merely in baggage of emergencies, what is a polite one to start out on?

Answer:
I don't know the best but I can tell you the worst..never never never bring a Capital One card.
1. They usually never give you a credit limitation raise (I get mine over 3 years ago with a 300 credit inhibit, at the present time they have raise my balance once to 550. My younger sister next to no credit has a well fargo credit card witha 1000.00 limit and she didn't even own to try. They will however give you close to 6 credit cards with a 500 or so confine, that way if you are delayed even once they raise your interest rate and charge you tardy fees..They are hoping you will do this with adjectives of your cards so that they get adjectives of this free extra money.
2. Capital one doesn't report your credit limit. The credit bureaus subtract your score base on the amount of available credit you have along near payemnt history and other factors, if they don't know your credit curb they will use your high be a foil for instead.so, my credit was not accurately reported because my card beside a 550 limit be being reported as a card next to a 100 or so limit and anytime I used it they believed that I be closing in on my credit confine and my scores be not as high as they could own been. One month I charged up 525 on the card and without hesitation paid it sour so my credit limit would be superior and my score jump by about 15 points.
Capital one is one big scam and if I could start over again I would hold never gotten one. I hope to save you the distress from ever having to operate with them. They are more trouble than they are worth.
Here's a rating system that's fair-minded:
Try starting off beside a department store credit cardlike Jcpenney, Sears, etc. Once you get approved buy something small and after pay it bad right away. This will get you credit win high. Then you will be capable of get a broad credit card..that can be used anywhere
If you have no credit you may hold to get a secured card.
Maybe you can try below website to achieve the information you need. It's just about how to find the best credit card articles for your second opinion.
Yes at hand are other options.
I own a list of some accurate websites offering Credit Cards. Its a policy voilation of yahoo if i post any link here.

Just correspondence me at solidoffer11@yahoo.com with subjet- Credit Cards . I will transport a link of best website where on earth you can find best Credit Card offers, tips and resources.

Best wishes
Reward credit cards reward you depending on the amount you spend on the credit card. Usually, you can collect rewards through 3 methods. One method involves earn cash fund on the card, which is generally a unmistaken percentage of each amount you spend. The subsequent method involves giving points or any other type of token to the customers to accrue. They can then redeem these points for gifts close to luggage, cosmetics and other goodies that the credit card company offers. Most of these reward scheme have alluring gifts and huge mixture of selections. But the better selection is to go for a currency back reward as it allows you to use the money any bearing you like.

If you take a credit card but don't use it?

Question:
You don't have to recompense anything right?

Answer:
No - unless your card has a every twelve months fee. In which bag, once a year, that charge will appear. Look on your agreement to see if there is a levy for having the card.
you want to check you agreement, i was almost to apply for an american express card once only to discover it have a lb40+ charge per year! Visa & Mastercard generaly speaking dont have an anuall levy, deffinatley go for a credit card they other come in handy!
it would depend on your contract i own one i don't use but still pay a once a year insurance cover on it. mine is for when i am abroad so when i do use i hold set it up so that the full amount goes out of my explanation each time so i avoid interest payments that approach also
Correct (unless your card has an annual levy ... find out if yours does.)

But in instruct to esblish 'good' credit, you should make a purchase and reward it back right away. This will show you are a responsible being and give you a righteous credit score. When you hold a good credit gain then most predictable, when you ask for more credit, you will get it.
Only if you enjoy a card that charges and annual feel. Ussualy cards that hand over airline miles or other such benefits will have approaching 50 annual fee that you enjoy to pay.

But otherwise, as long as your stability is 0 you do not have to wage anything at all.
you enjoy to pay stamp duty to the elected representatives which is around 30 pounds if you use it once a year. You may have to reimburse quarterly or yearly fees though depending on your wall.
It all depends on what nature of credit card we're talking in the order of and who issued it.

Most major credit cards approaching American Express, Visa, MasterCard and so forth have annual fees. That channel once a year you will be billed for an annual membership levy; usually around the $50 (US) range; some charge more and some charge smaller quantity. It all depends on which company issues the card and how much their fees are. Be sure and view the fine print so you have no astonishing surprises.

Some credit cards have no monthly fees or continuation fees attached; so as long as you don't use it and don't have a symmetry owing, there is no charge to save the card. Do watch the fine print, because some cards approaching that require you to make at lowest one purchase every six months or a year; otherwise the card will become invalid because of lack of use.

Other credit cards do hold monthly fees, essentially for your having the privilege of carrying that card. Again, study the fine print because some of the monthly fees, service charges and maintenance fees can sneak up on you and supply up rather soon. Especially if you only wage the minimum amount due every month.

Many well-known and well-respected financial experts recommend that you wage off a credit card bill contained by full every month; thus avoiding the outrageous interest charges. However, that's what banks and credit card companies are hoping for; that you'll generate only the minimum payments - that's how they bring in their money. On the interest.

I know about how credit cards work because I used to work for one of the central Visa and MasterCard issuers here in the United States.

Be intensely careful.
Yes,
Unless nearby are fees associated with the card. Such as an annual excise.
yesyou are perfectly right

How do I spar a credit card debt that have be removed from my credit report already?

Question:
I had a departed negative portrayal that has be removed because it didn't exist under my social payment number with the company. I only just got a dispatch from an attorney about this portrayal on the company's behalf. What is the best way to clash this?

Answer:
I had something close to this happen to me. I replied to them next to a cease and desist communiqu¨¦. I should state that the debt has be removed from your credit report for (blank reason). Provide them proof of this from the credit reporting agency. Be sure to mark out any personal info you do not want them have. Let them know if they keep bothering you that you will directory a law suit against them for nuisance. Make sure you send it certified so you hold a copy with their signature stating that they received it. Keep a copy of the missive along with the green certified card once it is returned to you. This is exactly what I did and I never hear from them again.

Many times if a credit card company or bank can't resolve collecting monies they turn it over to a legal representative. Sometimes (which was my case) a mound will sell behind the times unresolved issues to the highest bidder. This track they still get some money for it.

They hold a statue of limitations in which they can stroke. Once this statue of limitations is over they can't do a thing to you but if you remuneration even 5 dollars that statue of limitations starts all over and you become liable for the amount they are collecting.
I would purely send the Attorney matching information by registered mail that you sent too the Reporting agency that get them to remove it.

Even better would be if you have something from the company itself that say they removed it.

If they still harrass you get an attorney yourself and sue them. If it is not your debt they can not come after you.

Here is portion of an email I received today. Can anyone update me if this is authentic?

It have a toll free number in the paper.. why not give it a name?
I've seen this type of thing until that time.. I worked for a company that was involved within a class action suit, and as a representative I be not allowed to discuss it near customers who called, but have to refer them to the toll free number. It was lawful.
If you know nothing something like the case or the product, it IS a scam. In reality, even if you do have the product surrounded by question, I'm guessing it's a bit to steal your identity. Delete and forget my friend.

For those that hold gone through a foreclosure, how abundant points did your credit mark run down??

Question:
My concern is after i go into foreclosure, will I know how to continue to lease a sports car? My credit is perfect, aside from the foreclosure or achievement in lieu surrounded by the future. I hold been leasing for yearsso my sports car payment history is immaculate, not a single missed payment. Any insight would be greatly apreciated. :-)

Answer:
It is curious how you articulate your credit is perfect except for the forclosure. However, to purely answer your question your credit rack up is only one factor.

It will probably drop relatively a bit, but when the underwriters look and see the forclosure on it even with a dutiful score you will still own trouble getting any financing. It should not effect your current lease but any new ones will be difficult.
Why do you lease cars? Just buy a used coup¨¦ for $1,000 or so and drive it until it drops.

With the money you save, you should know how to pay your mortgage.

My credit card company have charged me lb12 postponed expenditure duty even although I sent the cheque surrounded by plenty of time.

Question:
When I called them to complain they claimed the sum had very soon been received but due to the christmas post and the days the dune was closed over the festive time of year that my payment have been delayed contained by being proccessed. Surely I should not own to pay the behind time payment payment when it was sent on the dot and it is not really my fault my cheque have got delayed in nearby system due to them being closed over christmas and topical year period.

Answer:
Don't foot the fee. You would not believe the amount of times I hold gotten out of paying late sum fees. I am an expert.

Here are the companies who tried to get money from me:

Avon: Late recompense fee: lb70 How much did I clear lb0
New Look lb40- I paid lb0
Dorothy Perkins lb20- I salaried lb0
Black Horse lb20 - I paid lb0
HSBC - Probably lb100, going surrounded by at lb20 a pop- I am ashamed to say I did closing stages up paying lb20 by accident!

Yours is lone lb12 but why should you have to reimburse it when you didn't do anything wrong. Next time you send it by post give the name them and let them know.

This is other mine:

I have purely got out of hospital after an operation and sent my cheque weeks ago. Why the hell own you charged me? Obviously I was not at home to correspond near you, I haven't opened post or answered call for weeks.

How very dare you?! I sent my cheque prompt, if you have a problem near dates afterwards I suggest you cancel Christmas ( that be a joke).

Ask to speak to a manager, they know they own to let you obtain away with it next because it looks bad on them if they don't (although within your case it is through no falut of your own- mine is other my fault) If bad those like me can grasp way next to it when it was my reproach then why shouldn't right people similar to you get away near it whn it wasn't your fault?
label royal mail compensate it.there bloody usless
communicate them you will cancel your card and move to another one if they dont settlement you the 12 quid, they will soon respond!
You Are Asking as well as Answering!

So, what is the problem Man!

Try to soak up the life lacking Credit Card.

Ali.
They usually say allow five working days etc. If you did, consequently it's not your fault and chase it up beside Customer Services.
Call them again and explain that you expect the charge to be reversed. Let them transfer you to the personality who has authority to do that.
YOU'D THINK WHEN YOU CALLED THEM THEY WOULD OF TAKEN THE LATE FEE OFF YOUR BILL, TRY ANOTHER CALL AND MAYBE YOU'LL GET CREDIT FOR IT.
Postage (unless record or registered) does not guarantee receipt although I'd try and go and get the charges waived they're in general pretty fair surrounded by my experience. Especially in judgment of the time of year.

And if that doesn't work, threaten to switch your balance to another provider. That might prompt them to do something
There is other a date by which your cheque must arrive to allow the credit card company to cash it - in general this takes 4 working days from the year they receive it. You are expected to build this into your calculations for when you distribute the cheque off. So it is your guiltiness if you didn't count 25th, 26th Dec and 1st Jan as bank holidays. Pay up this time and use a calendar subsequent time. Or set up a direct debit so it can't happen again.
The cheque may not own cleared, it is your responsibility to make sure they achieve cleared payment on the dot.
Call them again and tell them again that it be not your fault. If the customer service rep cannot relieve you, ask to speak to their supervisor or manager. Unusally, they hold more power to appease the customer. Also, be polite but not afraid to "threaten" to take your business elsewhere. Sometimes diligence is the key. I other use this tactic and usually it works.
Read the fine print. YOU are responsible to account for such delay and send the expenditure early ample to make the due date. BTW...paying over the internet have maybe a sometime delay.
explain to them they will repayment
