AIG - Supposed overpayment of Worker's Comp Pay...?

Hello. My husband was injured at work closing year, August 25th, and applied to get worker's comp pay/benefits when he could not work due to a torn muscle within his foot.

I was wondering - AIG, the insurance company he be under, didn't issue him his first Worker's Comp check until October 12. (That funds, nearly 7 weeks/45 days went by until he received his benefits!)

He returned to work on October 15th; however, AIG continued to rate him (supposedly) until November 27th. (I did not see the checks that came after October 15th, and will enjoy to request copies from the bank.)

The entry is AIG is now trying to say aloud that they overpaid my husband by a thousand and some dollars, and want repayment.

My question is - can they do this? If they really did overpay him, be error not their fault? (They even call my husband at work on October 15th to confirm that he had returned to work.) We didn't know if the money that they be paying him was supposed to be back-pay for the month of September.


Answers: Well over payments come up alot in the work comp business, I've even done it myself, but not to that extent.

It's not simply AIG that issues overpayment letters and call, every company does it. Your husband should have be paid through 10/14/2007 and zilch beyond that. Basically he was getting compensated more and more. Your responsibility was to notify the adjuster and tolerate them know that your getting money that shouldn't be yours since he returned back to work. So they hold every right to ask you for the money back, because it isn't your money.

Each state is different but some states will purloin the overpayment out of an award, so if you where expecting a big PPD award of $10,000 and you enjoy an overpayment of $9,000 AIG, or any other company has every right to attain that money back regardless.

If you used your ATM card to debt $100 dollars and the ATM went nuts and coughed up $500 dollars, the mound will look for your to get that $400 dollars, or readjust your article, because it's not your money.

Yes, they can request a repayment. Regardless of the error that was their show disapproval, you should NOT have deposited the checks. If you don't comply, they'll sue you and win, and attach his paycheck - plus expenses.
It doesn't surprise me that they did this, and they probably enjoy the right to get wager on their overpayment.

Can u recv workers comp&ssdisabilty at the same time in calif?




Answers: Sort of. BUT, any SSDI you receive while collecting workers comp, the workers comp carrier is entitled to get it back from you - reimbursement up to the amount that wc is paying you.

The effect is, you can't collect both (double dipping). Frequently what happens if you're out on SSDI, the workers comp will keep the claim open, and continue paying the medical portion of the claim while you collect your SSDI.

But it's pretty rare to have an injury that makes you SO disabled you qualify for SSDI, without being dead.
No it is against the rules and they will punish you.Workers comp. is for people hurt on the job and state disability is for people who have not been able to return to work from a injury other than work related.Social security disability is when you are deemed totally disabled before retirement age and you collect a check based on that judgement of dissability.If you have made a error and are trying to get SDI and are getting workmans comp.return the money and let them know you were unawear of the rules.
