Workers comp, employer cross-question..?

Ok I got hurt acouple of months ago, and be on workers comp. workers comp worked with me until they established to dispute my case because I could not definatively speak about them what I did to hurt myself. It was really nippy paced that hours of daylight, and I was working a mission I wasn't that familiar beside..fastforward to today, and I had to own surgery, physical therapy, and waiting for my doctor to release me. I am surrounded by debt up to my eyes now, and cannot afford to retribution all the medical bills, even next to my ins paying 80% I'm left next to a 4,000 bill. what are my chances of unbeaten a case against workers comp? I did give an account one guy that I hurt myself that night.

What do you propose that they worked with you? Did they PAY you any benefits at adjectives?

In most states, they will determine compensability up front before providing benefits.

if they provide initial benefits and next find out that your injury is not compensable - they can stop benefits. They might have to controvert your injury or give somebody a lift it to a hearing but - if your injury is not a compensible injury below the statute...then you're going to be out of luck...and you usually are not going to win within that situation.

Usually, benefits are provided when you are injured doing your job. YOUR assignment. If you were doing something to be precise not within the COURSE and SCOPE of your employment - they could allege that it is not JOB related and thus no benefits would be do.

EVERY SINGLE STATE is DIFFERENT, though.

If you are not sure what's going on - call the worker's compensation bureau/board. Ask for an ombudsman. They will lend a hand you understand.

Now - when you right to be heard that you did tell one guy that you hurt yourself 'that night' - do you suggest that you told someone at your job that you hurt yourself on the charge? Or do you mean that you told someone that you hurt yourself elsewhere? That could put you within a sticky situation.

If you can clearly establish that you hurt yourself whilst performing duties for your employer, WC should take thoroughness of you.

If a physician can point to an injury and this injury can be linked to an injury arising contained by and out of your employment, you are not required to explain how you did it. However, it does seem a bit bizarre that you are unable to articulate what you were doing when the injury occur. Maybe it's a semantics issue.
Much depends on what State you are in. In California the doctors usually settle on if your injury is compensable. It is usually a very slow process. If they hold denied your claim I would recommend that you seek the guidance of an attorney who specializes in Workers' Compensation.

About self-insurance:?

Other than the involvement of a third party, can we argue that self-insurance and traditional insurance are virtually equal? What bases of arguments for or against this statement can you provide?


Answers: They are not virtually transposable at all.

Traditional insurance give you maximum protection up to the limit of the policy you own purchased, assuming the insurance company is solvent and pays the claim. If you have a million dollar liability policy and you are sued for a million, you are covered.

Self-insurance simply pays out of anything funds are available, with no guarantee in that will be enough funds.
FCAS80 give a good answer. I'd just add that commercial insurers are subject to state insurance law (which usually require the inclusion of numerous "mandated benefits" and other consumer protections), while self-insured ERISA plans contain particularly few mandated benefits and virtually no protection for the consumer, since appeals and other disputes aren't investigated or reviewed by a governmental agency -- this necessitate that the matter be adjudicate in Federal court, which is time-consuming and VERY expensive.
