Would an independent contractor be held liable?

I have be searching online and cant find a clear answer. Would an independent contractor who is a driver, using a company vehicle, be held liable if the vehicle be left unlocked and later robbed? Or would this be filed below an insurance claim. My husband and friend are going round and round about this. Thanks

What are some of the option available to lower strength caution costs?

Answers:   I hold a few questions: First, what insurance coverages are you seeking? When you right to be heard robbed, was the coup¨¦ physically stolen or just the contents?

My gut, 17 years experience as adjuster, tell me "NO". If the company provided the independent contractor the car after they are a permissive user and they therefore are an extension of the company. If they be in an calamity, the company can't turn away and not have negligence. Also, I don't guess the vehicle left unlocked be the real common sense the crime was committed. Criminals hold numerous ways to gain entry into a vehicle and if they want something in your saloon, they will get it.

Purely base on (a UK formed) opinion, I largely agree beside Scott's answer.
If you are acting as an agent or employee of the company next its usually all deal with lower than the companies insurance.

That said I'm less convinced that nearby isn't some culpability on the part of whoever departed the vehicle unlocked. I've known insurers waste a claim where cars enjoy been stolen from petrol stations etc, because they be left unlocked next to the keys surrounded by. The reason one that there is a duty of attention involved, not locking a vehicle could well be see as not taking 'reasonable care'. A lot of policies require there to be 'forcible or furious entry or exit' before they rate out, this may or may not be the case here.

On a practical smooth I'd say it depends how much is involved the exact circumstances of why it be unlocked and how picky the people handling the claim want to be.

These things would be looked at on a luggage by case foundation, which is probably why you can't find a definitive answer.

OK, you're under the hollow that just because there's an insurance policy that might cover it, channel that the person can't be held liable. That's not true.

Anyone can sue anyone else for anything. Stuff within the car that's stolen, isn't covered underneath car insurance.

If the contract say the IC is responsible for the stuff . . .they are responsible for it. USUALLY, a robbery isn't going to be held against them. That's when someone takes stuff below threat of violence. But BURGLARY, when not a soul is around, if they left the coup¨¦ open, sure, I can see near is some negligence there.

You'll own to read the contract.
