Maybe it wasn't as bad as you thought.

Is Bank of America's check cashing/hold policy wrong, or am I man unreasonable?

Recently, my family suffered a fire and we be displaced from our home for 6 weeks. When it was time to relocate, I needed currency, upfront. In order to avoiding cashing out a compact disc for money that would be reimbursed in two week's time anyway, I have a family branch take a cashier's check out and overnight it to me. Mind you, a cashier's (or guard check) is a check drawn up at a bank branch and IMMEDIATELY withdrawn from a person's side. In effect, it is the same as dosh. I went to my local BOA branch (my side has other been contained by good standing) to deposit the money so I could write checks to cover the move. The transaction be completed without the bank clerk informing me that a 10-day hold was person put on the funds until AFTER everything was said and done and short further reason. I own been going wager on and forth with them since consequently to get the hold released. Am I wrong within wanting my money NOW and not later? They insist they are following federal guidelines. Is this true?

Answers: If your cashier's check is coming from another State, the edge has the right to hold the funds for up to 10 days contained by some States

Holds on check are governed by the Federal Reserve regulation "CC", or 12 CFR 229.

In summary: the maximum automatic availability rota for checks is often expressed as 1-2-5, explicitly:

o one-day availability for cash, on-us checks, cashiers checks, and management funds;
o two-day availability for local items as defined in the regulation, and
o five-day availability for non-local checks

Factors that allow the wall to extend the above schedule, on a case-by-case principle:

o Some State level rules oscillate on maximum holds
o The check you received from a your family is drawn from (is from) a guard in a different State
o Your description is new (30 days or less)
o Your article has be overdrawn in olden times (last 6 months)
o Checks deposited per day exceed $5,000
o ATM deposits enjoy some modified rules

When/if the maximum period is extended, you must receive a notification that your funds will not be available. In some States the extended hold can be until the check have cleared.

I hope this helps. This is a terrifically confusing regulation that was initially very well intended, as banks used to sit on customer funds forever and create a free "float". With electronic clearing, bank are trying still to preserve the float as much as possible. My guess is that these days no check should run beyond three days, no matter where on earth in the US it is drawn from. Still, they enjoy the legal right to hold your funds.

If your check is from alike State as your bank, or you did not catch a notification for the extended hole, complain.
I have NEVER hear of a bank holding a cashier's check, assuming the check be drawn on a bank to be exact in worthy financial standing. You need to chat with a edge officer; don't settle for anybody lower than a branch VP.

After all the shouting is over, I'd find another mound, and I'd tell them WHY! There are plenty of bank out there that will NOT treat you this means of access.
I don't know if it is Federal Guideline or not. I just know that more bank are doing this now. In my judgment, it is a good course for them to hold onto your money for 10 more days while they get more interest on from the bank investments.
I am a contractor, working in different states, and working for companies for 6 months to a year, everytime I cash Contract Employers, me bank puts a 10 year hold on my money to check with the unsullied Employer.
I don't know if its a federal guideline or not but it probably has to do next to how much the cashiers check is for. If it was for a generous sum of money then they may want to hold onto it to gross sure that it isn't a fake.

Answers: There is no conversion for that.
