How much does a government grant cost?

Question:
I've invented something and I'm really excited about it. I'm sure it will work and is an change on current designs. I want to take out a exclusive rights but want some idea of the costs.

Answer:
Good cross-question.

The decision to pursue patent, which kind and how much to spend is a business edict that merits consideration and planning.

Although you can do it yourself you will probably regret it later. But next, you could spend $25k+ with a government grant attorney and regret it, too. Patent services are like medical watchfulness. Cutting costs now can result contained by huge costs later. Often, you won't know almost the problems until later, and by that time the situation is irreversible. The cost for a typical US government grant, from start to finish, is typically between $10 and $30,000.

The patent process is resembling a tennis match. To grasp a normal, US "utility" application prepared and file ("serving the tennis ball") you are probably looking at spending $5-20k on an attorney depending on the kind of invention.

About 1-4 years after you serve, the exclusive rights office will return the serve. You will enjoy additional costs for hitting the bubble back. When the official document office agrees to give in the patent, at hand are additional costs for the final processing. All told, after file the application, the follow-on costs are typically in the $1,500-15,000 inventory (depending on lots of factors).

The US patent process typically take 1-7 years. The current published average is almost 3 1/2 years.

There's also the option of an informal provisional application, which typically runs $2,000 or smaller quantity. The provisional expires in 12 months and there's no tennis contest. Provisionals generally don't provide much protection, but they are great to receive "patent pending", to establish a date of invention, and to set deadline for making a formal application.

Lots of people approaching to file provisionals to carry their feet drizzly and during initial market test. If it looks like the product will go then they wish whether to pursue a real exclusive rights.

You might also want to consider pursuing a design patent. Typically this costs in the order of $3,000 to start and issues in 12-18 months. Design patent are supposed to be for the ornamental/ artistic/ non-functional aspects of products, but lots of people use them as a cheap approach to protect a product's appearance.

Patentability requires that your invention be new, and also that it is something more than an comprehensible variation or modification of the prior art. The US courts and the USPTO are getting tougher on the obviousness standard.

A "prior art" survey should be one of your first steps in the rights process. In the US, the prior art mostly includes (a) any patent file prior to your invention, (b) any publication (e.g, magazine article, web page), published more than one year prior to when you record your patent application, (c) any public use, public sale or offer to public sale of the invention by you or anyone else in the US more than one year since you filed your rights application. There are some other categories -- the government grant laws are packed with gotchas. From these three category, you can see that even if someone else hasn't gotten a patent on your invention (or if they did and it expired), you still might not draw from a patent any.

The patent imperative also has gotchas on deadline. The US and foreign laws favor impulsive filings. Tread carefully here. If you report the application too late, you might lose US and/or foreign rights. Most foreign countries hold "absolute novelty" rules, which public house patenting if there have been any nature of disclosure of the invention anywhere. The US has a one-year grace length on the absolute modernism rule. The rules are quite complex so don't rely on this simplification. The safest approach is usually to report your patents prior to any thoughtful of public disclosure or attempt at commercialization.

Now, back to penetrating. Before you spend the money to hire someone else, try doing some searching on your own. Use a turn out engine such as Yahoo to see if there is (or was) anything out in that like your invention, or articles which are on point. You should also use the rights database of the US Patent & Trademark Office www.uspto.gov to search issued patent and published applications. Most people furrow and find nothing, but at smallest it's a good start.

While here are still some professional prior art searchers, it seems similar to most people only just have their exclusive rights attorney do the search. It is usually more streamlined and accurate.

Be sure to pick a patent attorney who have some familiarity beside your technology. We patent attorneys usually specialize. You probably don't want a software expert working on a up to date pharmaceutical.

These estimates are budgeting guidelines based upon have a competent patent attorney doing the work, and include the affairs of state fees and other costs. You can look up the government fees at www.uspto.gov

Though you just asked about patent, you should ask your IP attorney about copyrights and trademarks, too. Many products can be protected by copyright and trademark within addition to rights.

Hope this helps. My email address is public. -Steve

What is the long residence outlook for the hastily food industry?

Question:

Answer:
The need to invest surrounded by bigger doors to accomadate larger people. The in one piece menu, whether they claim it as healthy food is really discouraging for your health. Slower pace societies have McDonalds, yes, but its not an everyday or every lunchtime thing thus the population around these international chains ar largely healthy empire.

But lets frontage it, we are a fast pace society, so we eat swiftly and need quickly service so sales will other be there. I doubt at hand will be much growth due to many factor such as other fast food chains, monetary needs, and a short time ago having a store contained by every town. The concentration will be on growing the buisness on what stores they have immediately and trying to remain competitive with other chains.
I conjecture it's really very virtuous. Most fast food chains are run by serious business relations who want to succeed. They will change their menu to copy the public's demand. Those who anticipate these trends, whether it's to well again foods, or just to suit the constraint for variety contained by foods, will be the most successful. Any who resist will fall astern, or ultimately fail. It's the method of business.
