ok, I've just read the adjunct to your post and that you dont use paypal! I really dont know what you can do other than maintain contacting the person and try to come to some sort of agreement. Its shocking that ebay wont attain involved though! They are the ones hosting the auction after all!! I would try and contact them again and try and return with them to do something. It does state somewhere that selling faulty merchandise, that are not being described as damaged is against the law. Maybe contact trading standards or the bureau of fair trading? You can claim through PayPal, and they really do their profession, I just get money back for two items, which be never delivered, however, if you won't report it in good time, which is 45days from the payment date, they will demur your case. Surely that's if hold paid through paypal, otherwise if you've rewarded by cheque - speak to your bank they might supply you couple of options.
