You can sue for it at any time. But if the person you take to court knows the statute of limitations they can just bring that up and they wont have to pay. On the other hand you can mess with thier credit forever until they pay.

In general how much do people get back from claiming mortgage interest, is it worth claiming?

It depends on how much interest you're talking about and if you can itemize or not.

I used to itemize every other year and made sure I paid my property tax twice in that year (January for the previous year and December for the current year) so that I'd have enough to itemize and get a greater deduction.

Anything that helps lower your taxes is worth claiming.
