Can you not money rent to Landlord for not providing satisfactory heat?

We are a married couple in New England (RI) to be exact, we enjoy two toddlers, by the time the second person is done showering be out of hot water adjectives the time. The Landlords have both said and we agree that near is some water leak or something. They have not even serviced the boiler. We other have to file them or call them to remind them to check the boiler. I own being a man enjoy even offered my help to be skilled how to deal near this when they are not available, but to no avail. Can we refuse to foot the rent or break the lease some how? We are fed up! For heavens sake we hold kids. If you care give or take a few human rights please pass this on to someone who can assist us!! Please!!


Answers: I would get it fixed myself, afterwards deduct the cost out of the rent. I am not sure this is official where your at, But it worked for me within Florida, when my Air Conditioner went out years ago. Talk to a legal representative, and see if that's okay to do there. They are the lone ones who are going to know your legal option man. Your landlord sounds similar to a card-carrying-butt-head! doing that to people near kids in the winter. He should be arrested! or lose adjectives of his properties. The jerk! Hope this help you anyways. Take care.
You do enjoy cause to withhold rent, transport the landlord a note with the problems near the apartment and that you will be withholding rent if they are not prepared, (give date). Then send the note registered mail so you know he received it.
Call the housing Authority for RI, and they will advocate you on all the other activities you can take. If the environment is not not detrimental for your children they will file a complaint near the city against your landlord as a slumlord, Good luck, but be prepared to move.

Unfortunately if you refuse to recompense the rent, you would probably be breaking your rental contract and he would be able to evict you. I would review the contract to see if here is a provision that discusses the issue you are experiencing with the paucity of heat. If this is not discussed I would probably bug the heck out of the tenant and hope the squeaky wheel get the grease...start with 2-3 call per day and increase for respectively day you don't bring satisfaction. Call your local Health Department. You can find the contact info on your towns website. They will come out inspect and issue and writ to the owner to correct the issue. If the owner REFUSES, he gets CRIMINAL CHARGES file. They are there to give support to you, use this resource. I just have a very similar situation, and my former proprietor looked really foolish when he was war his hefty fines. His fines were triple what it would enjoy cost him to fix the problems in the first place. I completed up sueing, getting my money back and moving. Good Luck
OK. Here's the skinny from the RI Statutes, relative to proprietor duties and obligations.

Supply running sea and reasonable amounts of hot hose at all times as required by Sec. 45-24.3-7, or applicable local codes if more restrictive, and believable heat as
required by Sec. 45-24.3-9, or applicable local codes if more restrictive, between October 1 and May

Within every dwelling part there must be a room, which affords privacy to a party within that room and is equipped near a bathtub or shower contained by good working condition. The hip bath or shower may be in impossible to tell apart room as the flush water closet or surrounded by another nonhabitable room, and is properly connected to a water supply system approved by the appropriate authority and which provides at adjectives times an adequate amount of heated and unheated running hose under pressure, and is connected to a sewer system or septic reservoir approved by the appropriate authority

You can use the statute(s) as you see fit. They appear to be in YOUR favor, but be alert. No judge will allow you to brand name a claim if each of two folks takes a steaming hot shower for thirty minutes respectively, and then complains around a lack of hot hose. There ARE limits to 'rational supply'.

As far as rent withholding, it does not fly under RI regulation. Self-help repairs (you pay and deduct) are constrained to those for less than $125.00 total.
If he doesn't fix the problem inside reasonable time, report them you will have it fixed and take off the amount from your rent, but you can't break your lease or refuse to reimburse rent.

Me and two other buddies of mine are looking for apartment complexs near MCC or any where on earth around there.
Ones beside decent rent and near two rooms, as two of us will room together.

I have a friend that lived at Rustic Village and that is basicly right accross the street from MCC, but it doesn't look approaching they take first year students.

Where can I find pre-foreclosure listings for free?




Answers: Check out your local newspaper under trustee sales...its in the classifieds. All foreclosures have to be listed publicly and most companies choose the newspaper to fulfill that. Check it out- you can usually go to the online version of your newspaper and sort through them online.

I am a Realtor and have access to many pre-foreclosures. Unfortunately, when in pre-foreclosure, they are not yet bank owned and the owner probably owes more than the home is worth. That would bring yo to a short sale. Where the bank has to agree to let someone buy the property for less than what is owed on the mortgage. I would honestly go for the foreclosures. Prices are better and banks are willing to negotiate.
If they go to Sheriff's sale, the Sheriff's office usually has some kind of list of what properties are offered at upcoming auctions. But they can be pulled at the last minute . . . .
