I lately give a prospective manager a $800 deposit on an apartment. Can the hotelier rent to someone else?

I recently moved to NYC, am subletting for the time individual, but will be out of this apartment in two days. I found a room to rent on Craig's List, view the room, and decided to rent it. The two empire living there met me, and both contracted I could rent the room. I went final to the apartment a second time to give them and $800 bread deposit, which they accepted, and told me it be a done deal. I be to move in this Sunday, and wage them and addition $1000 on moving surrounded by. Today, one of the prospective "landlords" called to speak they were sorry but they be renting to someone else (who was going to repay them more for the rent) and I could come and get my deposit subsidise. I hadn't signed any papers as I was to do that Sunday. Now I'm stressed out more or less not having a place to live, and upset as I really like the room (but mostly worried about not have anywhere to go, I am spanking new to NYC and don't know anyone here). Do I have any recourse? Can they do this to me? Please sustain!


Answers: I agree with Mary. No lease,no recourse. Post an poster on craig'slist and keep looking. Sorry you are going through this situation.
Go and catch your deposit and find another place to live.

If you didn't sign a lease, then you enjoy no recourse.

Keep in mind also, that it be ROOM that you were renting and not an apartment next to a landlord.is that how you want to start sour a living arrangement? Living with race that don't want you there?
I`m not familiarized with tenant law in NYC. Sorry. But once you hold placed a deposit down that constitutes a contract unless of course a credit check would inevitability to be ran.
One course you hold is to sue them for moving expences unless you placed your deposit by cash or they enjoy not cashed your check. If they have not done any of the above afterwards you have no trial standing.

Learn this presently...NEVER give anyone currency without getting a written bill! Make sure the receipt states what the money is for and is signed and dated by both party.

Thank your lucky stars that they are giving you the $800 back! You hand total strangers $800 in lolly...not the smartest thing you could hold done. Lesson learned. Find unusual room mates.

Foreclosure beside 80/20?

I bought a condo with an 80/20 loan where on earth both loans are from the same lender. Both contracts read out "purchase money" on them. I can no longer afford the payments and cannot refi because I am upside down on mortgage. If I cannot short sale and it forecloses, can the 80 loan foreclose as it's one deed law surrounded by California and then the 20 loan sue me because of the one deed law contained by California?


Answers: Did you try deed within lieu of foreclosure some banks here are doing that. Good luck, I know this is taking place to a lot a empire right now.
Foreclosures don't work any different within California than they do anywhere else.if you don't pay, they'll foreclose.

The property is sold, the proceeds payoff the FIRST mortgage loan (doesn't event if it's with two different lenders or not), and consequently if there is any money gone over after foreclosure costs, they will apply it to the second mortgage and then levy a defect judgement against you for what it didn't pay...which mode you'll most likely inevitability to file for a BK right after that.

My counsel? If you KNOW there is no passageway to avoid it...do a Deed in Lieu..if you agree to walk out the place sparkling clean, they will agree to forego the lesser amount and not charge you foreclosure fees.

You'll need to hail as the Loss litagation department with the lender to arrange it, you will both negotiate a date for you to will, and they'll send you some papers to sign.

Never agree to them forcefully take your home when you know you can't salvage it...all it does is cost you money.
In California, when a first mortgage forcloses, adjectives junior mortgages are wiped out.

The second mortgage lender is very soon an unsecured creditor and can try to get a judgement on your information. If they do they can use all legally recognized means to collect the judgement.

House auction? back please?

Hi I am looking to move house, I currently have a dble fronted victorian finale of terrace (turned on its side so it looks detached)with 3 double bedrooms. I hold done a lot of work to it, (damp course, electrics, inlay flooring, solid oak and slate kitchen, and a 're-furbished roof etc etc)it needs a current bathroom, ..bought but not fitted, and 2 bedrooms need redecorating) but I hold just found my 'dream' home (we are looking to move area) and it is such a 'bargain' (!!) I am thinking if I put my current house through a house auction what charitable of percentage would i lose on my house? I am in the Wirral (north west UK) have anyone ever sold a property through a auction? what are pros and cons? I don't mind taking a small loss, but I need to cover what i compensated.. thanks x

You can put the home up for auction near a reserve price on it. If the home will not reach that reserve price it will not get rid of. The cost would be yours for that auction if it will not sell.
