What can an apartment innkeeper discriminate against when choosing tenant?

I own a small house with a couple of apartments contained by it. The lower apartment is vacant again-- It's solitary a tiny two-bedroom apartment and I've recently begin to advertise and wish out renters.

It seems everyone who have come to see it has have 2 adults and 2 or 3 kids. Most of them have babies.

I don't mind kids or babies or dogs or cats... but the apartment is simply TOO SMALL for that tons people. And, furthermore, the other tenant contained by the house (who is an excellent tenant) has made it clear to me that he would prefer I receive someone without kids.

I obviouslly KNOW I can't discriminate by see, religion, color, family status, etc, etc, etc. But what CAN I descriminate against? Can I state that I want 2 or not as much of people living at hand?

Answers: simply you don't want to loose your good tenant, you may examine, but not discriminate.
You may; consider the amt of automobiles they have vs the amt of spaces you provide bad street.
...you may consider the applicants family amt vs bedrooms to tenant, sons, daughters & adults. i.e girl 1 bdrm, son, 1 bdrm & adults 1 bdrm...
...pets, thats your call if you want them and you do not enjoy to rent to pets, they don't pay rent and you rent to relatives...
...is the applicant financially capable to compensate all the rents and deposits up front and the rent near ease...
...are they the sort of tenant you craving to rent to...
...You needn't rent to anyone that comes off the street, you bring their applications for review and scrutinize from at hand...if not adequate to your criteria, just simply share them your refusal is conceptual. there needn't be an answer to the request for information, therefore you volunteer no recourse to the applicant for debate in a official situation and this can all be done near a call-back to the applicant.basically, its not up for discussion.

You can limit the number of ethnic group for the apartment size. I was rejected from renting a one bedroom when married because the parking be 1 space per bedroom and even when we didn't have two cars they thought we might buy a second sports car.
Since your's is a two bedroom it really isn't too small for more than one person. If you allow two associates you can't discriminate against children.
What you can do is have an application, show the apartment to several renters later pick on based on the best overall on things similar to credit and income. Tell each individual when you will decide next those that weren't selected merely need told you preferred someone else without giving them a explanation.

Also enlist the help of your current tenant. He/she may know of a friend or co-wroker explicitly looking for a place to rent. I had fitting luck with that tactic too.
You are trying to discriminate against family unit status, ie kids.

No, this would not be legal! A two bedroom is endorsed for a family of 4. Two parents, 2 kids.
it sucks but your other renter shouldnt determine who you rent to as long as their credit is obedient and has the income to support it...technically its 2ppl to one room...so for a two bed you could enjoy 4 ppl what happens if you get hold of a single mom and her kid...thats only 2 ppl you really couldnt deny her an apt because she have a child.. i live in 2 bed small apt near 3 ppl. we do just fine...

Answers: The appropriate wording, even the authority of asking them to vacate varies by state.

On the net craigslist is the best place. But again, I would not advertise the fact that you are a racist.
You cannot only rent to a certain race/origin- that is considered illegal.

Post your ad on Craigslist.com.

Ok I am going to step on some toes by answering this- but, here goes. The other people who are responding are trying to quote a Federal Law that is referred to as Title VIII. If you are renting a room or even units =under 4 units where you personally live in one of them (and you do!) the rules may change.
