When a person rents a house and the want to evict the person dont they have to go to court first ?
Answers: Yes, they have to go to the courthouse and file for an eviction notice. Atleast thats how it is in Georgia I'm not sure if these things vary from state to state. After filing the notice there is a time period for the person to get out or file an appeal and THEN it actually goes into a courtroom as a case. (if an appeal is filed). If no appeal is filed and said person refuses to leave property owner and police remove said person from property and their belongings are put out at the curb. But once again this is in georgia other states I'm not sure.
Most states require you to go to court, but this is covered by state law. I know for a fact some do not.
It is very very difficult to evict someone from a residence in most states.
Yes, in every state they need a court order. You will be notified of the court date and get a chance to appear and tell your story.
Apartment ?..?
I'm just browsing on the 'lattice for apt. I may like to live contained by (near future). What the heck is a studio? What makes it different from a 1-brm. apt?Answers: A studio is a huge approachable space with no doors to a bedroom nouns. Most of them have a bedroom nouns but it will kinda be part of the rest of the apt. It is close to a 1 bedroom with no walls inside to get a bedroom out of. Most people that live contained by studios use room dividers to divide seperate living spaces. Normally a studio would be cheaper than a 1 bedroom, also some studio apts you have to share a kitchen but most hold their own bathrooms.
studio aprtments are ones where in attendance is no seperate bedroom / sitting room / kitchen it is all one generous open nouns.
Need assistance near my partner ex flatmate!?
Hi theremy partner moved into a flat lately to share with one of his friends , as the previous flatmate be moving out.
The ex flatmate gave my partner the key on the 16th of december as both her and the current tennant were going out of the country during the christmas period. He be given the keys to check on the place every so repeatedly.
His official move within date with the letting agent be the 01/01/2008. The now ex flatemate is asking him also to pay packet for the extra 2 weeks in december. He wasnt in that as he was next to my family
does she own any claim to this
she paid up to the closing stages of december with the letting agent and my partner moved within on the 01/01/2008 as per the contract
any advice would be appreciated
gratefulness
Answers: Any such agreement should have be made beforehand with the agency! The majority folks would assume it was an perform of kindness since she wouldn't know how to be home and give the key to your partner(?). You can't just come and constraint money like that in need any verbal or written agreement since.. Just like I be nice when I moved out of my flat and the next couple moved surrounded by a week before, lacking extra cost of course. Like contained by your friends case, the apartment would hold been not in use otherwise, so why not let them come early?
(I live in Sweden though, you never know give or take a few people contained by your country suing for stuff like too hot coffee etc.)
If the ex's stuff be in the flat till the lapse of the month, and your partner had not moved their stuff into the flat or the flat be completely empty, consequently I'd say sorry but I'm not paying the rent to store your stuff.
If your partner stuff was moved into the flat during the later 2 weeks of december, it would be sort of fuzzy ... maybe be nice and bestow to give somewhat payback just to be honourable - since your partner had personal belongings within the flat before the agreement date
If you check your letting agency agreement, you'll probably find that they forbid sub-letting, which method the ex is in breach of contract if she pursues your partner.
Anyway a flat view is not occupancy.
Ignore her!
What move within date is on the contract? 01/01/2008. That is all specifically relevant
Whatever anybody else says is trash. Even if the estate agent come up tomorrow that she have to pay for the two weeks, its not enforce competent on your friend to pay.
