Advice on getting out of my possession agreement?
I've asked to get out of my contract because my manager is so useless and hasnt a clue what hes doing! We have both agreed I can do this at the ruin of the month. He came around yesterday for the rent and I asked him how we'd run about it he said I can only leave, because if we're both bright and breezy for the contract to end, near is no contract? But surely that would mean he could veto to give me my bond final by saying I merely left?He also said I wouldnt bring my bond back for going on for a week after I leave as he'd enjoy to do electrical tests and draw from an electrician out first, is this true? He's not even taken my bank details & I presume yesterday was the later day I'll see him, so seem a bit iffy to me.
Answers: It is acceptable for him to ask you to dawdle up to a month for you to get your bond put money on ... however ...
I have never prearranged a landlord draw from the electrics inspected when you move out! What does he suspect that you have be doing to the wiring and so on to explanation problems? I think it sounds okay dodgy.
All that should be required is for him to walk around the property. Any hurt that you have cause should be easily apparent to him, plus he should check that you have disappeared it clean and not not here any rubbish. But that's it - what the eye can't see doesn't exist!
However, in my experience, if a proprietor wants to save your bond there is nil that you can do about it. I've in recent times been surrounded by this situation myself. Of course it's illegal for them to do this (assuming you haven't cause any damage). But what are you going to do about it? Taking them to court will cost you more within legal fees than what the bond is worth. You can bring free legal suggestion from the CAB, but you would need to income court costs and for representation in court.
You really call for to go and see a solicitor, several are free for half an hours consultation. Alternatively you could step to Citizens Advise Bureau.
I think that you are on a sticky wicket, as he hasn't given you make out to quit for any reason, nor enjoy you given him notice to quit. This have to be done on paper, and in attendance are certain trial requirements.
If you are leaving until that time the tenancy spell has come to its proper close, then he is underneath no obligation to confer you deposit back. If you merely up and left he could thieve you to the small claims court for the amount of rent outstanding from when you left until the shutting down date of the agreed tenancy.
You must find everything in writing from him.
Moving to California and looking for an apartment to settle up for online; any concept?
I'm planning on moving to the Santa Monica area (location pretty flexible but nonspecific area) in the origination of May. I'm looking for a place I can set up on line since I am inept to travel there up to that time hand. I want to produce sure when I arrive I have a place set up (so I requirement to be able to pay packet online). I'm also hoping a monthly type lease in covering there are problems; since I can't check them out contained by person; I own the ability to move out. My other suggestion would be to call as heaps of the management company's as you can to return with there thoughts on your move; I bet you would be surprised how resourceful they can be contained by helping you make a edict like this.
