Regarding a lease contained by Florida, must I pay envelope if I didn't help yourself to possession?
I signed a lease but have arranged not to take the bungalow,as the owner does not allow smoking inside the house.This be never mentioned at the signing of the lease and is not even on the lease. What is the law surrounded by Florida about a rental which you own never taken posession of?Answers: Signing a lease is one issue... You must take possession because it is a contract... BUT you are very soon stating that the contract is trying to be altered after the fact. 1st I would write a notification, sending it certified, covering the fact that you are not exercising the "lease contract" as she is shifting the "lease contract", notice I call it a "Lease Contract" by not letting you smoke when it clearly is not in the contract.
I would skulk for her response, if negative consequently I would inform the landlord, by certified notification, that because she is trying to change the contract after the reality that you see no other recourse except to sue her for "Breech of Contract", to include legal fees, and compensatory damages and see if that simply newly settles the problem.
If she decides to sue for rental you at-least own created a "paper trial" of the type needed to win a armour in small claims court.

A lease is a written contract which you signed. You are on the hook. Why did you just assume that it would be ok to smoke inside?
