I sold my home & am one sued by the buyer. I want to know if I can countersue for my permitted fees?
For sale by owner condo transaction within IL; a special assessment was passed 8 months after I gone (they had be getting bids on the projects on & off for 3 years but never did anything). Their legal representative is claiming because the board had talk about projects within the past it be "planned" therefore I should own disclosed it and be responsible. All of this required a vote by the board and then homeowners for it to overhaul. So if the homeowners would have voted NO next noithing would have happen.How can I make sure my attorney is doing a good situation?
Can't she present the information that all of this be decided on & passed 8 months after I disappeared; I had no utter in it and ask for the crust to be dismissed?

Answers: I'm afraid that you are not going to be able to attain the case dismissed because you did know just about what the issues were and consequently should have disclosed it during the transaction. I know you have no idea on when anything would rob place but you had acquaintance about in anticipation of actions because you be the homeowner. Your lawyer know that you won't be able to seize the case dismissed but also know and is probably working on a smaller amount you would have to repay then what is mortal asked by the buyer.
You are going to lose this puppy. If your attorney told you otherwise they just want to up their payment.
Your sale be not legal, you have to disclose this. They will win and get damages, as capably as THEIR legal fees.
Legal fees are not damages, you can not database a law suit to be rewarded to file a lawsuit. Your attorney can ask surrounded by your response for fees, and will get them if you win. But, that will not be taking place.
I would try and settle out of court, this is pretty serious.
