Upland is a fairly expensive area. There is not much low income housing.

Our house is up for auction we are renters - how long will a guard pass you to move out surrounded by California?

Found out two days ago from our ex owner that the house would be auctioned in sooner or later and that within 24hrs of the auction if the property wasn't vacate they would send an Orange County Sheriff to lock up the property. Anything on the premises will be confiscated and impounded and I'd be charged to draw from our belongings back. Seems metallic as we have be paying rent etc. Surely we must have some rights here. Please tolerate me know if you have some guidance for us. We have not received any formal written communication from the ridge or anyone else. Thanks

Answers: Your lease is no longer valid, it doesn't matter what it say on it. The house is no longer a rental unit and the edge can not rent to you.

The sheriff will be by, but to tell you to move, not lock it up. Usually you hold 3 days, but you may have more if you are within a rent controlled city. The sheriff will let you know the details. They revulsion doing this, and will not be rude or anything.
Take a look at the terms and conditions of your lease agreement, viz:

1) Is in attendance a pre-termination clause? How many months interest? If there is, you own the right to remain as tenant until expiry of the agreement/contract; or
2) In the absence of any right of the proprietor to terminate your contract, the buyer of the property must honor the remaining time of your lease contract.
3)
You don't say if you hold a lease or month to month agreement. Here are some basic law for landlord termination. Technically if you hold a month to month, you have to be given 30 days discern.

However, you really need to contact the hill that is holding the auction to find out the lingo of the sale.
It comes down to your lease and state directive. Most states do have a clause allowing for 30 or 60day perceive for owner's own use. HOWEVER, if you have a lease later it's till the end of the lease and they hold to give you that concentration beforehand.

If your lease says "90 light of day notice of termination", later that is what it is. If the Sheriff comes by, you any show your lease or say "Where is my discern?" In most cases the bank/lender would have attempted to return with possession before auction, as that would attract more buyers for the property.
What you enjoy been told IS NOT TRUE. In California, you can single be evicted by a COURT ORDER. You must be notified and given a accidental to have your vote in court BEFORE a court will demand your eviction. After the court hearing, you will be given a identify to vacate by a certain date. If you are still in attendance after that date, the sheriff will come to evict you.

The property owner will have to store any property vanished and give you some time to remove it. You must repay for this storage.

Consult an Orange County attorney for a full explanation of your rights. DO NOT let a lender bully you.

How do I bring out of my lease if I am buying a house?

I am currently in the closing phase of buying my first house. I am on a month-to-month lease next to my apartment complex. Set to close on or before Feb. 14, but immediately my apartment complex is telling me I enjoy to give them 30 sunshine written notice that I will be moving. I own been upfront roughly speaking my living situation with the rental organization throughout this whole process and even signed a 3 month lease prior to the month-to-month rental. Are within no special circumtances such as this that would allow me to break my lease with little to no penalty?

Answers: There are no provisions or special circumstances to allow you to break your lease with little or no cost because you are purchasing a home. Landlords issue leases for a justification, to get as much income from a property as possible, and you are bound by the vocabulary of that lease.

By my calendar, if you gave interest today, you only own to pay 9 days of rent.

If you own been a righteous, long term tenant, it wouldn't hurt to ask for a break on this thought, but don't expect a positive response.
you are going to have to settle up rent for all of Feb.

which might be a biddable thing, that approach you don't have to rush to bring back moved out
As everybody said, you have to hand over them the full 30day notice, so you may be liable for the 15days extra. If you dont compensate it (assuming you dont have a deposit next to them) then they'll a moment ago throw it on your credit, even worse.

Far as special circumstances go, near arent any I can think of, you'd enjoy to check your lease as they do vary. I"ve see some that have a "Moving due to job" clause but they'll want to see it and proof as okay. In this situation best way is only just to take the loss. You can change/cancel the utilities on the 14th (provided you're not within a northern state or anywhere that it could get cold ample to freeze the pipes). That would save you some money.
Give them a written 30 year notice today. That would put you at Feb 22nd. Thats 8 days long-gone your closing date. Which is good. Gives you that tons days to get adjectives your stuff out, you dont have to stress almost moving it all within one weekend or a day. You will with the sole purpose have to repay rent til the 22nd, they should pro-rate it for those days.
