Do you have to remove a dead spouse from a house deed?




Answers: You don't have to, but it is always a good idea. Take a certifed copy of the death certificate to whoever handles your deed. It will be one less thing that will need to be done later.
The answer to your question depends upon how you and your deceased spouse held title.

If you held it as joint tenants with rights of survivorship, or tenants by the entirities, then all of the house became yours when your spouse died and bypassed probate by operation of law. It is not necessary to file a new deed with your name only on it, but if you do not, be prepared to show the death certificate of your deceased spouse whenever you decide to sell it.

If you held title as tenants in common, then your deceased spouse's estate must determine, through probate, the heir which shall receive this share of the house. If it is not you, then a new deed would need to be drawn up showing you and the other person.

Sachs in its year 2008 financial report said Fed may cut the interest rate up to 2.75%, how do I translate this to % of reduction within Mortgage rate. Currently prime rate is ~4.00% and 30 fixed mortgage is ~5.25%. when this fed 2.75% rate cut lug effect how much will be the 30 year fixed mortgage and when we can see the lowest mortgage rate?
