Renting Real Estate Questions and Answers

"Me and my buddys get evicted from our apartment for excess hullabaloo, we have 3 months to dance...?

now they are claiming WE owe them remaining rent, more fees, and a few repairs. Is this legal, what if I deny to pay??

Answers: Yes - its fragment of the lease agreement you signed. You owe rent thru the end of the lease as powerfully as any damage repair's for damages to the property while you lived you at hand. If you refuse to wage, you will be sued and you don't want to go nearby - wage garnishments, personal belongings being sold to money the debt, etc...
You have every official right to refuse. Please consult a residential use authority in your nouns. They will be able to push for your best course of action.

Please do not remuneration anything or be pushed into anything with the unadulterated estate agent. Consult your legal rights first!!
Be grown up in the order of it. politely meet beside the landlord, apologize and try to work out a compromise beside them. If you're going to rent elsewhere, you'll need to put down where on earth you lived before, and you don't want the aged place holding you back.
perfect luck.. also, they have your deposit deposit (I assume) to fix the objects broken. Try to use that to calm them down a bit.
At tiniest TRY to repair some of your rep.. it won't cost you anything to at least try.
By any manner I'm not an attorney nor am I schooled within this stuff, Im just going by what little I hold read and and heard.

First it will depend on where on earth you live (different states have different law concerning this) and 2nd it will depend on your lease.

But from my understanding an eviction process will eventually budge to court where you will be ordered to repay the remainder. But those 3 months that are left they enjoy to try and lease out the place again and if they do you wont have to settle up them from the time they do lease it out and the time your lease would expire (Its called double dipping-excepting transmittal from 2 parties and it is wrong for landlords to do).

Also if they have or haven't started the eviction process and you do supply them a rent payment and they except it I believe the eviction become voided. And when you go to court over the eviction purely present the reciept of payment to the conciliator and he/she should void the eviction process and require them to start it over again.

Landlords can't except rent payments from tenant they are evicting. If they want the money they need to do the eviction process and hold it court ordered otherwise it is seen as them upholding the lease and allowing you to stay.

But once again Im not an attorney nor do I do any of this stuff for a living and I push for you to seek permissible help
Also...Florida is one of the few states that the manager does not need to mitigate his damages...significance, he does not need to try to re-rent the part to lessen his damages incurred by your breach. Pay what you owe so your credit/rental history is not ruined for years.

Is it smart to purchase a rental property if I am currently renting?

I am currently living in an apartment. I am considering purchasing a home contained by the area to help yourself to advantage of the current physical estate market. I will rent the house and verbs living in my apartment.

if you can rent the home for more than the mortgage payment and other expenses per month next it is a great move. you get the house as an asset and the renters pay cheque for it.

My manager own not returned warranty deposit? 10 points for the best recommend. Thank you?

She is the most flip flop woman I have ever met. She is adjectives about money. I moved out on Dec 12. I hold not received anything from her.

Actually, I don't really want the money, but I just HATE to consent to her take profit from me and others.

Answers: Many landlords do this. They know that you will have to filch them to small claims court and they hang on to the currency. It costs 65 dollars to file a claim. Send her a registered missive and tell her that it is iffy to with hold the wellbeing dep. Tell her you will pick it up from her. If she doesn't comply then nick her to court. It is worth go through the process surrounded by order to build your confidence within the system and to use this avenue in the adjectives if you need to.
Why hasn't she returned it? Was the house not here in a mess? If not consequently just do whta i did when it happen to me.
I sent my landlord a memo advising if i didnt hold the money returned within 7 working days i would be taking court action on the situation.
I spoke to the citizens advice who told me i have to do this first and keep a copy of the memorandum i made and send the notification recorded distribution so she cant worm out of it by saying she hasnt get the letter.
I be lucky as when i sent this i got my money pay for.
The next item to do if you dont get any rapture is to visit a solicitor and ask for direction on what to do next, guidance is free with some solicitors. They may advocate you to get a formal communication from a solicitor which costs about lb30 and it will utter if she does not return the money they will look to take her to the small claims court.

Good luck, hope you achieve it back.
Without knowing what state you reside within, it's hard to provide advice on what law prevail reqarding security deposit. State law can vary anywhere from 15 to 60 days, where on earth some states, such as New York, have no set time..with the sole purpose "reasonable".
